Phil Knight, former chair and CEO of Nike, tells the story of starting the sports apparel and equipment giant after taking an entrepreneurship class at Stanford and teaming up with his former track coach, Bill Bowerman. Together (and with the help of a waffle iron) they changed how running shoes are designed and made. Knight discusses the company's enduring culture of innovation, as well as the succession process that led to former runner and Nike insider Mark Parker becoming CEO.

Dorie Clark, a marketing strategy consultant, answers a burning question: how do people make money off of what they know? She outlines the options for experts who want to monetize their knowledge. Clark explains, using herself and other successful solopreneurs as examples, how to earn revenue from public speaking, podcasting, e-books, and online courses. She also goes over what to charge and when to get an assistant. Clark teaches at Duke University’s Fuqua School of Business and is the author of the new book “Entrepreneurial You.”

Freek Vermeulen, an associate professor of strategy and entrepreneurship at the London Business School, argues that too many companies are following so-called best practices that are actually holding them back. They do it because of deep-seated industry tradition—and because it’s hard to know how seemingly successful business models will hold up over the long term. That’s why, he says, organizations should avoid benchmarking and instead routinely test their business practices before there’s a problem. Vermeulen is the author of “Breaking Bad Habits: Defy Industry Norms and Reinvigorate Your Business.”

Kenneth Frazier, the CEO of the pharmaceutical company known as MSD outside of North America, discusses his upbringing and how it influences his leadership as chief executive. He is one of the few African-American CEOs in the Fortune 500, and shot to prominence after resigning from a council advising the Trump White House. Frazier discusses the importance of values in leadership and how Merck thinks about R&D and drug prices.

James Detert, a professor at the University of Virginia Darden School of Business, studies acts of courage in the workplace. His most surprising finding? Most people describe everyday actions — not big whistleblower scandals — when they cite courageous (or gutless) acts they’ve seen coworkers and leaders take. Detert shares the proven behaviors of employees who succeed at speaking out and suffer fewer negative consequences for it. He’s the author of the HBR article “Cultivating Everyday Courage.”

Kimberly Whitler, assistant professor at the University of Virginia Darden School of Business, believes the days of transplanting well-worn Western marketing practices into national markets may be numbered. She has researched marketing campaigns in China and finds they are faster, cheaper, and often more effective than traditional Western ones. Moreover, she argues they may be better suited to today’s global marketplace. Whitler is the author of the HBR article “What Western Marketers Can Learn from China.”

Peter Cappelli, professor at the University of Pennsylvania's Wharton School of Business and director of its Center for Human Resources, says managers at companies large and small are doing hiring all wrong. A confluence of changes, from the onslaught of online tools to a rise in recruitment outsourcing, have promised more efficiency but actually made us less effective at finding the best candidates. Cappelli says there are better, simpler ways to measure whether someone will be a good employee and advises companies to focus more on internal talent. He's the author of the HBR article "Your Approach to Hiring is All Wrong."

Ethan Bernstein, associate professor at Harvard Business School, studied how coworkers interacted before and after their company moved to an open office plan. The research shows why open workspaces often fail to foster the collaboration they’re designed for. Workers get good at shutting others out and their interactions can even decline. Bernstein explains how companies can conduct experiments to learn how to achieve the productive interactions they want. With Ben Waber of Humanyze, Bernstein wrote the HBR article "The Truth About Open Offices."

Dashun Wang, associate professor at Kellogg School of Management, crunched big datasets of entrepreneurs, scientists, and even terrorist organizations to better understand the fine line between failure and success. One surprising finding is that people who experience early failures often become more accomplished than counterparts who achieve early successes. Another insight is that the pace of failure is an indicator of the tipping point between stagnation and eventual success. Wang is a coauthor of the study in the journal Nature: “Quantifying the dynamics of failure across science, startups and security.”

Nancy McKinstry, CEO of Wolters Kluwer, has successfully shifted her company’s business to digital products over 15 years. The Dutch multinational started in the 1830s as a publishing house and now earns more than 90% of its revenue from digital. McKinstry explains how her firm kept investing in product innovation – and how she learned to be patient as consumers slowly adopted new products and services. She also credits the role of increased diversity in her organization. McKinstry is the top woman in HBR’s 2019 list of the world’s best-performing chief executives.

