Federal Appellate Court Upholds Enforcement of IRS Summons Seeking Information Concerning Law Firm Clients Involved in Foreign Transactions

On April 24, 2020, a federal appellate court upheld an order enforcing an Internal Revenue Service (IRS) summons directed to the Taylor Lohmeyer Law Firm PLLC, the Department of Justice announced. The summons directed the law firm to provide information about clients who used the law firm’s services to create and maintain foreign bank accounts and entities. On appeal, the United States Court of Appeals for the Fifth Circuit upheld the trial court’s enforcement of the summons and rejected the law firm’s “blanket” claim that all responsive materials were protected by the attorney-client privilege. It explained that revealing the fact that the clients participated in specific types of transactions would not necessarily reveal any confidential communication of legal advice protected by the attorney-client privilege.

Making fire and fire surrogate science available: a summary of regional workshops with clients

Operational-scale experiments that evaluate the consequences of fire and mechanical "surrogates" for natural disturbance events are essential to better understand strategies for reducing the incidence and severity of wildfire. The national Fire and Fire Surrogate (FFS) study was initiated in 1999 to establish an integrated network of long-term studies designed to evaluate the consequences of using fire and fire surrogate treatments for fuel reduction and forest restoration. Beginning in September2005, four regional workshops were conducted with selected clients to identify effective and efficient means of communicating FFS study findings to users. We used participatory evaluation to design the workshops, collect responses to focused questions and impressions, and summarize the results. We asked four overarching questions: (1) Who needs fuel reduction information? (2) What information do they need? (3) Why do they need it? (4) How can it best be delivered to them? Participants identified key users of FFS science and technology, specific pieces of information that users most desired, and how this information might be applied to resolve fuel reduction and restoration issues. They offered recommendations for improving overall science delivery and specific ideas for improving delivery of FFS study results and information. User groups identified by workshop participants and recommendations for science delivery are then combined in a matrix to form the foundation of a strategic plan for conducting science delivery of FFS study results and information. These potential users, their information needs, and preferred science delivery processes likely have wide applicability to other fire science research.

How to Foster Real-Time Client Engagement During Moderated Research

When we conduct moderated research, like user interviews or usability tests, for our clients, we encourage them to observe as many sessions as possible. We find when clients see us interview their users, and get real-time responses, they’re able to learn about the needs of their users in real-time and be more active participants in the process. One way we help clients feel engaged with the process during remote sessions is to establish a real-time communication backchannel that empowers clients to flag responses they’d like to dig into further and to share their ideas for follow-up questions.

There are several benefits to establishing a communication backchannel for moderated sessions:

  • Everyone on the team, including both internal and client team members, can be actively involved throughout the data collection process rather than waiting to passively consume findings.
  • Team members can identify follow-up questions in real-time which allows the moderator to incorporate those questions during the current session, rather than just considering them for future sessions.
  • Subject matter experts can identify more detailed and specific follow-up questions that the moderator may not think to ask.
  • Even though the whole team is engaged, a single moderator still maintains control over the conversation which creates a consistent experience for the participant.

If you’re interested in creating your own backchannel, here are some tips to make the process work smoothly:

  • Use the chat tool that is already being used on the project. In most cases, we use a joint Slack workspace for the session backchannel but we’ve also used Microsoft Teams.
  • Create a dedicated channel like #moderated-sessions. Conversation in this channel should be limited to backchannel discussions during sessions. This keeps the communication consolidated and makes it easier for the moderator to stay focused during the session.
  • Keep communication limited. Channel participants should ask basic questions that are easy to consume quickly. Supplemental commentary and analysis should not take place in the dedicated channel.
  • Use emoji responses. The moderator can add a quick thumbs up to indicate that they’ve seen a question.

Introducing backchannels for communication during remote moderated sessions has been a beneficial change to our research process. It not only provides an easy way for clients to stay engaged during the data collection process but also increases the moderator’s ability to focus on the most important topics and to ask the most useful follow-up questions.

Driver interface functions to interface client function drivers

In embodiments of driver interface functions to interface client function drivers, a set of serial communication protocol driver interfaces are exposed by a core driver stack, and the serial communication protocol driver interfaces include driver interface functions to interface with client function drivers that correspond to client devices configured for data communication in accordance with the serial communication protocol. A client function driver can check for the availability of a driver interface function before interfacing with the core driver stack via the serial communication protocol driver interfaces. A contract version identifier can also be received from the client function driver via an extension of the driver interface functions, where the contract version identifier indicates a set of operation rules by which the client function driver interfaces with the core driver stack.

Client-allocatable bandwidth pools

Methods and apparatus for client-allocatable bandwidth pools are disclosed. A system includes a plurality of resources of a provider network and a resource manager. In response to a determination to accept a bandwidth pool creation request from a client for a resource group, where the resource group comprises a plurality of resources allocated to the client, the resource manager stores an indication of a total network traffic rate limit of the resource group. In response to a bandwidth allocation request from the client to allocate a specified portion of the total network traffic rate limit to a particular resource of the resource group, the resource manager initiates one or more configuration changes to allow network transmissions within one or more network links of the provider network accessible from the particular resource at a rate up to the specified portion.
