Judgment of the trial court finding that the hearing officer, who upheld the demotion for use of excessive force, had not exercised independent judgment is reversed, where: 1) under the Memorandum of Understanding, the hearing officer was required to exercise independent judgment not only with respect to whether there were grounds for discipline, but also with respect to the nature of the discipline; and 2) the hearing officer's failure to use independent judgment would not have changed the outcome and was therefore not prejudicial.

(California Court of Appeal) - Affirming the dismissal of a verified petition for writ of mandate complaining about a city's transfer of additional revenue from electric utility reserve fund accounts into the general fund without approval from the electorate because the action was subject to the 120 day statute of limitations of the Public Utilities Code and was not a tax increase.

School Start Times Affect Teen Drivers

A recent study published by the Journal of Clinical Sleep Medicine found a connection between school start times and teen driving accidents. The study found that pushing a 7:20 a.m. start to an 8:10 a.m. start significantly reduced the crash rate of 16– to 18–year–old drivers in the area. According to the researchers, teens who don’t get enough sleep are more likely to make poor decisions—such as distracted driving or forgetting to wear a seat belt.

The American Academy of Sleep Medicine (AASM) has been advocating for middle and high school start times of 8:30 a.m. or later to help promote teen safety, health, and academic performance. The AASM recommends teens get 8 to 10 hours of sleep a day. By getting enough sleep, teens are more alert in the classroom, are less tardy or absent, have better mental health, and have improved safety habits while driving.

Yesterday The Observer went by bus to Marsaxlokk from Valletta, leaving the capital at about 10.40 am. The bus, which was an articulated bus, i e extra-long, had a sign saying it was a special tour and The Observer agrees, the tour was indeed a special one. The bus was completely full with passengers, both sitting and standing. The bus went sometimes in a speed that must have been more than 80 kilometers per hour. Several passengers were terrified, staring at each other in horror. It felt like the back of the bus would skid across the roadway in the curves. It was indeed a special and terrifying tour! Unfortunately, this type of experience is not unusual when going with Arriva buses although there are, of course, also careful drivers.
