The Rewards of Podcasting
Getting started with podcasting is a relatively inexpensive venture. The equipment and software required for podcasting is inexpensive for a business contemplating podcasting as a new marketing and communication adventure.

Why You Should Use Web Templates
Web templates expedite the process of setting up a new website. The idea behind a web template is that it will save time with the creative design and layout process. In the business world, time is money; hence, using templates can save money. It can be a challenge to find a web designer for hire, and quite often the designer's schedule will not always mesh with the needs of a small business. Time rarely controls a web graphic designer. Artists are, well, artistic, and don't necessarily work by the clock. Instead, they work when inspiration strikes, which can be problematic when there are deadlines to meet. Templates are ready-made, and can be easily edited, allowing you to instantly create a website.

Newsletter Blues

Happy New Year everyone! I've worked hard and really customized Wordpress to look and work exactly as I'd like. It's ready to go as soon as I get the rest of the site up.

One of the next tasks was to replace the mailing software that I was using to send out my Behold News to people who had purchased or downloaded Behold. You might have noticed that you didn't receive a mailing for my last version in November. I didn't send one out because I had problems back in August with my mailings. My software kept shutting down every few hundred people and I'd have to restart it quite a few times. I wasn't sure if everyone had received it, and I'm sure some people received it twice. I didn't want that to happen again, so I didn't send one out in November.

I was thinking of switching to phpList to be my mailing program. But in the last couple of days, I found out the real problem and phpList wouldn't be any better than Spd E-Letter would.

There are three ways of sending Mass Mailings:

  1. From a program running on your website. This is what Spd E-Letter and phpList do. What I discovered the trouble here is that webhosts limit the number of mailings you are allowed to make in an hour. This is to prevent spamming. My number of mailings is now getting large enough that it would take quite a number of hours to send them all out at the limits they allow. If I had 10 times the list size, it would take days. So this is no longer a solution for me for the future.

  2. From a program running on your computer. Unfortunately this has the same problem. The limit instead is imposed by the ISP who you get Internet service from.

  3. From a company on the web that provides e-mailing services. This appears to be my only option. My research indicates the way to go is to stick to one of the top two: AWeber or GetResponse.
So at least for now, I don't have to worry about trying to implement phpList along with everything else I'm doing to get the new site up. But what I may do when I get my next version of Behold out, is try out both AWeber and GetResponse each with half my people and see which I like better.

But next it's off to Vanilla and finishing up the rest of my "new" site.

An Open Letter to New Port Richey

Dear New Port Richey, Florida,

Hey there, it's been a while since we touched base. Soz about that. I've been away writing books and getting up to no good in the UK; you've been busy increasing your suburban sprawl to the point where there is now no clear boundary between you and the rest of the West Central Florida region (a.k.a. "the bit too far west of Disney").

Anyway, I thought we should probably catch up after you recently announced a new plan to arrest sex workers in the city limits. As I am arguably the city's best-known export, and certainly its best-known prostitute export, I'm surprised you didn't run this by me first. Because this plan of yours? I'm telling you this now, it ain't gonna work.

Just to catch up the rest of the folks reading this - the grandees of New Port Richey got tired of rigging elaborate stings to entrap sex wokers, so are giving cops free rein to arrest people who tick any three of eight "behaviours" off a list. These behaviours include asking if someone is a cop, getting into and out of cars at the same place by the road, trying to attract attention of drivers, and more.

You know who else asks if you're a cop? People who are trying to get help in an emergency. You know who else gets into and out of cars by the road every day? Students and workers waiting for their carpool. You know who tries to attract the attention of people driving by on US 19? Anti-abortion protestors. Last time I checked, New Port Richey had all of these in abundance.

That's the problem with these kinds of laws, you see. Profiling has a false positive rate greater than zero, and some of those false positives will no doubt lawyer up. Also, picking up people because you think they might possibly commit a crime in the future is not the same as detecting people who are actually breaking the law. It is - hm, how you say? - oh yeah, now I remember the word. "Unconstitutional." (My time in Florida's schools did not go to waste, as you can see.)

And while we're on the topic of what's legal and what's not, please explain to me what the point of criminalising sex workers is again? Because harassing people over a victimless crime seems like a pretty poor use of resources.

Back when I lived in Florida I knew a few women who were out there selling sex on the streets. Not one of them ever said, "you know what would change my life in a positive way? A mandatory minimum jail sentence and a thousand dollar fine." For the most part they were just trying to get by day to day, put food on the table, hoping maybe for something better someday. Jail is not that something better.

