Kane v. Barger

(United States Third Circuit) - Held that a police officer did not have qualified immunity to a suit alleging that he inappropriately touched a woman who reported a sexual assault and that he used his personal cellphone to photograph her intimate areas. The officer argued that he was immune from suit because the right at issue was not clearly established at the time of his alleged conduct. Rejecting his argument, the Third Circuit reversed the entry of summary judgment for the officer and remanded for further proceedings in this suit alleging infringement of the Fourteenth Amendment right to bodily integrity.

Lee v. Sixth Mount Zion Baptist Church

(United States Third Circuit) - Held that a pastor could not sue his church for breach of an employment contract. The church contended that adjudication of the pastor's contract claim would impermissibly entangle the court in religious doctrine in violation of the First Amendment's Establishment Clause. Agreeing, the Third Circuit affirmed summary judgment in favor of the church.

Fishback Nursery, Inc. v. PNC Bank

(United States Fifth Circuit) - In a lien contest among creditors of a bankrupt commercial farm, held that a bank's lien outranked the agricultural liens of nurseries that sold the farm trees and shrubs. Affirmed a summary judgment ruling.

(United States Fourth Circuit) - Affirming the district court's denial of qualified immunity regarding alleged due process violations in the case of the firing of emergency personnel officers involved in a group text-message chain that questioned the competence to perform various emergency services, workout tips, sexual gibes, and other inappropriate content, but concluding that the district court erred in holding that officials were not entitled to qualified immunity as to First Amendment retaliation claims and reversing and remanding on those grounds.

Netro v. Greater Baltimore Medical Center, Inc.

(United States Fourth Circuit) - Affirming the district court's determination that a hospital did not fail to pay funds owed Medicate for the treatment of the plaintiff's mother, despite being a bit late in their payment, meaning that the plaintiff was not entitled to double damages under the Medicare Secondary Payer Act.

US Tobacco Cooperative Inc. v. Big South Wholesale of Virginia, LLC

(United States Fourth Circuit) - Held that the United States should be substituted as a party defendant in a lawsuit in which two defendants were tobacco industry businesspeople who had agreed to perform undercover work for the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives. The question before the Fourth Circuit was whether the United States should be substituted as a party defendant. The panel held that the answer was yes, and thus reversed the district court's ruling on the matter.

(United States Second Circuit) - Affirmed. Financial institutions that hold junior notes issued by the defendant, as trustee, appeal the grant of summary judgement. The district court erred in holding that ICA § 47(b) does not give rise to a private right of action. However, the district court ordered distribution of the assets of the trust according to the terms of the trust’s governing indenture, so summary judgment affirmed.

The case involved antitrust claims, patent infringement claims and an alleged breach of a confidentiality agreement.

Foley v. Wells Fargo Bank, N.A.

(United States First Circuit) - Affirmed summary judgment against a homeowner's claim that Wells Fargo Bank breached the terms of a federal Truth-in-Lending Act class action settlement. The homeowner claimed that the bank was contractually obligated under the settlement to modify his mortgage contract to help him stave off default. However, the First Circuit held that the homeowner did not qualify for the relief provided in the settlement, agreeing with the district court.
