BAKU, Azerbaijan — COP29 negotiators welcomed as an early boost to the two-week summit a pledge by major development banks to lift funding to poor and middle-income countries struggling with global warming. A group of lenders, including the World Bank, announced a joint goal on Tuesday of increasing this finance to $120 billion by 2030, a roughly 60% increase on the amount in 2023. "I think it's a very good sign," Irish Climate Minister Eamon Ryan told Reuters on Wednesday. "It's very helpful. But that on its own won't be enough," Ryan said, adding countries and companies must also contribute. The chief aim of the conference in Azerbaijan is to secure a wide-ranging international climate financing agreement that ensures up to trillions of dollars for climate projects. Developing countries are hoping for big commitments from rich, industrialized countries that are the biggest historical contributors to global warming, and some of which are also huge producers of fossil fuels. "Developed countries have not only neglected their historical duty to reduce emissions, they are doubling down on fossil-fuel-driven growth," said climate activist Harjeet Singh. Wealthy countries pledged in 2009 to contribute $100 billion a year to help developing nations transition to clean energy and adapt to the conditions of a warming world. But those payments were only fully met in 2022 and the pledge expires this year. With 2024 on track to be the hottest year on record, scientists say global warming and its impacts are unfolding faster than expected. Climate-fueled wildfires forced evacuations in California and triggered air quality warnings in New York. U.S. President Joe Biden and Chinese President Xi Jinping will meet November 16 on the sidelines of the 2024 Asia Pacific Economic Cooperation, or APEC summit in Lima, Peru, the White House announced Wednesday. The official said Biden will also reiterate his "longstanding concern" over China's "unfair trade policies and non-market economic practices" that hurt American workers. LONDON: In a dramatic turn of events at the Old Bailey, Urfan Sharif confessed to the murder of his 10-year-old daughter, Sara Sharif, admitting in court that he “takes full responsibility” for her tragic death.

Sharif detailed the brutal treatment he inflicted upon the girl, acknowledging he beat her with a cricket bat and metal pole, leading to her death on Aug 8, 2023, days before her body was discovered in their Surrey home.

The confession came during cross-examination by Caroline Carberry KC, who asked him bluntly if he had killed her by beating. “Yes, she died because of me,” Sharif responded. He revealed that he had struck Sara “severely” over several weeks, reportedly because he was angered by her frequent episodes of soiling herself and vomiting.

Sharif, 42, his wife, Beinash Batool, 30 and his brother Faisal Malik, 29, all facing charges related to what prosecutors have described as a “campaign of abuse” against Sara. The trio fled to Pakistan shortly after Sara’s death, with Sharif later calling the British police to confess he had “beat her up too much”.

A handwritten note, found near Sara’s fully clothed body, further documented Sharif’s admission, stating: “I swear to God that my intention was not to kill her. But I lost it.”

Medical examination reports presented to the court were harrowing. Sara’s postmortem revealed 71 external injuries, including fractures, burns, and bite marks.

When confronted with images of Sara’s injuries, Sharif appeared unable to look, repeatedly saying, “I accept everything,” as Carberry questioned him on the details of his alleged actions.

The prosecution presented a disturbing video clip from Aug 6, showing Sara dancing just two days before her death. Despite this glimpse of her lively spirit, Sharif admitted to brutally beating her that same evening.

The defence team for Sharif later sought a private consultation with him in court, delaying further proceedings.

The trial, however, continues, with Sharif and co-defendants maintaining not guilty pleas to the charges of murder and causing or allowing the child’s death.

Cross-examination

During the hearing, Carberry asked: “Do you accept that you had been beating Sara severely over a number of weeks?” He replied: “Yes, ma’am.”

He went on to accept attacking Sara with a cricket bat repeatedly and causing 25 fractures to her body.

Carberry continued: “I want to ask you about the occasions when you assaulted her with a cricket bat. What had she done to deserve such beatings in your mind?”

Sharif replied: “Nothing.”

She asked: “Why were you beating her so forcefully?”

He replied: “I was wrong.”

She continued: “Were you angry with her because in the summer of last year, she had started soiling herself?”

He replied: “Yes ma’am.”

She added: “And she had started vomiting, hadn’t she?” to which Sharif replied: “Yes, ma’am.”

Carberry asked: “And when she was sick you would get angry? And when she soiled herself you would get angry?” He replied: “Yes ma’am.”

He accepted causing injuries to Sara’s face and head by beating her with the bat and metal pole on 6 Aug.

Carberry continued: “You have pleaded not guilty to the offence of murder. Would you like that charge to be put to you again?”

He replied: “Yes ma’am.”

Google is conducting a “test” that will omit results from EU-based news publishers. The company says the time-limited trial will only affect a small portion of users in nine EU countries and will help “assess how results from EU news publishers impact the search experience for our users and traffic to publishers.” But given the fragile state of the news media — and the company’s history of threatening to pull its services in the face of news-related regulations — it’s tempting to view it as the equivalent of a mob boss conducting a “little test” to see how the corner laundromat fares without its protection.

Google describes the experiment (via The Verge) as a “small, time-limited test” to omit EU results from search, Google News and the personalized Discover feed. It will only affect one percent of users in Belgium, Croatia, Denmark, France, Greece, Italy, the Netherlands, Poland and Spain. Those users will still see results from other websites, including non-EU news publications.

The company says news results will reappear as usual once the test concludes. (It didn’t list a specific timeframe.) Google stresses that the experiment won’t impact the publisher payments it makes under the European Copyright Directive (EUCD), under which the company has inked deals with over 4,000 EU publishers.

Google does have a history of using the potential withdrawal of its visibility as a negotiating stick in similar situations. In some cases, the tactic has helped it draw concessions.

Last year, Google pulled its news links from Canada in response to Bill C-18 (the Online News Act), which required tech companies to negotiate compensation with online publishers for linked content. After months of negotiations, Google said Canada had addressed its concerns and given it a path to an exemption. Canada said it granted one to Google last month, with the company agreeing to pay $100 million annually to news organizations.

In April of this year, Google briefly removed links to California news outlets in response to the proposed California Journalism Preservation Act (CJPA), which would require Google to pay news publishers in exchange for continuing to link to their websites. Although the bill’s fate is still up in the air, Google struck a deal with state lawmakers this summer, committing tens of millions of dollars to a fund supporting local news.

In 2021, the company threatened to remove its entire search engine from Australia in response to a then-proposed law requiring tech companies to share royalties with news publishers. The nation’s then-Prime Minister stood firm. “Let me be clear. Australia makes our rules for things you can do in Australia,” Scott Morrison said. After the bill was passed and enacted, Google struck deals with Australian media companies to license content.

Google says it hopes the data analysis tools it provides publishers will help them use the EU test to “understand traffic patterns.”

96. It would be evident from the above discussion that the claims for refund under the said two enactments constitute an independent regimen. Every decision favourable to an assessee/manufacturer, whether on the question of classification, valuation or any other issue, does not automatically entail refund. Section 11B of the Central Excises and Salt Act and Section 27 of the Contract Act, whether before or after 1991 amendment - as interpreted by us herein - make every refund claim subject to proof of not passing-on the burden of duty to others. Even if a suit is filed, the very same condition operates. Similarly, the High Court while examining its jurisdiction under Article 226 - and this Court while acting under Article 32 - would insist upon the said condition being satisfied before ordering refund. Unless the claimant for refund establishes that he has not passed on the burden of duty to another, he would not be entitled to refund, whatever be the proceedings and whichever be the forum. Section 11B/Section 27 are constitutionally valid, as explained by us hereinbefore. They have to be applied and followed implicitly wherever they are applicable.
