Trump hush money judge delays ruling on immunity following election win

The judge overseeing Donald Trump’s criminal hush money case has put off ruling on whether the president-elect’s conviction should be thrown out on immunity grounds, enabling prosecutors to weigh next steps following his November 5 election victory.

Justice Juan Merchan had been due to rule on Tuesday on Trump’s argument that the US Supreme Court’s decision in July that presidents are immune from prosecution involving their official acts meant the New York state case should be dismissed.

Instead, Merchan granted a request by Manhattan District Attorney Alvin Bragg’s office to have until Nov 19 to consider how to approach the case in light of Trump’s looming inauguration in January 2025, email correspondence made public on Tuesday showed.

Trump’s scheduled Nov 26 sentencing is now widely expected to be postponed.

Trump in May became the first US president — former or sitting — convicted of a crime when a jury in Manhattan found him guilty on 34 felony counts of falsifying business records to cover up a potential sex scandal shortly before his first election win in 2016. Trump, who pleaded not guilty, has vowed to appeal the verdict after sentencing.

Prosecutor Matthew Colangelo wrote there were “competing interests” between ensuring a criminal case proceeds as usual and protecting the office of the president.

“The People agree that these are unprecedented circumstances,” Colangelo wrote.

Trump is set to be the first felon inaugurated as president after his victory over Vice President Kamala Harris.

At issue in the six-week Manhattan trial was a $130,000 payment made by Trump’s then-lawyer Michael Cohen to adult film actress Stormy Daniels to keep quiet about a sexual encounter she said she had with him in 2006 but which he has denied.

Trump’s defense lawyer Emil Bove wrote that the case ultimately needed to be dismissed to avoid interfering with Trump’s presidential duties.

“The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote.

Trump faced four criminal cases

Trump, 78, is hoping to enter office unencumbered by any of four criminal cases he has faced and which once were thought to have threatened to derail his 2024 candidacy to return to the White House after having served from 2017 to 2021.

The Republican Trump has portrayed the hush money case brought by Bragg, a Democrat, and the three other state and federal criminal indictments brought in 2023 as politically motivated attempts to harm his presidential campaign. He pleaded not guilty in all four cases.

“It is now abundantly clear that Americans want an immediate end to the weaponization of our justice system,” Trump campaign spokesperson Steven Cheung said in a statement on Tuesday.

Special Counsel Jack Smith brought two of the cases against Trump, one involving classified documents he kept after leaving office and the other involving his efforts to overturn his 2020 election loss. A Florida-based federal judge in July dismissed the documents case. The Justice Department is now evaluating how to wind down Smith’s election-related case.

Trump also faces state criminal charges in Georgia over his bid to reverse his 2020 loss in that state, but the case remains in limbo.

The Supreme Court, in a decision arising from one of Smith’s two cases against Trump, decided that presidents are immune from prosecution involving their official acts and that juries cannot be presented evidence of official acts in trials over personal conduct. It marked the first time that the court recognized any degree of presidential immunity from prosecution.

In making the case for immunity, Trump’s lawyers said the jury that convicted Trump in the hush money case was shown evidence by prosecutors of his social media posts as president and heard testimony from his former aides about conversations that occurred in the White House during his 2017-2021 term.

Bragg’s office countered that the Supreme Court’s ruling has no bearing on the case, which they said concerned “wholly unofficial conduct.” The Supreme Court in its ruling found no immunity for a president’s unofficial acts.

'I just want closure': Qoo10 vendors, customers accept they will likely not get money back

SINGAPORE - When an online retailer began selling his products on e-commerce platform Qoo10 in August 2023, he did not bat an eyelid when it took 30 to 45 days for the platform to disburse his first payout, compared with about three to seven days for other e-commerce sites he was using. But nearly a year later in July, payments owed to his business by Qoo10 had ballooned to about $1.6 million, as the platform’s payment delays exceeded two months and disbursements began trickling in, in smaller amounts. The Singaporean, who wanted to be known only as Mr T and did not wish to divulge what he sold, pulled the plug on his Qoo10 shop this year in the middle of July, and filed a civil claim with the courts. He obtained a default judgment in October for Qoo10 to pay him what he is owed, after the e-commerce site failed to serve a notice of intention to contest or not contest the claim. Mr T, who added that he had borrowed nearly $1 million from banks, friends and relatives to pay his suppliers, said: “I am not holding out hope that I will get much, or any, of my money back from Qoo10... By this point, I just want closure because it’s been so stressful.”

Let’s talk about money!

Let’s talk about how hard it is to pay small amounts online to people whose work you like and who could really use a bit of income. Let’s talk about how Coil aims to change that.

Taking a subscription to a website is moderately easy, but the person you want to pay must have enabled them. Besides, do you want to purchase a full subscription in order to read one or two articles per month?

Sending a one-time donation is pretty easy as well, but, again, the site owner must have enabled them. And even then it just gives them ad-hoc amounts that they cannot depend on.

Then there’s Patreon and Kickstarter and similar systems, but Patreon is essentially a subscription service while Kickstarter is essentially a one-time donation service, except that both keep part of the money you donate.

And then there’s ads ... Do we want small content creators to remain dependent on ads and thus support the entire ad ecosystem? I, personally, would like to get rid of them.

The problem today is that all non-ad-based systems require you to make conscious decisions to support someone — and even if you’re serious about supporting them you may forget to send in a monthly donation or to renew your subscription. It sort-of works, but the user experience can be improved rather dramatically.

That’s where Coil and the Web Monetization Standard come in.

Web Monetization

The idea behind Coil is that you pay for what you consume easily and automatically. It’s not a subscription - you only pay for what you consume. It’s not a one-time donation, either - you always pay when you consume.

Payments occur automatically when you visit a website that is also subscribed to Coil, and the amount you pay to a single site owner depends on the time you spend on the site. Coil does not retain any of your money, either — everything goes to the people you support.

In this series of four articles we’ll take a closer look at the architecture of the current Coil implementation, how to work with it right now, the proposed standard, and what’s going to happen in the future.

Overview

So how does Coil work right now?

Both the payer and the payee need a Coil account to send and receive money. The payee has to add a <meta> tag with a Coil payment pointer to all pages they want to monetize. The payer has to install the Coil extension in their browsers. You can see this extension as a polyfill. In the future web monetization will, I hope, be supported natively in all browsers.

Once that’s done the process works pretty much automatically. The extension searches for the <meta> tag on any site the user visits. If it finds one it starts a payment stream from payer to payee that continues for as long as the payer stays on the site.

The payee can use the JavaScript API to interact with the monetization stream. For instance, they can show extra content to paying users, or keep track of how much a user paid so far. Unfortunately these functionalities require JavaScript, and the hiding of content is fairly easy to work around. Thus it is not yet suited for serious business purposes, especially in web development circles.

This is one example of how the current system is still a bit rough around the edges. You’ll find more examples in the subsequent articles. Until the time browsers support the standard natively and you can determine your visitors’ monetization status server-side these rough bits will continue to exist. For the moment we will have to work with the system we have.
