Enhancing consumer & investor protection from ICO scams

The rise of new technologies is changing the way companies raise funds. Along with increased popularity of crowdfunding in recent years, a new form of funding has emerged – that is, the use of Initial Coin Offerings, or ICOs. In 2017, companies in the United States raised over $4 billion through ICOs; in 2018, more than $21 billion has been raised. ICOs generate many challenges for securities regulators, and also give rise to other issues including corporate governance, data protection, anti-money laundering and insolvency. Assistant Professor Aurelio Gurrea-Martínez from the SMU School of Law has conducted legal research on financial regulation. In this podcast, he shares his recent comparative and interdisciplinary study which addresses the issue of ICOs and makes recommendations to regulators and policy makers in a way that aims to promote innovation and firms’ access to finance without harming investor protection, market integrity and the stability of the financial system.

Robert here with the second part to the pentatonic lesson. I hope you got a grasp on lesson one because this lesson is a direct continuation. Enjoy it and remember if you have any questions place them in any comment section of www.bluesandjazzguitar.blogspot.com. Have fun!

What follows is the superimposing of a major pentatonic scale, whose root will change, over a static root. This will produce the relationship of:

Maj. Pent.
Static root

The major pentatonic scale will ascend by half step and we will analyze the resulting tones when played over a fundamental static bass note (root).

At this point I will refer to all non chord tones (2nds, 4ths and 6ths) as their compound interval equivalent (9ths, 11ths and 13ths). These are also known as the extensions of the chord or scale. So:

2nds = 9ths
4ths = 11ths
6ths = 13ths

Let’s start with C major pentatonic (1, 9, 3, 5, 13) over a root C or mathematically I/I (Maj. Pent./Fundamental static root)



Note that in the “fraction” I/I, the fact that both roman numbers are the same simply means that the roots are the same. The roman number on the left will be the major pentatonic scale and it shares the same root as the roman number on the right which is the fundamental bass note.

Now, we want to analyze this relationship and see the resulting tones to determine over what chord(s) it will fit.



So, when a C note is sounding in the bass and you play a C maj. pent. scale, the resulting tones are those listed above the scale. We need to see which notes are chord tones (part of the structure of the chord), that way we’ll know what type of chord it fits. Chord tones in this case are 1 = Root; 3 = Major 3rd; 5 = Perfect 5th. A clear major triad is formed inside the structure of a (or any) major pentatonic scale. So this scale must sound good over a C major chord. The 9th and 13th are the extensions or color tones.

In lesson 3 we’ll start to compare this scale with other roots and you’ll see all the neat sounds it produces! ‘Til then, bye…

Un verdadero clásico en la literatura de espionaje y de aventura moderna, ¡Rescaten el Titanic! fue la tercera novela del escritor Clive Cussler sobre Dirk Pitt, agente de NUMA (National Underwater & Marine Agency), pero la primera que tuvo un gran éxito a nivel mundial, y que terminó por consolidar a la serie como una de las mejores del género, que ya va por el libro nº 27, The Corsican Shadow, publicado en 2023 por Dirk Cussler, hijo de Clive y continuador de sus novelas.
El presidente de EEUU autoriza y sostiene el “Proyecto Siciliano”, un esquema ultrasecreto funcionando a espaldas del Congreso y de la opinión pública, que busca dotar a su país de la invulnerabilidad frente a un posible ataque misilístico de la URSS. Para lograr su objetivo, necesita imperiosamente de bizanio, un mineral rarísimo que sólo pudo hallarse en el Ártico ruso. Se descubre que un cargamento de bizanio pudo haber sido transportado en el Titanic, famoso barco hundido en 1912. Contrareloj, se monta una operación dirigida por Dirk Pitt para llevarlo a la superficie y arrástralo hasta el puerto de Nueva York. Sin embargo, la KGB logró infiltrar a dos espías en el contingente de rescate, que recurren incluso al asesinato para malograr la misión. Lo hace apelando tanto al cultivo de las viejas tradiciones de camaradería y de esfuerzo que crearon a la gran república del Norte, así como a la tecnología militar y marina, que tiene que priorizarse, incluso sobre las preocupaciones sociales. PRISONER-SCARLET ANNIVERSARY

It was on this day in 1967 that two groundbreaking programs made their debut: Patrick McGoohan's The Prisoner and Gerry Anderson's Captain Scarlet and the Mysterons. If mystery/adventure of the mid-1960s captured the youthful and optimistic energy of the jet-setters, these two programs marked a growing sense of consequences and uncertainty for agents during the later part of the decade.

