Precision Framing Systems Inc. v. Luzuriaga

(California Court of Appeal) - Affirmed. Plaintiff performed framing work on a commercial building owned by Defendant. Plaintiff was not paid for his work and filed a mechanic’s lien. Defendant complained of problems with some of the framing and Plaintiff performed repair work. Plaintiff filed this action to foreclose on its mechanic’s lien. The trial court granted Defendant summary judgment ruling that the mechanic’s lien was filed prematurely, before Plaintiff had ceased work. The appeals court agreed.

Duthie v. Matria Healthcare, Inc.

(United States Seventh Circuit) - In a suit arising out of alleged fraud by officers of a corporation acquired by defendant, a preliminary injunction preventing defendant from proceeding with an arbitration hearing on the fraud claims is affirmed where the merger agreement between the two companies did not mandate arbitration of the types of claims defendant asserted against plaintiffs.

City of Hesperia v. Lake Arrowhead Comm. Serv. Dist

(California Court of Appeal) - Affirmed. Plaintiff sued to prevent Defendant from violating city zoning laws to construct a solar energy project. Defendant claimed an exemption under Gov. Code, section 53091 and 53096. Court found that exemption does not apply and that there was no finding that no feasible alternative was available.

PHL Variable Ins. Co. v. Town of Oyster Bay

(United States Second Circuit) - Affirmed. Trial court dismissed Plaintiff’s complaint for failure to state a claim on the grounds that the claimed agreement entered into with Defendant had not be approved by the Defendant’s governing board as required by New York Town Law, hence there was no valid and enforceable contract.

(United States Second Circuit) - Held that recipients of unsolicited spam text messages had legal standing to bring a lawsuit against the company that sent them. Affirmed a ruling in a class action suit under the federal Telephone Consumer Protection Act.

Trinity Warner v. Experian Information Solutions

(United States Ninth Circuit) - Affirmed Defendant’s summary judgment against Plaintiff, holding that the Fair Credit Reporting Act did not require Defendant to initiate a reinvestigation of incorrect credit report items because Plaintiff did not directly notify Defendant of disputed items.

Marriage Is Like a Garden

How to cultivate love and root out weeds in your marriage.

Marriage is like a garden. It needs intentional care and cultivation. When weeds grow, they must be pulled up from the root immediately. If we don’t pull up weeds by the root they will continue to grow back, eventually overtaking and killing the garden.

So how do we care for and cultivate our marriages?

1. Let the Gardener (God) care for and cultivate your garden by letting him plant it. (See Eph. 5:25–33).

It is important for husbands and wives to realize that their marriages are a picture of Jesus and his church. The husband represents Jesus and the wife represents the church. The husband loves and sacrifices for his wife, and in response to his love, the wife respects and follow her husband’s leadership.

2. Let the Gardener care for and cultivate your garden through the work of Jesus.

God cares for our garden by applying his grace to our lives through Jesus. In Christ,

  • We are forever forgiven (Eph. 1:7)
  • We are as righteous as Jesus (Rom. 5:9)
  • We are loved (Eph. 1:5)
  • We are reconciled to God (Rom. 5:10)
  • We are regenerated with the life of Jesus himself (Gal. 2:20)
  • We are God’s dwelling place and temple (Eph. 2:19–22)
  • We are sealed and filled by the Spirit (Eph. 1:13; 5:18)
  • We are the body of Christ (2 Cor. 12:12)

The nutrients of grace, when received and acted upon by faith, keep our gardens green and healthy.

3. Grow your garden by working on it.

A great marriage takes great work.

  • Read books on marriage.
  • Attend marriage conferences.
  • Get marriage counseling.
  • Date each other.

4. Pull up weeds immediately!

In 15 years of counseling married couples, I have seen that unforgiveness leads to a pattern of unhealthy behaviors, bitterness, and contempt. ...

(United States Third Circuit) - Affirmed a conviction on drug-trafficking charges. Raising a venue challenge, the defendant argued that he could not reasonably have foreseen that conduct in furtherance of the conspiracy would have occurred in the Eastern District of Pennsylvania. Rejecting his argument, the Third Circuit declined to adopt a reasonable foreseeability test for venue.

(California Court of Appeal) - In a Chapter 7 bankruptcy case, held that when the nature of a debt is such that its discharge will directly and adversely impact the finances of the debtor's spouse or former spouse, it is nondischargeable in bankruptcy, even if it is not directly payable to the spouse. Affirmed the district court.

Abdul-Mumit v. Alexandria Hyundai LLC

(United States Fourth Circuit) - Affirmed the dismissals of three consumer lawsuits alleging that Hyundai Motor America misrepresented the estimated fuel economy of certain models of the Hyundai Elantra. In affirming the dismissals, the Fourth Circuit held that the complaints failed to satisfy federal pleading standards, except as to a single claim in one of the complaints, which the appeals court dismissed for lack of jurisdiction.

(United States First Circuit) - Affirmed a conviction on drug-smuggling charges. The defendant, who was caught with two other men aboard a vessel carrying 70 kilograms of cocaine, argued that he was a mere transporter of the contraband and thus was entitled to a minor participant reduction under the U.S. Sentencing Guidelines. Finding no error in the sentence, the First Circuit affirmed.
