Issues at Audible's ACX: Attempted Rights Fraud, Withdrawn Promotional Codes

Two issues involving Audible's ACX have come across my desk recently.

Rights Fraud

I've heard from several self- and small press-pubbed authors who report that they've found their books listed on ACX as open to narrator auditions...except that they, or their publishers, didn't put them there. This appears to be an attempt to steal authors' audio rights.

Below is one listing. Here's another and another and another. (All of these listings have been invalidated by ACX.)


See "Comments from the Rights Holder" at the bottom. The purported company, Publishing D LLC, does not show up on any searches.

The fraud seems pretty elaborate. Here's what one of the authors who contacted me told me:


These comments from a freelance audiobook narrator illustrate that "Publishing D" is not an isolated incidence.

Promotional Code Shenanigans

Multiple authors have contacted me to report that they've received an email from ACX withdrawing their promotional codes. The cited reason: "unusual activity," with no explanation of what that means.

The authors say that they have not used the codes improperly or violated ACX guidelines; in some cases, they've used the codes only a handful of times or not at all. See, for instance, blog posts by authors G. Michael Vasey and Adam Piggott. Per discussions on the KBoards and Reddit, a lot of authors seem to be affected.

Is this one of Amazon's (Audible's parent company) periodic crackdowns on misuse or fraud that has inadvertently ensnared innocent authors? According to author and self-publishing expert David Gaughran, ACX promo code scamming is a major problem, and Amazon's anti-abuse sweeps often involve a lot of collateral damage. Or could it be an error--a glitch or rogue algorithm?

So far, authors' efforts to get a fuller explanation have run up against the black box that is Amazon:


If I hear anything further, I'll update this post.

UPDATE 11/27/19: One of the authors who alerted me to the promo code withdrawal has received a notice saying that their codes are reinstated--however, they say that the promo code tab has yet to appear in their dashboard.


UPDATE 2/25/29: More about ACX scams, from a comment left by a narrator:
About the ACX thing...I was contacted by ACX to narrate three books, however, the person who offered the contracts kept emailing and frantically telling me to send them my book codes. I got leary and called ACX. They said unfortunately there are many scams taking place where if a book is "unclaimed" in their system, someone may grab it and offer it as an audiobook contract. Then they keep the codes and blackmarket sell them. They do not pay the narrators. Many other authors are experiencing it, they said, but they have no way to regulate it.

I declined the offers and got a nasty note from the contract holder. I was also told that since I corresponded with them, they had my email that is associated with Amazon..the same one. So, ACX said I had to go change my email on Amazon or they would have access there too. Geez.

No new jobs, promotions, extra expenses for state government

In view of the financial hit the state is likely to take owing to the pandemic, the state government has taken several austerity measures.

New schemes, construction, purchases by the state have been barred while new jobs will not be created. Employees will not be transferred and promoted this financial year.

A resolution issued by the chief secretary on Monday said that the current schemes will have to run on 33 per cent grant instead of 100 per cent. Health, medical education, relief and rehabilitation, food and civil supplies departments will get priority in state funding.

'Review schemes'
The departments have been asked to review current schemes and work on them with a limited budget.

However, there will be no cut in essential spendings like salaries and pension payments.

Pending bills to be paid
Buying gizmos, furniture and hiring offices have not been allowed. The expenses on event management have been curtailed. The pending bills will be paid using whatever the finances are available.

Exams only for final year students, rest to be promoted

In major relief, the state government has decided that first and second-year students will be promoted to the next year based on performance. However, final year students will have to appear for their final exams which will be conducted between July 1 to 30.

State higher and technical education minister Uday Samant declared the decision through video on Friday providing relief to lakhs of students studying in thousands of colleges affiliated to different universities in the state.

However, the decision to conduct the final year exams will be subject to COVID-19 situation in the state and a decision about the same will be taken on June 20.

Also, a committee has been formed which will decide if the Common Entrance Test (CET) for UG and PG courses can be conducted. The committee is going to table their findings in eight days.

For UG the exam has been scheduled between July 1-19 and July 23-30 for PG courses.

