WASHINGTON -- The Justice Department's decision to drop the criminal case against Michael Flynn, President Donald Trump's former national security adviser, even though he had twice pleaded guilty to lying to investigators, was extraordinary and had no obvious precedent, a range of criminal law specialists said Thursday."I've been practicing for more time than I care to admit and I've never seen anything like this," said Julie O'Sullivan, a former federal prosecutor who now teaches criminal law at Georgetown University.The move is the latest in a series that the department, under Attorney General William Barr, has taken to undermine and dismantle the work of the investigators and prosecutors who scrutinized Russia's 2016 election interference operation and its links to people associated with the Trump campaign.The case against Flynn for lying to the FBI about his conversations with the Russian ambassador was brought by the office of the former special counsel, Robert Mueller. It had become a political cause for Trump and his supporters, and the president had signaled that he was considering a pardon once Flynn was sentenced. But Barr instead abruptly short-circuited the case.On Thursday, Timothy Shea, the interim U.S. attorney in the District of Columbia, told the judge overseeing the case, Emmet G. Sullivan, that prosecutors were withdrawing the case. They were doing so, he said, because the department could not prove to a jury that Flynn's admitted lies to the FBI about his conversations with the ambassador were "material" ones.The move essentially erases Flynn's guilty pleas. Because he was never sentenced and the government is unwilling to pursue the matter further, the prosecution is virtually certain to end, although the judge must still decide whether to grant the department's request to dismiss it "with prejudice," meaning it could not be refiled in the future.A range of former prosecutors struggled to point to any previous instance in which the Justice Department had abandoned its own case after obtaining a guilty plea. They portrayed the justification Shea pointed to -- that it would be difficult to prove to a jury beyond a reasonable doubt that the lies were material -- as dubious."A pardon would have been a lot more honest," said Samuel Buell, a former federal prosecutor who now teaches criminal law at Duke University.The law regarding what counts as "material" is extremely forgiving to the government, Buell added. The idea is that law enforcement is permitted to pursue possible theories of criminality and to interview people without having firmly established that there was a crime first.James G. McGovern, a defense lawyer at Hogan Lovells and a former federal prosecutor, said juries rarely bought a defendant's argument that a lie did not involve a material fact."If you are arguing 'materiality,' you usually lose, because there is a tacit admission that what you said was untrue, so you lose the jury," he said.No career prosecutors signed the motion. Shea is a former close aide to Barr. In January, Barr installed him as the top prosecutor in the district that encompasses the nation's capital after maneuvering out the Senate-confirmed former top prosecutor in that office, Jessie K. Liu.Soon after, in an extraordinary move, four prosecutors in the office abruptly quit the case against Trump's longtime friend Roger Stone. They did so after senior Justice Department officials intervened to recommend a more lenient prison term than standard sentencing guidelines called for in the crimes Stone was convicted of committing -- including witness intimidation and perjury -- to conceal Trump campaign interactions with WikiLeaks.It soon emerged that Barr had also appointed an outside prosecutor, Jeff Jensen, the U.S. attorney in St. Louis, to review the Flynn case files. The department then began turning over FBI documents showing internal deliberations about questioning Flynn, like what warnings to give -- even though such files are usually not provided to the defense.Flynn's defense team has mined such files for ammunition to portray the FBI as running amok in its decision to question Flynn in the first place. The questioning focused on his conversations during the transition after the 2016 election with the Russian ambassador about the Obama administration's imposition of sanctions on Russia for its interference in the American election.The FBI had already concluded that there was no evidence that Flynn, a former Trump campaign adviser, had personally conspired with Russia about the election, and it had decided to close out the counterintelligence investigation into him. Then questions arose about whether and why Flynn had lied to administration colleagues like Vice President Mike Pence about his conversations with the ambassador.Because the counterintelligence investigation was still open, the bureau used it as a basis to question Flynn about the conversations and decided not to warn him at its onset that it would be a crime to lie. Notes from Bill Priestap, then the head of the FBI's counterintelligence division, show that he wrote at one point about the planned interview: "What's our goal? Truth/admission or to get him to lie, so we can prosecute him or get him fired?"Barr has also appointed another outside prosecutor, John H. Durham, the U.S. attorney in Connecticut, to reinvestigate the Russia investigators even though the department's independent inspector general was already scrutinizing them.And his department has intervened in a range of other ways, from seeking more comfortable prison accommodations last year for Paul Manafort, Trump's former campaign chairman, to abruptly dropping charges in March against two Russian shell companies that were about to go to trial for financing schemes to interfere in the 2016 election using social media.Barr has let it be known that he does not think the FBI ever had an adequate legal basis to open its Russia investigation in the first place, contrary to the judgment of the Justice Department's inspector general.In an interview on CBS News on Thursday, Barr defended the dropping of the charges against Flynn on the grounds that the FBI "did not have a basis for a counterintelligence investigation against Flynn at that stage."Anne Milgram, a former federal prosecutor and former New Jersey attorney general who teaches criminal law at New York University, defended the FBI's decision to question Flynn in January 2017. She said that much was still a mystery about the Russian election interference operation at the time and that Flynn's lying to the vice president about his postelection interactions with a high-ranking Russian raised new questions.But, she argued, the more important frame for assessing the dropping of the case was to recognize how it fit into the larger pattern of the Barr-era department "undercutting the law enforcement officials and prosecutors who investigated the 2016 election and its aftermath," which she likened to "eating the Justice Department from the inside out."This article originally appeared in The New York Times.(C) 2020 The New York Times Company

