Black history month is not just for black people. It's for all people.

Note: I use the term “Black History Month” rather than “African-American History Month” because a friend informed me that there are individuals who would not be considered African-American, but still very much are considered part of Black history, like Marcus Garvey and others. In general, I tend to use the terms "black" and "African-American" interchangeably, and I apologize in advance if anyone finds this offensive.

Every February is Black History Month. I have to admit that before a few years ago, I didn’t really celebrate it in any real way, besides some cursory acknowledgement. But now, I actively celebrate Black History Month, both in my personal life as well as in the life of the church. I don’t do so because it’s the right thing for an educated person to do, or in an attempt to pander to political correctness. Nor do I do this because I consider myself anything close to an expert on black history and culture. The reason I unapologetically celebrate Black History Month is because the past couple of years of my life have made me realize that, even as a Korean-American, it was only appropriate that I do so.

The first event that brought me to this realization was that whole “Make Me Asian” and "Make Me Indian" thing. Two years ago, there was an app on the Android market called “Make Me Asian”, which took photos from your phone or mobile device and digitally altered them. This seems benign enough, but the manner in which they altered them was that they made your skin tone yellow, your eyes slanted, slapped a fu-manchu mustache on your face, as well as a rice paddy hat on your head. The apparently unarmed motorist and his wife filed this suit alleging that the officers violated the motorist's Fourth Amendment rights. On interlocutory appeal from the denial of qualified immunity, the Third Circuit held that the officers' conduct was within the bounds of the Supreme Court's relevant decisions regarding the use of lethal force, and the officers were entitled to summary judgment on qualified immunity grounds.

(United States Fourth Circuit) - Vacating relevant orders by the district court granting habeas relief and remanding with instructions to dismiss a habeas application with prejudice in a case involving a man, convicted for crimes he was committed when he was 15, that resulted in a 118 year sentence because although the Supreme Court prohibited jubenile offenders convicted of nonhomicide crimes from sentences of life without parole a partial pardon that reduced his sentence to 40 years rendered the habeas petition moot.

(United States Fourth Circuit) - Held that plaintiffs bringing three wrongful death nursing home malpractice claims were entitled to punitive damages. The nursing homes argued that they were not liable for punitive damages because there was no aggravating factor justifying such an award, and the trial court granted their JMOL motion. Reversing, the Fourth Circuit held that the plaintiffs had presented evidence sufficient for a reasonable jury to award punitive damages under North Carolina law.

(United States Fourth Circuit) - Held that the National Labor Relations Board was not entitled to preliminary injunctive relief directing two hospitals to bargain in good faith with a labor union representing nurses and take other actions. The NLRB argued that the district court ought to have granted its request for a preliminary injunction under section 10(j) of the National Labor Relations Act. Finding no abuse of discretion, the Fourth Circuit explained that the Board had not demonstrated that the effectiveness of its remedial power would be in jeopardy unless a preliminary injunction were imposed.