Michelle King, director of inclusion at Netflix, says it’s time to stop telling women to adapt to the male-dominated workplace and time for the workplace itself to change. Her prior academic research shows that diversity training and anti-harassment efforts address important issues but fall short of creating gender equality in organizations. She identifies the real obstacles and shares how leaders can create a culture of equality at work, for women and men alike. King is the author of the book "The Fix: Overcome the Invisible Barriers That Are Holding Women Back at Work.”

• Ultrawealthy and sometimes asymptomatic Americans are using concierge doctors to access COVID-19 tests amid a nationwide shortage.
• The doctors, whose monthly fees can range up to $10,000 a month and don't accept insurance, can offer coronavirus antibody test results in as little as two hours; results for the general public can take days.
• Even some concierge doctors question the ethics of offering tests to their wealthy clientele that aren't available to the general public.
• Both concierge doctors and their clients told Business Insider that America's health care system is dysfunctional, and that patients are healthier operating outside it.

Jamie Gerdsen, the 46-year-old CEO of Cincinnati-based construction company Apollo Home, wanted his 200 employees to know how seriously he was taking the coronavirus pandemic. To prove it, he decided to get tested in April. 

For Gerdsen, the process was simple. All he had to do was call his doctor, set up an appointment time for him and his wife, and get to his doctor's drive-through testing center. At the center, they showed their IDs, answered a few questions, and got their fingers pricked, all without getting out of their car. The results came into Gerdsen's email inbox two hours later.

1. Hearing Held to Reauthorize the National Apprenticeship Act

On Wednesday, March 4, 2020, the Higher Education and Workforce investment Subcommittee held a hearing to discuss reauthorizing the National Apprenticeship Act. The National Apprenticeship Act, originally passed in 1937, will be amended to expand the apprenticeship system to include broader forms of apprenticeship programs. This discussion is centered around how to modernize the Act and bring apprenticeships into the 21^st century.  

NECA’s Look Ahead: Preserving these valued apprenticeship programs is a priority. NECA continues to work closely with legislators while this bill is being shaped.

2. NLRB Chairman and General Counsel to Testify Regarding Funding     

Next week, the Chairman and General Counsel of the National Labor Relations Board are scheduled to testify before the House Appropriations committee. This hearing is anticipated to be contentious with lawmakers inquiring as to the reasons behind the Trump Administration’s request to lower the board’s funding by 10%. At the same time, the NLRB’s regional offices are plagued with under-employment and the board itself is dogged with hearings and legal challenges over ethical conflicts of interest.

NECA’s Look Ahead: While historically the National Labor Relations Board has been a contentious and often politicized place, this hearing is expected to highlight the new level of dysfunction that now riddles the Board. NECA believes that lawmakers should continue to fully fund the NLRB and encourage their leadership to expedite the hiring of their regional offices.

3. Congress Passes Coronavirus Funding Bill

On Wednesday, March 4, 2020, Congress passed a NECA-supported bill, H.R. 6074, the Coronavirus Preparedness and Response Supplemental Appropriations Act.

NECA’s Look Ahead: This bill addresses the critical funding issues surrounding the U.S. response to the Coronavirus outbreak. The bill includes the following:

• $4 billion to make diagnostic tests more broadly available

• $2.2 billion for the Centers for Disease Control and Prevention (CDC) for a robust response, including:

• $1 billion exclusively for state and local response efforts
• $300 million for CDC’s Infectious Diseases Rapid Response Reserve Fund
• $20 million to administer disaster assistance loans for small businesses impacted by the virus.
• $1.25 billion for the State Department and (USAID)
• $264 million to evacuate Americans and maintain consular operations overseas

1. NECA Helps Secure Construction Industry Exemption in Final IRAP Rule

On March 10, 2020, the Department of Labor released the final rule of the Industry-Recognized Apprenticeship Programs (IRAP) regulation. The final rule contains a permanent construction industry exemption, thereby protecting our industry from participation in IRAPs. NECA released a statement thanking the Administration for recognizing that the construction industry has longstanding expertise in the creation and execution of apprenticeships.