Question papers of two subjects of the SSC (Class X) exam conducted by the Maharashtra State Board were found leaked at Bhiwandi in Thane district of Maharashtra on Wednesday, police said. A case was registered at Narpoli police station against an unidentified person in this connection. "As per the complaint filed by a state board official, examination of history and political science subjects was scheduled to take place on Wednesday," senior inspector M B Shinde of Narpoli police station said on Thursday.

"For the exam that was to start at 11 am, students were expected to be in the exam hall by 10.15 am. However, outside an exam centre at Kalher in Bhiwandi, the board official found some girl students checking their mobile phones inside an autorickshaw," he added. When the official checked their phones, he found the question papers of history and political science subjects. "The girls had received these question papers through a messaging application. When the actual question papers were tallied with those on the mobiles, they were found to be the same," Shinde added.

A case was registered under IPC section 406 (criminal breach of trust) and section 72 of the Information Technology Act, police said, adding that nobody has been arrested in this connection so far. According to police, question papers of algebra, geometry and science subjects were also allegedly leaked in Bhiwandi earlier. The state board's secondary school certificate (SSC) exam began on March 1.

The only reason a semi-circle of well-connected writers, and well-paid editors seemed to loathe Chetan Bhagat so vehemently is because he is so widely read, perhaps even loved, and they aren't, I (rightly) thought — standing in the periphery of that semi-circle at a literary fest after-party, over half a decade ago. With that bitchy conversation over-valuing Bhagat's national impact going nowhere, I stepped out to grab a drink.

Bhagat was at the corner of the bar at Indigo, where a big-shot industrialist, now I forget if it was Anand Mahindra or Ness Wadia (and that's not even the point), somberly walked up to him to check on what's going on in Indian politics. His vishesh tippani followed. Now, where to go?

The most erudite can be swayed by numbers alone, in this case the number of Bhagat's English young-lit readers. Do these numbers always signify democracy? It could produce the opposite effect. Let's look at politics in a bit, but we do know a little about mass news, entertainment, although it's hard to tell one from the other.

They're crafted around second-guessing audience's supposed tastes, often where one thing works, automatically everybody else follows, and therefore an entire industry, over time, step by step, splicing out everything that doesn't fit into the larger, determined hole, produces a mainstream media that looks the same —across. Pick up the most popular radio, television stations, websites, newspapers, or even movies (creating stars, or special effects), and you'll know. One size must fit all. Your circus, my monkeys. It's a numbers' game. And numbers can be gamed.

Is politics that aims for more complicated arithmetic, and much larger audiences, another field that defies free-market, with greater competition only inhibiting choice, and progressively screwing up quality? Survey the national scene. Examine its broad product categories that, weeding out the highest common multiple over time, every political party has conveniently fit into, in order to appeal to the lowest common denominator: Nehru/Gandhi, Sangh, Ambedkar, Lohia, Left (and those opposing them, of course). Grand promises of abolishing poverty (1971), 'acche din' (2014) etc, although well-meaning, are merely side-shows, and tag-lines.