Remember how that Prohibition thing worked out with booze? The War on Drugs with drugs? Yeah, this is bound to backfire, too. The people you're trying to target - some of whom really are vulnerable - will be getting criminal records instead of a helping hand.

Meanwhile, the indoor sex workers like me who can easily dodge these ham-fisted vice moves will continue making money, because the truth is you can't stop the world's oldest profession.

Florida's an odd place, I'll grant you that, and it can be tough to set yourself apart when virtually every other town and city in the state has attracted international attention for doing strange stuff. Why, just down the road we have Clearwater, a place that's both the spiritual HQ of Scientology and the world HQ of Hooters restaurants. It's hard to compete with that kind of weird.

But this approach is not the way forward. Becoming well-known for something you didn't exactly plan on is kind of a bummer. I feel your pain. You know what? Sometimes you have to roll with the hand you're dealt. Like, maybe offering the sex workers passing through the Pasco County law enforcement system options other than going to jail? Or - if you're feeling like pushing the boat out a bit - letting adults mind their own business.

New Port Richey, you and me parted ways a while ago. But that doesn't mean there isn't still a part of you with me, and a part of me with you. I'd really appreciate it if you could do me a solid and reconsider this ill-thought idea. Otherwise I'm going to have to keep telling people I'm from this town, and from what I gather, that would probably rub you up the wrong way.

Sunshine and kisses,

Brooke

Analog Equivalent Rights (2/21): The analog, anonymous letter and The Pirate Bay

Privacy: Our parents were taking liberties for granted in their analog world, liberties that are not passed down to our children in the transition to digital — such as the simple right to send an anonymous letter.

Sometimes when speaking, I ask the audience how many would be okay with sites like The Pirate Bay, even if it means that artists are losing money from their operation. (Do note that this assertion is disputed: I’m asking the question on the basis of what-if the assertion is true.) Some people raise their hands, the proportion varying with audience and venue.

The copyright industry asserts that the offline laws don’t apply on the Internet when they want to sue and prosecute people sharing knowledge and culture. They’re right, but not in the way they think. They’re right that copyright law does apply online as well. But privacy laws don’t, and they should.

In the offline world, an analog letter was given a certain level of protection. This was not intended to cover just the physical letter as such, but correspondence in general; it was just that the letter was the only form of such correspondence when these liberties were drafted.

First, the letter was anonymous. It was your prerogative entirely whether you identified yourself as sender of the letter on the outside of the envelope, on the inside of the letter (so not even the postal service knew who sent it, only the recipient), or not at all.

Further, the letter was untracked in transit. The only governments tracking people’s correspondence were those we looked down on with enormous contempt.

Third, the letter was secret. The envelope would never we broken in transit.

Fourth, the carrier was never responsible for the contents, of nothing else for the simple reason they were not allowed to examine the content in the first place. But even if they could, like with a envelopeless postcard, they were never liable for executing their courier duties — this principle, the courier immunity or messenger immunity, is a principle that dates as far back as the Roman Empire.

These principles, the liberties of correspondence, should apply to offline correspondence (the letter) just as it should to online correspondence. But it doesn’t. You don’t have the right to send anything you like to anybody you like online, because it might be a copyright infringement — even though our parents had exactly this right in their offline world.

So the copyright industry is right – sending a copied drawing in a letter is a copyright infringement, and sending a copied piece of music over the net is the same kind of copyright infringement. But offline, there are checks and balances to these laws – even though it’s a copyright infringement, nobody is allowed to open the letter in transit just to see if it violates the law, because the secrecy of private correspondence is considered more important than discovering copyright infringements. This is key. This set of checks and balances has not been carried over into the digital environment.

The only time a letter is opened and prevented is when somebody is under individual and prior suspicion of a serious crime. The words “individual” and “prior” are important here — opening letters just to see if they contain a non-serious crime in progress, like copyright infringement, is simply not permitted in the slightest.

There is no reason for the offline liberties of our parents to not be carried over into the same online liberties for our children, regardless of whether that means somebody doesn’t know how to run a business anymore.

After highlighting these points, I repeat the question whether the audience would be okay with sites like The Pirate Bay, even if it means an artist is losing income. And after making these points, basically everybody raises their hand to say they would be fine with it; they would be fine with our children having the same liberty as our parents, and the checks and balances of the offline world to also apply online.

Next in the series, we’re going to look at a related topic – public anonymous announcements and the important role the city square soapbox filled in shaping liberty.
