Califonia Communities Against Toxics v. Environmental Protection Agency

(United States DC Circuit) - Petition for review denied. The EPA did not act contrary to the Resource Conservation and Recovery Act in adopting a Transfer-Based Exclusion because hazardous materials are not necessarily "discarded" when they are transferred from a generator to a reclaimer along with payment. The policy was not arbitrary or capricious.

Monsanto Company v. Office of Environmental Health Hazard Assessment

(California Court of Appeal) - Affirming the trial court's conclusion that Monsanto and others failed to state a claim in a suit where they averred that Proposition 65's reliance on the International Agency for Research on Cancer's determinations about which chemicals cause cancer improperly granted a foreign entity authority over domestic affairs.

Delaware Riverkeeper Network v. Pennsylvania Department of Environmental Protection

(United States Third Circuit) - Denied a petition for review of a Pennsylvania state regulators' decision to grant a Clean Water Act certification to a natural gas pipeline project. An environmental organization raised various procedural and substantive arguments against the environmental regulators' issuance of a water quality certification. On judicial review, the Third Circuit held that the environmentalists' challenge failed on the merits. Prior to reaching the merits, the panel discussed in detail questions regarding its jurisdiction under the Natural Gas Act.

iron

Ohio Valley Environmental v. Scott Pruitt

(United States Fourth Circuit) - Reversed. Several environmental groups brought suit against the EPA for failing to perform duties under the Clean Water Act as to impaired waters in West Virginia. The district court found that plaintiffs have standing to bring the claim and granted summary judgment in their favor. The appellate court agreed that plaintiffs have standing, but reversed the grant of summary judgment. The appellate court reasoned that the doctrine of constructive submission under 33 USC section 1313(d)(2) which would have triggered the EPA’s duty to act was overcome by West Virginia’s partial compliance and agreement to do more. Therefore constructive submission would not apply and summary judgment improper.

Connecticut Ironworkers Employers Association, Inc. v. New England Regional Council of Carpenters

(United States Second Circuit) - Vacating the district court's determination that a carpenters union was entitled to summary judgment as to Sherman Act Antitrust charges, but affirmed summary judgment for them as to unfair labor practices charges in a case where the union used subcontracting to include ironworking in their activities because the union did not qualify for the non-statutory exemption to antitrust liability, but qualified for the construction industry proviso.

Airport Environmental Research Roadmap Narrative Report

Airports must maintain a safe and efficient facility while considering environmental impacts. Though traditional environmental challenges such as noise and water quality remain, several new themes are emerging, including energy management, sustainability, resiliency, and wildlife management. Airports will need guidelines and practices to help them address these pressing issues, and the first step in the process is to identify knowledge gaps and research needs. The neonatal microenvironment programs innate γδ T cells through the transcription factor STAT5

IL-17–producing RORγt+ γδ T cells (γδT17 cells) are innate lymphocytes that participate in type 3 immune responses during infection and inflammation. Herein, we show that γδT17 cells rapidly proliferate within neonatal lymph nodes and gut, where, upon entry, they upregulate T-bet and coexpress IL-17, IL-22, and IFN-γ in a STAT3- and retinoic acid–dependent manner. Neonatal expansion was halted in mice conditionally deficient in STAT5, and its loss resulted in γδT17 cell depletion from all adult organs. Hyperactive STAT5 mutant mice showed that the STAT5A homolog had a dominant role over STAT5B in promoting γδT17 cell expansion and downregulating gut-associated T-bet. In contrast, STAT5B preferentially expanded IFN-γ–producing γδ populations, implying a previously unknown differential role of STAT5 gene products in lymphocyte lineage regulation. Importantly, mice lacking γδT17 cells as a result of STAT5 deficiency displayed a profound resistance to experimental autoimmune encephalomyelitis. Our data identify that the neonatal microenvironment in combination with STAT5 is critical for post-thymic γδT17 development and tissue-specific imprinting, which is essential for infection and autoimmunity.

IRON MAIDEN

Jun. 11 - Poland, Warsaw PGE Narodowy

Jun. 13 - Germany, Bremen Bürgerweide

The Iron Dragon's Daughter E-Book Only $1.99--MONDAY ONLY!

.

More than a quarter-century ago, I was driving to Pittsburgh, with my wife, Marianne Porter, and we were talking about fantasy and about steam locomotives. I made a joke about the Baldwin Steam Dragon Works and Marianne laughed. Then, another mile or so down the road, I said, "Write that down, please."

Thus was born the Iron Dragons Trilogy, a trio of stand-alone books, the third of which, The Iron Dragon's Mother, was published just last year.

Far more recently, just an hour or so ago, I got an email from my associates at Open Road Media, telling me that The Iron Dragon's Mother, first of the three, will be on sale for $1.99 this coming Monday, March 23.

That's one day only BUT this time the sale includes Canada. Which I am very grateful for because the Canadian science fiction community has always been very warm and kind to  me.

Anyway, here's the boilerplate below, cut-and-pasted from the corporate email:

Habitat: Environmentalists eye city’s investment policies

Divestment is “more urgent” in Toronto than NYC

A growing list of large institutional investors around the world – state and provincial pension funds, university endowments, and most recently, New York City itself, have been aggressively divesting from fossil fuel investments so as to do their part in mitigating against climate change. Here in Toronto, it’s been a different story. Prominent institutional investors, […]

Food systems are fodder for curbing cities’ environmental impacts

Focusing on urbanization as a key driver of environmental change in the 21st century, researchers at Princeton have created a framework to understand and compare cities’ food systems and their effects on climate change, water use and land use. The research will allow planners to estimate the impact of a city’s food system and evaluate policy actions.

Expansion, environmental impacts of irrigation by 2050 greatly underestimated

The amount of farmland around the world that will need to be irrigated in order to feed an estimated global population of 9 billion people by 2050 could be up to several billion acres, far higher than scientists currently project, according to new research. The result would be a far greater strain on aquifers, as well as the likely expansion of agriculture into natural ecosystems as farmers search for water.
