Nielen-Thomas v. Concorde Investment Services LLC

(United States Seventh Circuit) - Held that a state law fraud lawsuit against an investment adviser was precluded by the Securities Litigation Uniform Standards Act. The statute's definition of a "covered class action" includes any class action brought by a named plaintiff on a representative basis, regardless of the proposed class size. Affirmed a dismissal.

(United States Ninth Circuit) - Affirmed a real estate business's Chapter 11 reorganization plan. Held that the plan was lawfully proposed even though a lessee illegally grew marijuana. Rejected a challenge brought by the United States Trustee.

Peaje Investments LLC v. Financial Oversight and Management Board for Puerto Rico

(United States First Circuit) - Held that a Puerto Rico Highways and Transportation Authority bondholder did not hold a statutory lien on certain toll revenues. The bondholder contended that, in response to Puerto Rico's financial crisis, the Puerto Rican government was diverting toll revenues to which the bondholder was entitled under a lien and using them for purposes other than paying the bonds. However, the First Circuit concluded that the bondholder held no statutory lien on the toll revenues.

A Glorious Review of The Postmodern Adventures of Darger and Surplus

My Subterranean Press collection, The Postmodern Adventuers of Darger and Surplus,  has received quite a splendid review for Locus by Gary K. Wolfe, which has now been posted on Locus Online. Darger and Surplus are, as you probably know, gentlemen grifters in the future civilization that rises from the ashes of our own, after a failed revolution by the Artificial Intelligences we are currently hard at work creating. Humanity mostly won that war and the demons and mad gods were banished to a subterranean infrastructure too widespread and well-defended to be rooted out. But, as a result, the mechanical sciences have languished while the biological ones thrive.

All this is spelled out in the review more entertainingly than I have put it here. I encourage you to read it.

Meanwhile, here's the pull-quote I'd grab from the review if I were the sort of person who did that sort of thing:

As those Hugo voters apparently recognized nearly 20 years ago, Darger and Surplus not only join the small company of SF’s classic rogues, but the world they occupy is as complex, detailed, and morally chaotic as we’ve come to expect from the best of Swanwick’s fiction.

Austerity and Structural Adjustment for Europe

For a while now many European governments have resorted to austerity measures to deal with the recession and financial crises affecting them. This may have either been by choice, or pressured from the outside.

However, as has been warned countless times, excessive austerity rarely works. Furthermore, focusing on debts and deficits appears to miss the point that the economic problems were caused by a collapse in markets and banking sector in particular, resulting in less revenues for governments; not necessarily an excessive overspend by governments.

Some of the policies being forced through even when evidence appears to show they do not work lead many to think that austerity and structural adjustment policies are being ideologically pushed for — just as they were on most of the developing countries for almost 2 decades with devastating results.

Indeed, in the US, investigations have found billionaires pouring hundreds of millions of dollars on campaigns to fix the debt making it appear as a grassroots movement. Fixing the debt of course happens to leave the elite less affected, so it works to their advantage to push for something like that.

Without more focus on appropriate economic growth, there is a real risk in going backwards, and even undermining democracy.
