Proc. section 425.16, is affirmed where plainitiff did not satisfy his burden of showing there was a minimal chance his claims would succeed at trial.

(California Court of Appeal) - Affirming the dismissal of a complaint brought by a company formed by a hairdresser who attempted to take advantage of changes in the law relating to whether cancelled companies can pursue litigation rather than litigate in a forthcoming manner, creating a situation where they were technically entitled to proceed but allowing them to do so would be unfair.

(United States Tenth Circuit) - In trademark dispute over steel "body kits" designed to make a truck look like a military-style vehicle, denial of plaintiff GM's motion for preliminary injunction is affirmed where the district court did not abuse its discretion in finding that GM failed to make a strong showing of a likelihood of success on the merits that the "body kits" infringe upon and dilute GM's trade dress rights in its Hummer line of vehicles.

(United States Fifth Circuit) - Held that the U.S. Department of Health and Human Services improperly calculated two Mississippi hospitals' Medicare reimbursements, specifically, so-called Disproportionate Share Hospital payments. Reversed the decision below and remanded to the agency.

(United States Seventh Circuit) - Held that adjoining landowners were not entitled to injunctive relief against a company whose manufacturing plant had polluted the groundwater, in an action under the citizen suit provision of the Resource Conservation and Recovery Act. The plaintiffs did not demonstrate a need for injunctive relief, because state environmental regulators had already sued the company and the two were working together on remedial steps. Affirmed the ruling below.

(United States Federal Circuit) - Vacating the Patent Trial and Appeal Board's dismissal of an interference claim for lack of standing and remanding for further proceedings because the description of a method for removing hair using nanoparticles to damage hair follicles was a sufficient written description under the Patent Act because although the description only gave optical density rather than particles per ml, this was enough of a disclosure to convey to those skilled in the art that the inventor had possession of the claimed subject matter.

(United States Third Circuit) - Vacated an administrative decision ordering a lawful permanent resident removed from the United States for having committed an aggravated felony. The man, a trader at a financial services firm who pleaded guilty to a securities law violation, argued that his crime was not truly an aggravated felony under the Immigration and Nationality Act and therefore he should not be removed. Finding merit in his argument, the Third Circuit granted his petition for review and remanded the case to the Board of Immigration Appeals for further proceedings.

(United States Third Circuit) - Denied an alien's petition for review of a decision ordering him removed from the United States. The Board of Immigration Appeals had ruled that the citizen of Cameroon, who entered the U.S. on a student visa in 1989, was ineligible for waiver of removal because his felony conviction of making false statements about a sham marriage constituted a crime involving moral turpitude. On appeal, the Third Circuit agreed that the man was not eligible for a fraud waiver, and thus denied his petition for review.

The lack of reliable electricity in the developing world is widely viewed by policymakers as a major constraint on firm productivity. Yet most empirical studies find modest short-run effects of power outages on firm performance. This paper builds a dynamic macroeconomic model to study the long-run general equilibrium effects of power outages on productivity. The model captures the key features of how firms acquire electricity in the developing world, in particular the rationing of grid electricity and the possibility of self-generated electricity at higher cost. Power outages lower productivity in the model by creating idle resources, by depressing the scale of incumbent firms and by reducing entry of new firms. Consistent with the empirical literature, the model predicts that the short-run partial-equilibrium effects of eliminating outages are small. However, the long-run general-equilibrium effects are many times larger, supporting the view that eliminating outages is an important development objective.
