(California Court of Appeal) - Affirmed. Defendant, a skilled nursing facility, appealed an order denying its petition to compel arbitration for claims of negligent, elder abuse and wrongful death. The trial court found that the claims were not arbitratable because there was no arbitration agreement between Defendant and the decedent.

Why A Little Denomination Hopping Is Not A Bad Thing

Although sometimes frowned upon, experience with other Christian traditions may be just what we need right now.

Sometimes, I’m a little embarrassed to be identified as an American Christian because it feels like we fall into one of two camps: either we hate everything that we are not familiar with, or hate everything that we used to like.

A good example of the former is a controversy that recently sprang up at Gordon College, where undergraduates were scandalized at the introduction of a strange and foreign type of worship experience during their chapel services: gospel music. Yes, GOSPEL MUSIC, one of the oldest and richest liturgical traditions in American faith.

Examples of the latter are too numerous to count. The Christian blogosphere and publishing industry are filled with memoirs of people ranting about how terrible their church experience was growing up, and how their current place and style of worship is what Jesus had in mind all along. When cast in this adversarial light, what should have been personal stories of finding one’s home in faith instead read like a harrowing escape from a doomsday cult, and serve as yet another salvo in our nation’s already raging cultural wars.

These two tendencies have unfortunately come to define Christians in this country, that we either despise everything with which we are unfamiliar, or the exact opposite. But personally, I have never had much of a problem with either, and it’s not because I’m all that great of a person – just ask my wife. It’s probably because I have spent so much time in diverse kinds of churches.

I grew up in the Roman Catholic church, and can still remember the cathedral in which Sunday mass took place. The entire building was constructed in a cruciform shape, the main entrance located at the foot of the cross, and ...

(United States Ninth Circuit) - Dismissed. The government appealed the district court’s granting in part of a motion to enforce a 1997 settlement agreement guaranteeing minors in the custody of immigration agencies be held in facilities that are safe and sanitary. The panel dismissed the appeal for lack of jurisdiction because the district court did not modify the agreement.

(United States Ninth Circuit) - Affirmed in part, reversed in part. Minor league baseball players seeking class status in an action under the Fair Labor Standards Act appeal the denial of class certification in Arizona and Florida. The panel held certification is appropriate and consistent with “the great public policy” embodied by the FLSA.

Finding that non-citizens subject to expedited removal under 8 USC Section 1228 have a statutory right to counsel in reasonable fear proceedings, the immigration judge deprived Zuniga of his right to counsel by failing to obtain a knowing and voluntary waiver of that right.

Letters: Striking a balance (4/29/20)

Striking a balance Easing the restrictions on COVID-19 risky activities is like setting a speed limit on our roads. The higher the speed limit, the greater the freedom to drive as one pleases, and the greater the number of statistically probable deaths. There are those who would advocate for unfettered freedom notwithstanding higher death rates, and vice versa. The political and economic challenge is in finding a socially acceptable balance. Although one might differ from our elected leaders on where to set the limits, or how fast to proceed in adjusting those limits, there is going to be a trial-and-error period during which data and societal feedback will trend toward an acceptable trade-off between freedom and harm. Let’s cut our local leaders some slack as they attempt to strike a balance.