McGoohan's Danger Man had been on the air since September, 1960. His stories often exposed the darker side of espionage: moral sacrifices deemed necessary to protect the common good. His John Drake, though slightly insubordinate, presented the image of a man who could recognize -but look beyond- the distasteful consequences of the job in order to carry out his duties. His critique rose to a boiling point in a number of episodes (Yesterday's Enemies, To Our Best Friend) and the theme ultimately was channeled into his next project, The Prisoner (1967-1968). McGoohan's character in The Prisoner, now an unnamed spy, has resigned as a matter of principle and finds himself kidnapped to a remote village, where he undergoes constant psychological torture to determine why he resigned and whether he will spill his secrets. Capturing a counter-culture-era mistrust of authority, he never discovers if his torturers are the enemy after his secrets or his own people testing his loyalty (or indeed, his own mind). Known as Number 6 in the Village, McGoohan's character epitomized the theme of individual freedom, liberty, and rebellion against a surveillance state and conformity. There was a 2010 mini-series based on The Prisoner, starring Ian McKellen. Although it didn't measure up to the original, the show did a good job bringing the "Village" concept up to date in the form of complacent, consumeristic communities we see developing around trends in globalization. Even in my area, I note the trend to build large apartment complexes above retail streets, for example.

Gerry Anderson's Supermarionation programs, high-octane Sci-Spy adventures, had appealed to kids throughout the early 1960s. After establishing himself with inventive programs like SupercarFireball XL5, and Stingray, Anderson and his team found international success with Thunderbirds (1965-1966). The show featured their familiar cocktail of futuristic gadgets and intrigue, while the blockbuster stories focused on a secret organization of international rescuers keeping the world safe. But as Anderson and his wife, Sylvia, moved into the later part of the decade, they shifted toward the darker sides of human nature and the theme of consequences, echoing conversations around the Vietnam War and Cold War. 

The next project would be Captain Scarlet and the Mysterons (1967-1968), which began with a story about a team of space explorers discovering a mysterious city of energy. In a rash act of misunderstanding, the explorers mistake an innocent Mysteron gadget as a weapon and obliterate the city from the planet. As it turns out, however, the aliens can re-create any matter that has been destroyed. Neat trick, and essential to the show's premise. The city magically returns and the Mysterons vow to take revenge on humanity for its cruel, aggressive nature. The program was a much more violent affair. The hero of the piece, Captain Scarlet, began the series as an alien-constructed double agent assigned to assassinate the world's president. There was even a devastating suicide-bomber scene in the pilot and the series is packed with violent killings and ominous plots to destroy the earthmen. Once Scarlet was killed, however, he was able to regenerate and escape alien control. This established the arc of each episode, where the hero ultimately experiences a brutal death followed by a resurrection. His colleague, Captain Black, remained a rogue killer-agent for the enemy. Children's programming? Dark times indeed! Style fans take note: the costumes in the series were inspired by Pierre Cardins' space fashions! 

If these two programs illustrated transitions in the popular imagination, the trend seemed to take an odd turn by the following year. In a visit to the 1968 Exhibit in Oakland some years back, I was struck by the odd juxtaposition of truly violent historical experiences in the news, public anxiety and protest, and the strange effort of American mainstream TV, in contrast to these UK shows discussed above, to create a lulling oasis with shows like Green Acres, Beverly Hillbillies, and I Dream of Jeanie. Independent filmmakers had more liberty to present subversive material, creating films such as Easy Rider, The Monkees Head, and Night of the Living Dead. In the UK, The Prisoner and Captain Scarlet illustrated a culture trying to cope with the circumstances of the times within a mainstream medium. Whether it was questioning freedom and individuality, or consequences and culpability, these programs stand the test of time because they weren't afraid to ask questions and to frame them in ways that evoked excitement, sparkled with cutting-edge playful fashion and design, and explored real empathy. 아이폰 11 프로 디스플레이 미리보기 (Feat. ColorScale)

