stage Chembur hospital holds dead patient hostage until family pays the bill By www.mid-day.com Published On :: 06 Oct 2018 04:47:23 GMT A month after she noticed what looked like an insect bite on her hand, Chanda Verma, 45, mysteriously died, after spending 22 days in the ICU. Before the Verma family could even process what had happened, the hospital handed them a bill of Rs 3 lakh, and refused to release the body until they paid up. Late August, Chanda noticed a small sore on her hand. As a single mother supporting two kids on a modest income as a vegetable vendor, she brushed it off as an insect bite. But, in a few days, her hand swelled up and the pain became unbearable, and she was admitted to Sai hospital in Chembur, where she underwent surgery. Mystery illness jolts familyDespite treatment, her condition deteriorated, and her entire body was swollen. She was moved to the ICU, where she spent 22 days in comatose state before succumbing to the infection on Tuesday. The shocked family's ordeal had only begun. When the family said they wanted to perform her last rites, they were handed a bill instead. The hospital held the body for nearly 12 hours, until the Vermas paid a portion of the bill. "Around 10 am, I was informed that my sister had passed away. The hospital immediately gave us a bill of Rs 3 lakh. When I asked them when I could take the body, they ordered me to pay the pending amount, and threatened that they wouldn't release the body otherwise. We waited and pleaded, to no avail. Then my friends helped me collect Rs 50,000, which we gave before collecting the body," said Chanda's brother Ratan Verma, who runs a small local business. Chanda had died at 4 am, and her body was eventually released at 3 pm. She is survived by two children, aged 16 and 18. Hospital saysA hospital staffer told mid-day, "The patient had a pending bill, so we couldn't release the body. The family members tried to shrug it off saying they didn't have any money. Later, they paid Rs 50,000 and took the body. What would we have done with the body anyway?" Administration in-charge Padma Joseph said, "We had given them a lot of time to clear the bills. She was admitted for 20 days and the bill amount rose to above Rs 3 lakh. They paid around R1lakh, so, we asked them to pay the remaining as this is a private hospital and we can't let go of unpaid bills. This does not mean we held back the body. When they informed us that they could pay only Rs 50,000, I told the director who instructed us to give them the discharge file." Dr Abid Sayyed, director of the hospital, said, "We had informed the family about the estimated amount and also asked them to shift the patient to another hospital, but they didn't listen. When the patient died, the doctor had to negotiate the pending amount. We never stopped them from taking the body," he said. Against apex court, HC rulingThe hospital's alleged insistence on payment before releasing the body is in violation of human rights and a judgment given by the Bombay High Court in January. The HC, while hearing a public interest litigation on bill disputes at hospitals, stated that detaining any patient for an unpaid amount is illegal. Last year, the Delhi High Court had issued a similar judgment, ordering that hospitals cannot hold patients "hostage" to extract money for unpaid bills. A few years earlier, the Supreme Court had also ruled similarly, advising hospitals to recover dues by moving court for legal recourse. In 2016, HC asked the state government to develop a mechanism which would enable the state to take action against hospitals and doctors who detain patients and hold up bodies over non-payment of bills. ExpertspeakDr Shivkumar Utture, president of Maharashtra Medical Council (MMC), said as private hospitals do not come under the purview of the council directly, there are no specific rules for that, but under the court rules, it is prohibited. "No hospital can refuse to release a body over unpaid bills. It would be a violation of the court judgment." The Bombay HC also ordered the Maharashtra government to publish the legal rights of patients online, so that such harassment is not meted out to less privileged patients. However, seven months on, the government is yet to follow the directive. "Patients need to know about their rights so that private hospitals can't harass them. The state government hasn't done anything to spread awareness among people," said Dr Ravindra Singh, a health activist. Advocate Shailesh Sadekar said, "As per a SC ruling, it is illegal to hold a body and deny a chance to carry out the last rites over a bill," he said. But, when the neighbourhood children's choir became defunct about a decade ago, Celeste, now 60, decided to start her own music education avenue with Gleehive, spearheaded by a children's choir. "She wanted to start her own choir for the neighbourhood kids to learn and appreciate music," says Dawn Cordo, her 30-year-old