Every politician, ideally, must check one or the other box, holding uniformly same and sometimes inter-changeable opinions on a variety of complex issues. That's what you need/scream to lord over vast public resources/institutions. Target in place. Hit-job ordered. Distraction complete. Groups vote en masse. Design is set.

Educational qualifications, past experience, passing tough exams/interviews that test competence, are for minions entrusted with growing/protecting a small company's pocket change. If you're part of none of the above cult groups, the newbie Aam Aadmi Party, for instance, you do appear like an "anarchist". It's easy to be portrayed as one. This is basically show-business, albeit of relatively not such good-looking people.

How did we get here? Because Ambedkar, the father of Indian Constitution, said we would. If, for one, he ironically stated, we fell prey to 'personality cults', or quoting John Stuart Mill, "lay liberties at the feet of even a great man, trusting him with powers, which enable him to subvert institutions." Two, if political democracy did not follow actual social democracy on the ground (unqualified liberty, equality, fraternity, for all). It didn't. So where do the regular folk stand? Between a rock, and a hard place. But you must pick a side. It makes life simpler.

And you must vote. Have to vote. It's your right. Your privilege. You must vote. This is democracy. They go to vote — for one, or perhaps, against the other. As they did in Karnataka. In a tri-partite fight, the party with the lowest number of seats, steps in to form a government, with the help of the party they fought against. The one with the highest number of seats looks at how they could "poach" from the other two, whose MLAs were locked up! It didn't matter what they fought for, or against.
The popular television anchor with the second highest English news ratings asks the gentleman from the scavenging team how they would manage the numbers. Arrey! He names his captain; and winks, pretty much. They both laugh out loud, in public, on TV, simultaneously. This is supposed to be "horse-trading" to form a "stable" government.

The highest read Indian English writer, Bhagat, weighs in with a pragmatic tweet, that must be seen as our form of public intellectualism — calling horse-trading an "art form". Yes, the election is over. Another will follow. The voter looks puzzled. Or maybe doesn't. Now let's just frickin' move on, right. No, you wanna question this? Oh.

Accepting the futility of genres, of boxing songs into different compartments like stacked products in supermarket shelves, seems to be at the forefront of Rafiq Bhatia's musical endeavour. The 30-year-old American of Indian descent is the guitarist for a New York-based indie outfit called Son Lux. But it's his recent solo album, Breaking English, which makes the listener really question the need for musical boundaries, of sticking labels to a composition as if it's packaged meat.

The title track of the album, for instance, is not jazz, is not electronica, is not lounge, but all of these generic classifications rolled into one lush sound with a coherent narrative, where Bhatia's melancholic guitar plays the role of the protagonist. Each sonic detail in the track is well-defined, to the point where even though fellow Son Lux member Ian Chang's drum beats seem dissonant, they fit like a glove into the overall musical fabric. Bhatia describes this sensibility when he tells us over the phone from Berlin, where he's on tour, "Ryan (Lott, the vocalist for Son Lux) would say that instead of building a house, designing a room and then placing a chair in it, why don't we start with the chair first, and then design the room around it before building the house. There is a theory in poetry called organicism, where the poet lets each individual verse define the form that the poem will take. That is kind of similar to what I'm trying to do with my music."

He further explains his musical process when he narrates a story about one of his influences, Sam Rivers, the late American jazz great. "I've read that he would attend the concerts of all his peers, and purposely study their music to understand what they were trying to do. But this wasn't to replicate what they were playing. Instead, it was to consciously avoid it. Similarly, John Coltrane took the music of his predecessors and retooled the entire musical vocabulary keeping a similar underlying foundation, but with new pathways built on top of it," he says, giving us an indication of how he doesn't hesitate to flush rule books down the toilet.

Hybridity, in fact, lies at the core of Bhatia's creative evolution. The basis for this, he says, might well be his mixed identity. Born in North Carolina, he has never really fit in to any particular community. For, even though his parents are of Gujarati origin, they grew up in Tanzania, before moving to London and then finally to the US. So, while his brown skin stood out among the white kids in his school, he didn't feel completely at home among the Indian community either. "Everybody thinks that I am something else. So, my music is a result of a need to express my identity. It's a form of therapy at some level, because it's also a way of accepting who I am," he says.

