Colorado Court Decides Issue of First Impression Regarding ERISA Preemption of State Divorce-Revocation Statute

The Colorado Court of Appeals recently decided an issue of first impression regarding the Employee Retirement Income Security Act’s (ERISA) preemptive power over Colorado’s divorce-revocation statute. The decision in Ragan v. Ragan, 2021 COA 75, settled an open question in Colorado regarding whether ERISA preempts “post-distribution” lawsuits under Colorado’s divorce-revocation statute. Specifically, the court held that ERISA preempts lawsuits against a former spouse to recover plan benefits that were distributed to the former spouse as the named beneficiary.

Supreme Court Declines to Hear Appeal in ERISA Class Action Permitting Recalculation of Benefits as Available Relief

The U.S. Supreme Court declined to review the Second Circuit’s decision in Laurent v. PricewaterhouseCoopers LLP, which held that retirees could receive money damages in the form of recalculated benefits in a class action over how the company’s cash balance pension plan calculated lump-sum benefits.

Supreme Court Sends Case Involving ERISA Breach of Fiduciary Duty Pleading Standard Back to Seventh Circuit for Revised Analysis

On Monday, January 24, 2022, the U.S. Supreme Court issued an opinion in a case of critical interest to employers offering 401(k) or other defined-contribution retirement plans.  In Hughes v. Northwestern University, Case No. 19-1401, the Court voted unanimously to vacate a decision from the U.S. Court of Appeals for the Seventh Circuit, temporarily reinstating allegations by employees of Northwestern University that the fiduciaries of Northwestern’s retirement plans had violated the duty of prudence required by ERISA.

Second Circuit Finds No Successor Liability for ERISA Withdrawal Where Employer Did Not Acquire Unionized Facility or Employees

On January 27, 2022, in New York State Teamsters Conference Pension and Retirement Fund v. C&S Wholesale Grocers, Inc., the Second Circuit joined the Third, Seventh, and Ninth Circuits in applying the doctrine of successor liability to claims for withdrawal liability under the Employee Retirement Income Security Act (ERISA). The court did not, however, find successor liability in this case because the acquiring company specifically did not acquire the facility or employees that triggered the liability.

Over the years, attempts to arbitrate breach of fiduciary duty claims under the Employee Retirement Income Security Act (ERISA) Section 502(a)(2) have had varying results.1  One court recently recognized that “whether any benefits plan may agree to submit to arbitration and/or whether an individual employment agreement may compel claims on behalf of a benefits plan to proceed to arbitration are not issues of clearly settled law.”2  This issue is before two circuit courts of appeal this year.  So far, the court rulings in the cases seem to provide some guidance while a

Characterisation of ultrafine particles from a waste-incinerator plant

Ultrafine particles emitted from a waste incinerator plant in Italy have been characterised in a recent study. The results suggest that a fabric filter was efficient at cleaning particulate matter from the exhaust gases. Data produced by the study could go on to be used by scientists studying the potential health impacts of ultrafine particles.

This invention relates to the oligomerization of olefinic compounds in the presence of an activated oligomerization catalyst. The invention also extends to a particular manner for providing an activated oligomerization catalyst. According to the present invention, there is provided a process for producing an oligomeric product by the oligomerization of at least one olefinic compound, the process including (a) providing an activated oligomerization catalyst by combining, in any order, iii) a source of chromium, ιv) a ligating compound of the formula (R1)mX1(Y)X2(R2)n wherein X1 and X2 are independently an atom selected from the group consisting of nitrogen, phosphorus, arsenic, antimony, bismuth, oxygen, sulphur and selenium or said atom oxidized by S, Se, N or O where the valence of X1 and/or X2 allows for such oxidation, Y is a linking group between X1 and X2 which linking group contains at least one nitrogen atom which is directly bonded to X1 or X2, m and n are independently 0, 1 or a larger integer, and R1 and R2 are independently hydrogen, a hydrocarbyl group, an organoheteryl group or a heterohydrocarbyl group, and the respective R1 groups are the same or different when m>1, and the respective R2 groups are the same or different when n>1, in) a catalyst activator which is an organoboron compound including a cation and a non-coordinating anion of the general formula [(R10)xL*-H]+[B(R20)4]− wherein L* is an atom selected from the group consisting of N, S and P, the cation [(R10)x L*-H]* is a Bronsted acid, x is an integer 1, 2 or 3, each R10 is the same or different when x is 2 or 3 and each is a —H, hydrocarbyl group or a heterohydrocarbyl group, provided that at least one of R10 comprises at least 6 carbon atoms and provided further that the total number of carbon atoms in (R10)x collectively is greater than 12, R20 independently at each occurrence is selected from the group consisting of hydride, dialkylamido, halide, alkoxide, aryloxide, hydrocarbyl, halosubstituted-hydrocarbyl radicals, halosubstituted-alkoxide, halosubstituted-aryloxide and a halosubstituted aromatic ring moiety with at least one halide substituent on the aromatic ring, and vi) an aliphatic solvent, and (b) contacting the at least one olefinic compound with the activated oligomerization catalyst to produce an oligomeric product.

The present invention relates to a polymerization-curable composition for the preparation of biodegradable, biocompatible, cross-linked polymers on the basis of polyvinyl alcohol comprising: 5 to 100% by weight of (a) vinyl ester monomer(s) of one of the general formulas (I) to (III): wherein X is oxygen, sulfur, nitrogen, or phosphorus; n is 1 to 1000, at least 20% of the n being ≧2; the R1 are selected from hydrogen; straight, branched or cyclic, saturated or unsaturated, n-valent hydrocarbon groups having 1 to 30 carbon atoms, which optionally have heteroatoms and are optionally substituted with one or more substituents selected from —OH, —COON, —CN, —CHO, and ═O, and n-valent radicals of biodegradable, biocompatible oligomers and polymers; m is an integer from 1 to 5; the R2 are selected from hydrogen, —OH, ═O, and the options listed for R1; and the R3 are selected from hydrogen, —OH, and the options listed for R1; 0 to 50% by weight of ethylenically unsaturated co-monomers; 0 to 10% by weight of (a) polymerization initiator(s); and 0 to 95% by weight of solvent(s).