애플은 왜 발표를 새벽에만 하는지. 매번 다음번엔 아침에 일어나서 요약된 버전을 봐야지 다짐하면서도 결국 생방송으로 보게 만드는 애플의 스페셜 이벤트가 끝이 났다. 당장 침대에 몸을 던지고 싶은 마음이 굴뚝같지만 꼭 짚어보고 싶은 내용들이 있어 이걸 글로 쓰지 않고는 편히 자긴 어려울 것 같아 이렇게 키보드를 두드린다. 네이밍, 디자인과 같은 내용들은 사전에 많이 유출되었던 내용이기도 하고 쿠도군님과 같이 필자보다 훨씬 더 내용을 잘 다뤄줄 분들도 계시니 필자는 좀 더 세부적인 부분을 짚어보려고 한다. 

아, 소개가 늦었는데 ColorScale은 디스플레이 전문 리뷰 그룹이다. 디스플레이는 우리가 스마트폰을 사용할 때 가장 많이 접하는 부품이라 해도 과언이 아니다. 하지만 어떤 스마트폰이 더 좋은 디스플레이를 가지고 있는지를 판단하기에 우리에게 주어진 정보는 너무 적다. 제조사들은 기껏해야 해상도, 최대 밝기, 색영역 등의 정보만을 줄 뿐이다. 실제 디스플레이가 보여주는 화질에 대한 통찰을 얻기에는 너무 제한적인 정보인데다 제조사들의 입맛에 맞게 선택해서 보여주는 정보도 있다(대표적인 예시가 최대 밝기). ColorScale은 소비자들에게 디스플레이에 대한 객관적인 정보를 전달함으로써 종국에는 모든 소비자들이 높은 품질의 디스플레이로 세상을 보는 것을 목표로 삼고 있다. 오늘 애플은 아이패드, 애플워치 시리즈 5, 아이폰 11, 아이폰 11 Pro 시리즈 등의 기기를 공개했는데 이 중에서 아이폰 11 Pro 시리즈를 제외하면 디스플레이 측면에서 크게 흥미로운 내용은 없었던 것 같다(애플워치의 Always On Display를 가능케 했던 LTPO 디스플레이는 시리즈 4부터 이미 탑재되어 있었다). 그래서 본 글에서는 아이폰 11 Pro 시리즈의 디스플레이에 대한 내용을 다루려 한다.

애플은 아이폰 X에서 처음으로 OLED 디스플레이를 탑재했다. 그리고 아이폰 XS와 XS Max에서는 디스플레이에 큰 변화를 주지 않았다. 그리고 올해 아이폰 11 프로에서 디스플레이가 한 단계 진화했다(애플은 이 디스플레이를 ‘슈퍼 레티나 XDR 디스플레이’라고 부른다…). 디스플레이 관점에서 보면 아이폰 11 프로 시리즈는 2세대 OLED 아이폰인 셈이다.

애플은 아이폰 11 프로의 명암비가 2,000,000:1로 아이폰 X, XS의 1,000,000:1보다 향상되었다고 한다. 하지만 이 수치는 ‘최대 밝기가 그만큼 더 밝아졌다’의 다른 표현으로 봐도 무방할 듯 하다. OLED는 픽셀들이 각각 빛을 내기 때문에 블랙의 밝기를 사실상 0에 가깝게 표현할 수 있다. 따라서 OLED 제품들의 명암비를 무한대로 표기하는 경우도 많은데, 기존에 애플이 명암비를 1,000,000:1로 표시한 것은 측정장비로 측정할 수 있는 가장 낮은 밝기 수치와 최대 밝기의 비율로 표시했기 때문일 가능성이 높다. 당연히 블랙의 밝기가 0보다 더 어두워질 수 없기 때문에 표기된 명암비가 2배 올랐다는 것은 최대밝기가 그에 가깝게 올라갔기 때문일 것이다(다만 OLED의 굉장한 명암비는 주변광이 없는 상태에서 극대화되며 어느 정도 이상의 주변광이 있는 환경에서는 그 효과가 떨어진다는 점은 알아둘 필요가 있다).