He adds that this therapy started early. When he was about eight or nine, the older desi kids in Bhatia's neighbourhood would pick him up in a car and stop at a parking lot, listening to the hip-hop albums that became one of his earliest influences. Was he drawn to them because of the political overtones that such songs often embody? "Not really," he answers, adding, "I was only in the third grade at the time, and I couldn't even understand the words. So it was the musicality that I fell for. But the deeper question is, why were a bunch of brown kids sitting in a car in a parking lot and empathising with hip-hop music? What is it that was drawing them to the words? So you see, it's difficult to disentangle the politics from the music."

It follows thus that an intertwining of politics and music sometimes features in his own compositions. For example, Hoods Up, a complex instrumental piece, drew its inspiration from Trayvon Martin, a black teenager who was cruelly shot down because of a case of mistaken identity. The guitarist says, "I feel some amount of compulsion to express my [political] ideas. But sometimes, it's easy to get carried away with being overtly political because there is so much to be angry about, and often the responsibility falls on artistes to emphasise it. So I would say that politics is a general part of what inspires my music, because there are so many other facets of my personality that also make their way in."

Essentially, then, what Bhatia wants to keep doing is create genre-defying tracks where attention to detail is of paramount importance. "When you take the details and all the generalities of music for granted, that's when your songs start sounding more like other people's music. That doesn't mean you can't make great tracks. It's just that the less you consider those things, the less is the chance that you will make music that departs from convention. The flip side is that when you think actively about each decision, and each one comes from a place of individuality, it becomes hard to find a coherent logic that ties all those things together. And that ends up being the riddle that I am constantly trying to solve with my music."

Speaking about her personal life, Sonakshi recently made headlines for dating Notebook actor Zaheer Iqbal. In a candid chat, Zaheer said, "Sonakshi and I laughed after reading the dating rumours. It was my first rumour so I didn't know how to react to it. People have seen all of us. Sonakshi and I chill together and someone must have seen that and might have started the rumour. Well, I'm sure that's how it started."

Soon after the Delhi police started questioning a prominent South Delhi school student in connection with the Boys Locker Room controversy investigation, 22 others linked to the mess went underground on Tuesday.

The Cyber Cell of the Delhi police earlier detained one teenager in connection with the Instagram chat group where rapes were glorified and photos of underage girls were shared and they were objectified.

The one who has been nabbed so far is a 15-year-old student of a prominent school in South Delhi. "Twenty-two other boys have also been identified and they would be called for investigation," the police said on Tuesday. The detained accused would be produced before the Juvenile Justice Board (JJB).

Based on the information provided by the minor during questioning, police teams have been sent to various parts of the National Capital Region. After the police registered the case, many students in the group have gone underground.

Leaked screenshots of the private Instagram chat group stirred up a storm over rape culture in India after numerous boys were allegedly seen sharing photos of underage girls, objectifying them, and planning "gang rapes".

A case was registered under Section 465 (forgery), 471 (using forged document), 469 (forgery for purpose of harming reputation), 509 (intending to insult the modesty of any woman) of the IPC and 67 and 67A of the Information Technology (IT) Act at cyber cell of the Delhi police.

Earlier on Monday, the police received a complaint from the principal of a prominent school in South Delhi's Saket at the Saket police station requesting for a probe into the matter, the same was forwarded to the Cyber Cell thereof. Apart from this, another complaint was filed at a police station in North Delhi by a parent in connection with this Instagram group.

Former Sri Lanka captain Kumar Sangakkara on Sunday said someone must answer to the questions which are still unanswered in regards to the Sri Lanka Easter bombing last year.

"A year on we all share the pain of the families grieving lives lost, we stand with you and for you. We remember. So many questions still unanswered, but answer them someone must," Sangakkara tweeted as people across the world celebrated Easter on Sunday.

Sri Lanka celebrated a quiet Easter Sunday amid the coronavirus lockdown, while remembering the victims of the terror attacks that killed at least 270 people on the resurrection day last year. People largely stayed indoors and offered prayers from home with the Archbishop of Colombo, Cardinal Malcolm Ranjith, leading an Easter mass from a TV studio because of the pandemic.

The attacks wounded over 500 and deepened communal tensions in Sri Lanka. The bombings, carried out by local Islamist extremists with suspected foreign ties, was claimed by the Islamic State. Police said that they have killed or arrested all suspects in various counter-terror operations carried out in the days after the mayhem.