NECA’s Look Ahead: NECA strongly advocated for the construction industry’s exemption, with thousands of NECA contractors sending comments to the Department of Labor. By securing this exemption, the long-established, gold standard apprenticeship model that NECA Contractors utilize will remain intact and not be subjected to these parallel programs which will operate with less scrutiny and limited educational requirements.

2. The House Introduces Legislation to Address COVID-19 Outbreak

Washington D.C., like the rest of the nation and world, is responding to the outbreak of the COVID-19 (Coronavirus). On the evening of March 11, President Trump addressed the nation live from the  Oval Office. On Capitol Hill, negotiators continue to work to find a compromise between competing coronavirus response bills.

NECA’s Look Ahead: In response to the crisis, the Senate plans to cancel a previously scheduled recess week. The House will gavel out today and will return to Washington D.C. on March 23, 2020 to finish the negotiations on a final response package. NECA CEO, David Long, released the following statement in response to the legislative and regulatory negotiations: “ NECA government affairs remains fully engaged with Members of Congress, the Department of Labor, and OSHA on how to best handle the COVID-19 outbreak with safety being a top concern for our contractors and their employees. We continue to monitor legislation coming out of Congress to address the economic impact of this outbreak and will inform our contractors on how to best work with the new regulations when they are finalized.”

3. NLRB Chairman Testifies Regarding Funding      

On March 11, 2020, the House Committee on Appropriations held a hearing on the National Labor Relations Board Budget Request for FY 2021. Testifying on behalf of the NLRB was the Honorable John Ring, Chairman of the National Labor Relations Board. The NLRB budget request and justification documents can be found here.

NECA’s Look Ahead: The NLRB’s FY 2021 budget request funds their mission to protect the rights of employees, unions, and employers under the National Labor Relations Act (NLRA). NECA believes that lawmakers should continue to fully fund the NLRB and encourage their leadership to expedite the hiring of their regional offices.

1. PPP Safe Harbor Deadline Extended

On May 5, 2020, the U.S. Treasury Department extended the safe harbor date for those that applied for a PPP loan prior to April 24, 2020. The original date, May 7, 2020, has been pushed back to May 14, 2020. Borrowers will not need to apply for the extension and additional guidance on how the SBA will review the certification will be provided shortly. NECA released the following alert pertaining to the extension and forthcoming guidance.

NECA’s Look Ahead: NECA is pleased by this extension after sending a letter to the Treasury department last week. We continue to advocate for NECA contractors as we move forward during this time.

2. Bill Introduced to Make 501(c)(6) organizations Eligible for PPP Loans

On May 5, 2020, Representatives Chris Papas (D-NH), Brian Fitzpatrick (R-PA), and Greg Steube (R-FL) introduced H.R.6697 – “Local Chamber, Tourism, and 501(c)(6) Protection Act of 2020”. This NECA supported legislation would expand the Paycheck Protection Program by allowing 501(c)(6) organizations, such as NECA Chapters, to access the Paycheck Protection Program to meet payroll and other necessary expenses during this crisis. 

NECA’s Look Ahead: NECA will encourage the inclusion of this bill in any future COVID-19 relief package along with additional PPP reforms such as:

• Extending the PPP to more than eight weeks or allow companies to apply again after the first eight-week period ends.

• Increasing the qualified expenses covered under the Paycheck Protection Program to include nonpayroll expenses.

3. NECA Requests Infrastructure Support in Next COVID-19 Bill

NECA joined 71 trade associations and labor unions in a coalition letter to President Trump to encourage continued support for infrastructure in the next Phase of COVID-19 legislation.

NECA’s Look Ahead: NECA continues to advocate before the Administration and Congressional leaders for the inclusions of major infrastructure investment as a corner stone for the next phase of COVID-19 legislation, often referred to as Phase IV.