그렇다면 이번 아이폰 11 프로에 탑재된 디스플레이의 진짜 주인공은 최대 밝기인 셈이다. 아이폰 11 프로의 디스플레이 최대 밝기는 800니트(칸델라 매 제곱미터; 얼마나 밝게 보이는지를 뜻하는 휘도의 단위)로 아이폰 XS, XS 맥스의 625니트보다 더 밝아졌다. 일부 제조사들은 최대 밝기를 높은 주변광 하에서 극히 일부 픽셀만이 빛나고 있을 때를 기준으로 표기하는데 다행히 애플은 이런 장난을 치지는 않는다. 필자가 가지고 있는 아이폰 XS Max는 모든 픽셀이 빛나고 있는 상황에서도 643니트의 최대 밝기를 보여주고 있다. 애플이 주장한 625니트보다 오히려 더 밝은 값이다(기기 편차를 고려해 상당히 보수적으로 스펙을 기재한 걸로 보인다). 전체 픽셀의 1%만이 빛나고 있는 상황에서는 767니트의 최대 밝기를 보여주어 애플이 기재해놓은 625니트보다 훨씬 높은 최대 밝기를 달성했다. 아이폰 11 Pro 디스플레이의 최대 밝기 역시 같은 기준으로 측정되었다고 보면 아이폰 11 Pro는 가장 밝은 스마트폰 중 하나임에 분명하다(추가: 아이폰 11 Pro 디스플레이를 측정해 본 결과 전체 화면 기준 최대 밝기는 821니트, 전체 픽셀의 1%만이 빛나고 있는 상황에서는 해당 부분의 휘도가 910니트까지 올라감을 확인했다).

높은 최대 밝기는 밝은 곳에서 화면을 볼 때 화면의 내용을 더 잘 보이게 해 준다. 밝은 곳에서는 그 빛이 스마트폰의 전면에 반사되어 눈에 들어오게 되는데 이 경우 디스플레이가 충분히 밝지 않으면 반사광에 화면의 어두운 부분이 ‘묻혀버리는’ 현상이 발생한다. 디스플레이가 밝을수록, 반사율이 낮을수록 이렇게 ‘묻히는’ 부분이 줄어들기 때문에 화면의 내용이 더 잘 보이게 된다. 거기에 밝은 영역까지 색을 정확하게 표시해준다면 밝은 빛에 색이 ‘씻겨나가는’ 현상(단 RGBW와 같은 방식으로 밝기를 늘리거나 밝은 영역에서 색이 심하게 틀어진다면 이런 효과는 기대하기 어렵다) 역시 완화되기 때문에 대체로 화면은 밝으면 좋다(높은 밝기를 얼마나 오래 유지할 수 있느냐 역시 함께 평가되어야 할 것이다).

하지만 주변 조명이 그리 밝지 않은 상황에서도 높은 화면 밝기가 빛을 발하는 환경이 있다. 바로 HDR 콘텐츠를 볼 때이다. HDR 콘텐츠는 SDR 콘텐츠와 달리 화면에 표시될 밝기를 절대값으로 기록하고 있다(PQ 기반 EOTF를 채택하고 있는 HDR 기준). SDR 콘텐츠에서 가장 밝은 부분을 1,200니트로 표시하고 싶다면 그 사이 계조의 모든 값들의 밝기가 그에 맞춰서 증가할 것이고 영상의 전체적인 밝기가 올라가 어둡게 보여야 할 부분이 충분히 어둡게 보이지 않을 것이다. 반대로 어두운 부분을 충분히 어둡게 표시하려면 그만큼 가장 밝은 부분의 밝기가 줄어들게 된다. 하지만 HDR 콘텐츠가 제대로 재생된다면 가장 밝은 부분을 10,000니트로 표시하면서도 어두운 부분을 여전히 어둡게 표시할 수 있다. 반대로 말하면 기기가 표현할 수 있는 최대 밝기가 밝지 않다면 HDR 콘텐츠가 주는 혜택을 제대로 누리기 어렵다는 의미이다.