daughter. And they will be bringing some of the magic and sense of belonging that comes with being part of a choir to Mumbaikars at their annual concert, The Gleehive Buzz, tomorrow. It's their teaching style that makes this concert a tad different from others. "Our classes are not academically driven and we don't have any certification. So, it's not just meant for people who can sing, but anyone who appreciates music," says Dawn, who completed her degree in music education from Berkley College of Music and decided to come back to start an education programme, besides singing backing vocals in studios and doing vocal arrangements for artistic projects. Dawn Cordo The evening will go on to show their growth from being just a choir, as there will also be small instrumental ensembles with students playing string and woodwind instruments. The kids, aged between five and 15, will show their dancing skills as well as play different characters on stage. "The music won't just be classical or jazz, but also include songs from musicals like The Ugly Duckling. The theme is markets from around the world because we wanted to show that life is like a marketplace where you meet people from varied cultures, you get things and you lose things, and even when there's a disagreement, we always approach one another with kindness and love," adds Dawn. The performers also include kids with autism and ADHD, who, Dawn says, have only benefited from pursuing their musical interests. "Music is therapeutic. There's a student who communicates better because of the feeling of being included. It's also important for kids who aren't exposed to those with special needs to mingle with them," shares Dawn. His name was Johnny Lever! On the flight everybody would take over the economy class, fold forward all the seats to make a huge à¤à¤¦à¥à¤¦à¤¾ like setting and the musicians, singers and dad would sing and jam and maybe create a new song to be performed later that night at the next venue. This routine went on 3 days straight. I doubt they must have slept for a collective 2 hours over those weekends. Functioning purely on adrenaline! Rest during the week and the routine would resume from Friday, again. What times! As a child standing in the wings looking at the show in awe and wonderment. Not realising at that time the legends that I was blessed to witness perform live. Secretly imagining myself on that stage once I grew up. This was for the "Help" telethon which was done to raise money to help all the victims of the devastating tsunami which occurred on December 26th 2004. This huge enterprise of getting the entire Hindi film industry together ( a Herculean task) was spearheaded by @duttsanjay . And although I was slated to make my debut stage performance in Amsterdam for the IIFA awards later in the year, I just couldn't say no to the cause and Sanju sir. Both dad and I performed to a mix/ medley of his song रंग बरसे and "one love" a track I had done as a cameo in my dear friend @suniel.shetty film Rakth. The show took place in early February 2005. Both dad and I were shooting for "Kajra re" with Aishwarya for Bunty aur Babli. I would shoot the song all day from 9am to 10pm and then drive to the concert venue and rehearse all night. I even spent my birthday shooting Kajra re ( but that is a different story, reserved for another Friday). At night, after the shoot I remember when I reached the venue for my rehearsal all the lights were off!!! Thinking that I had made a mistake and showed up to rehearse when there wasn't any.... Suddenly all the stage lights came on and all the dancers, Ganesh Hegde the choreographer, stage hands and technical staff surprised me! Then Sanju sir and @walia_bunty ( he was one of the organisers) rolled out a huge cake and a birthday present for me. They all sang and managed to embarrass me to bits! What fun. Good times! His father, TH Vinayakam, fondly known as Vikku Vinayakam is a Grammy winning ghatam player, while his grandfather TR Harihara Sharma was among the pioneers of percussion in India. "I believe that I am blessed to be a part of a heritage that has made music its tradition rather than just a profession," says Selvaganesh, who is touted as the 'kanjira king'. He along with his son Swaminathan will be in the city to match beats in what promises to be a fun concert. Speaking of his son, Selvaganesh says, "To perform alongside your child on one stage is a feeling that cannot be described. Swaminathan is an amazing son and a musician and most of the credit goes to my father. He is the one under whom Swami has trained." This father-son duo entirely relies on the magic of spontaneity when it comes to performing. "Our performances are not planned or rehearsed because everything is about that moment. It's like we play question and answers in the language of music. I throw questions at him and he responds. So, if you have to expect anything from this concert, that would be nothing.
