Impeachment Inquiry Update & California Democratic State Endorsement Convention Preview

Members of California’s Congressional delegation are center stage at the House Intelligence Committee impeachment inquiry hearings on Capitol Hill. The chair of the committee is LA area Democratic Rep. Adam Schiff. The ranking Republican member of the same committee is Fresno Rep. Devin Nunes. Other Californians are Democrats: Bay Area Rep. Jackie Speier and East Bay Rep. Eric Swalwell. McClatchy DC reporter Kate Irby joins Insight. She follows the California Congressional delegation.

California’s State Endorsement Convention is this weekend in Long Beach. One of the surprises is that candidates Massachusetts Sen. Elizabeth Warren and Former Vice President Joe Biden will not attend. What does this mean?

On Saturday, Nov. 16, the California Democratic Party in conjunction with Univision will host a televised 2019 Presidential Forum from 4 to 6 pm PST. Confirmed candidates are New Jersey Sen. Cory Booker, South Bend Indiana Mayor Pete Buttigieg, Former Health and Human Services Secretary Julián Castro, California Sen. Kamala Harris, Minnesota Sen. Amy Klobuchar, Vermont Sen. Bernie Sanders, investor Tom Steyer, and entrepreneur Andrew Yang. CapRadio’s Capitol Bureau Chief Ben Adler provides a preview to this weekend’s convention.

Why I Celebrate Black History Month

Black history month is not just for black people. It's for all people.

Note: I use the term “Black History Month” rather than “African-American History Month” because a friend informed me that there are individuals who would not be considered African-American, but still very much are considered part of Black history, like Marcus Garvey and others. In general, I tend to use the terms "black" and "African-American" interchangeably, and I apologize in advance if anyone finds this offensive.

Every February is Black History Month. I have to admit that before a few years ago, I didn’t really celebrate it in any real way, besides some cursory acknowledgement. But now, I actively celebrate Black History Month, both in my personal life as well as in the life of the church. I don’t do so because it’s the right thing for an educated person to do, or in an attempt to pander to political correctness. Nor do I do this because I consider myself anything close to an expert on black history and culture. The reason I unapologetically celebrate Black History Month is because the past couple of years of my life have made me realize that, even as a Korean-American, it was only appropriate that I do so.

The first event that brought me to this realization was that whole “Make Me Asian” and "Make Me Indian" thing. Two years ago, there was an app on the Android market called “Make Me Asian”, which took photos from your phone or mobile device and digitally altered them. This seems benign enough, but the manner in which they altered them was that they made your skin tone yellow, your eyes slanted, slapped a fu-manchu mustache on your face, as well as a rice paddy hat on your head. Of if you wanted to pretend to be a Native ...

Preston v. Superintendent Graterford SCI

(United States Third Circuit) - Affirmed the denial of habeas relief to a defendant who alleged violation of his Confrontation Clause rights. The defendant, who was convicted of third-degree murder, challenged the use of prior statements of a witness who refused to answer any substantive questions on cross-examination. While agreeing that the defendant's rights were violated, the Third Circuit concluded that his Confrontation Clause claim was procedurally defaulted and there was no cause to excuse the default here.

Gordon v. Cgna Corporation

(United States Fourth Circuit) - Affirming the summary judgment to an insurer that paid only half of a life insurance policy following the policy holder's death because the reduced coverage was the result of mistakes made by the employer, not the insurer, so the insurance company did not breach any duty it may have had under the Employee Retirement Income Security Act.

US Tobacco Cooperative Inc. v. Big South Wholesale of Virginia, LLC

(United States Fourth Circuit) - Held that the United States should be substituted as a party defendant in a lawsuit in which two defendants were tobacco industry businesspeople who had agreed to perform undercover work for the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives. The question before the Fourth Circuit was whether the United States should be substituted as a party defendant. The panel held that the answer was yes, and thus reversed the district court's ruling on the matter.