As for students fearing non-compliance of 75 per cent mandatory attendance criteria, Samant said, "All students should be given full attendance for all days of lockdown until now which is 45 days. However even after adding these 45 days if any student is still lagging, the college should consider those cases compassionately. All final year final examination students shall continue studying as their exams will be held in July. It is a question of their career which is why the exams cannot be cancelled."

Explaining the grading system that will be used for first and second-year students, a senior University official said, "This grading will be done with 50:50 formula where 50 per cent marks will be based on internal evaluation or tests held until now before the lockdown and 50 per cent from the performance of the student in the previous year. If previous year's performance is not available, the grading will depend 100 per cent on performance until now in the academic year."

"Moreover students who have pending papers or fail in any subject will have to appear for ATKT exams which the varsities will hold within 120 days from the beginning of the new academic year," he added.

Mumbai cyclist to journey across India to promote the cause of veganism

An article he had read a little over two years ago changed Rohit Ingle's life forever. It espoused the cause of veganism so persuasively that Ingle says he was convinced overnight to give up eating meat. "I can't remember where I read the article," he confesses. "But it had a very simple line - if you are an animal lover, you can't eat them. If you love someone, how can you be the cause of their misery?" he adds.

That message is what he now hopes to spread across the country, riding a cycle. Ingle embarked on his epic journey - and it can only be described as that - from Bandra on Thursday, a week ahead of World Vegan Day on November 1. The plan is to cover 19,000 km over one year, stopping not just at different state capitals, but especially in the hinterland. "Hardly anyone in India knows about veganism," he says, adding, "I'll pitch my tent at places like highway dhabas. There, I can interact with the customers and tell them more about what I am doing, hopefully inspiring some of them [to take up veganism] in the process."

Does he feel any apprehension? "Yes, I am nervous, I won't lie about that. But I am motivated by my cause. There are also people who will be there to welcome me at Ahmedabad and Surat initially, and that will hopefully give me further encouragement. So, as the journey goes by, I am sure this feeling will go away."

But, Ingle adds, he's not quite sure about how he will sustain himself financially to get through an entire year. "I have raised `60,000 [of his `3.5-lakh target] through crowdfunding. I have also received money from The Pollination Project, an organisation based in the US that has sponsored me for $1,000. So, I have around `1.3 lakh and can easily start my journey for at least three to four months."

After that, he hopes to keep going till November 2018, inspiring as many people as possible along the way. "See, the message is very simple - if you want to eat meat or wear animal products, an animal that doesn't want to die is definitely going to be killed. So, you have to keep that in mind."

Wasim Akram: Sad that people still use my name to promote themselves

Wasim Akram has claimed that "some people" still use his name to "promote" themselves, a reference to ex-opener Aamir Sohail who has blamed the pace great for Pakistan not winning the World Cup since 1992. "Whenever I hear these negative things about myself I feel very sad that it has been 17 years since I retired but even today they are some people using my name to promote themselves," Akram said on a web show. Wasim said even he could say a lot of negative things about others but refrained from doing so.

"I can also make negative comments about these people but what purpose will it serve. That is why I keep quiet. I just think about the respect and love I have earned from the people over the years and even 17 years after retirement," he said. Sohail, who is also a former Pakistan captain, has claimed that Akram's job as captain in the 1996 and 19999 World Cup and as a senor player in the 2003 edition was to ensure that Pakistan never repeated their 1992 title-winning feat.

"It's very simple. Put the 1992 World Cup to one side and talk about the 1996 World Cup. In 1995, Ramiz Raja was captain. Saleem Malik was the captain before that, he was very successful and if he could have spent one more year as captain then Wasim would not have been leading the side," Sohail was quoted as saying by Dawn. "If you look at what happened till 2003, there was this persistence before every World Cup to remove the captain and put Wasim Akram in that role...Look, the biggest contribution by Wasim Akram for Pakistan cricket was making sure Pakistan does not win a World Cup after 92," he added.

Former Pakistan pacer Ata ur Rehman and former PCB chiefs, Khalid Mahmood and Lt General (retd) Tauqir Zia, have also mentioned Akram's name while discussing the match-fixing allegations of the 90s and the Justice Malik Qayyum report.