아이폰 11 Pro는 HDR 콘텐츠를 재생할 때 최대 밝기를 1,200니트까지 끌어올릴 수 있다. 다만 제대로 마스터링 된 HDR 콘텐츠는 100니트보다 높은 밝기를 명부의 하이라이트 계조 표시에만 사용할 것이므로 애플이 여기서 말하는 1,200니트의 최대 밝기는 아까와는 달리 화면의 일부만이 빛날 때 달성할 수 있는 수치일 가능성이 높다(추가: 실제 아이폰 11 프로를 측정해 본 결과 전체화면 HDR 최대 밝기 기준으로 1115니트, 1% 픽셀만 빛나고 있을 때 기준으로는 1309니트까지 밝기가 올라감을 확인했다). 그렇다고 하더라도 HDR 콘텐츠에서 최대 767니트(기기별 편차가 있을 수 있음)까지 표현할 수 있던 아이폰 XS 시리즈보다 50% 이상 더 밝은 1,200니트의 최대 밝기를 표현할 수 있다는 것은 더 나은 HDR 시청 경험에 분명히 기여할 것이다. 다만 자극이 강해질수록 변화에 무뎌지는(베버-페히너의 법칙) 인간 감각의 특성상 HDR 콘텐츠에서 50% 이상 더 밝은 명부를 볼 수 있다고 생각하면 안 된다. 1,200니트는 우리 눈에 767니트보다 7% 정도 밝게 보일 뿐이다(우리의 시각은 10,000니트를 1,000니트보다 두 배 정도 밝다고 느낀다).

여기서 한 가지 흥미로운 곳은 애플이 ‘HDR 사진과 HDR10 동영상 감상에 탁월한 밝기’라고 표시해놓은 부분이다. 여기서 말하는 HDR 사진은 흔히 우리가 알고 있는 스마트폰 카메라의 HDR 기능으로 생성된 사진(HDR 이미징)과는 다르다. 기존에 우리가 흔히 들어왔던 스마트폰 카메라의 HDR 기능으로 생성된 사진은 SDR의 다이내믹 레인지 안에 서로 다른 노출로 촬영된 내용들을 구겨넣은 것이라면 진짜 HDR 사진은 다이내믹 레인지 자체를 넓힌 것이다. 당연히 진짜 HDR 사진이 우리가 눈으로 보는 장면에 가깝게 피사체들을 재현해 낼 것이다. 하지만 HDR 동영상은 유튜브, 넷플릭스 등의 매체를 통해 어느 정도 보급되고 있지만 HDR 사진의 경우 표준은 정해져 있으나 거의 보급이 안 되고 있는 실정이다. 

애플은 iOS 11이후로 아이폰에서 촬영된 이미지를 HEIF 포맷으로 저장하고 있으며 HEIF 포맷은 최대 12비트, PQ EOTF로 HDR 사진을 저장할 수 있다. 이는 돌비 비전이 요구하는 다이내믹 레인지 기준을 충족하는 것이다. 즉 아이폰에서 촬영한 사진을 HDR로 저장할 준비가 되어 있는 것이다. 만약 실제로 아이폰이 촬영한 사진을 HDR 사진으로 저장하고 이를 보여준다면 이는 이번 아이폰의 또다른 도약이자 아이폰에서 찍은 사진이 아이폰에서 굉장히 멋지게 보일 또 한 가지 이유가 될 수 있을 것이다. 다만 이 부분은 아직 확실하지 않은 부분이라는 점은 참고 바란다.

또 애플에 따르면 아이폰 11 프로의 디스플레이는 아이폰 XS에 비해 최대 15% 더 전력 효율적으로 동작한다고 한다. 이는 아이폰 XS 시리즈에 비해 각각 4시간, 5시간 더 지속되는 배터리 시간을 만들어낸 여러 퍼즐 조각 중 하나이다(나머지 퍼즐 조각들은 더 전력 효율적이 된 어플리케이션 프로세서, 향상된 전력 관리, 꽤 무게가 나가는 3d 터치 모듈을 제거하고 사이즈와 무게를 더 늘려가며 투입한 추가 배터리이다).

물론 애플이 밝힌 수치들은 나름대로 인상적이지만 글의 서두에서 밝힌 것처럼 우리에게 제공하지 않은 정보들이 더 많다. 거기에 고주사율 디스플레이 등의 새로운 기능이 투입되지 않은 것도 아쉬운 점으로 꼽을 수 있다. 애플의 1세대 OLED 아이폰이었던 아이폰 X, XS 시리즈의 디스플레이는 굉장히 인상적이었지만 완벽하지는 않았다. 아이폰 11 프로가 출시되면 이런 점들에 초점을 맞춰서, 그리고 타사의 플래그십 제품들과도 객관적으로 비교할 수 있는 디스플레이 리뷰를 보여드릴 것을 약속드린다.
