Amid all the talk about cutting-edge technology, much of Uber and Lyft’s success actually owes to that fact the ride-sharing companies have been able to exploit a basic loophole: The companies foist the cost of insurance on their drivers, but the drivers' insurance companies don’t know they are underwriting cars for hire, and even if drivers wanted to be honest and get a policy that would cover ride-sharing, they couldn’t, because no such policy exists.

AB-2293, introduced by Assemblywoman Susan Bonilla (D-Concord) and signed into law Wednesday by Governor Jerry Brown, tries to close the loophole by paving the way for insurance companies to offer hybrid personal/commercial policies by next summer.

Uber once derided the bill as a backroom deal between insurance companies and trial lawyers.

"The bill does nothing to enhance safety, yet compromises the transportation choices and entrepreneurial opportunities Uber offers Californians," the company wrote in a June blog post that encouraged customers to contact their representatives opposing the bill.

However, the company backed down and supported the legislation when Bonilla insurance requirements were lowered.

AB 2293 also specifically bans drivers from using their personal policies and mandates drivers have to be covered from the moment they turn on their app and look for customers, which is a response to the tragic accident on New Year's Eve in San Francisco when an UberX driver hit and killed a six year old child.

Uber argued that because the driver was waiting for a fare he wasn't working for the company at the time, so he wasn't covered by the company's insurance.

A moment Hollywood's been waiting a while for will take place... in Hollywood. 

A ceremony is planned for Thursday morning at the Chinese Theater where Governor Jerry Brown will sign the "California Film and Television Job Retention and Promotion Act" into law.

The bill - also known  as AB 1839 — will more than triple the funding for California's film and television production tax credit program. 

The push to expand and enhance the tax credit program has been going on for more than a year. In August of 2013, Los Angeles Mayor Eric Garcetti used the term "state of emergency" to characterize the flight of film and television production to other states and countries. Garcetti is expected to speak at the ceremony. 

Los Angeles-area Assemblymen Mike Gatto and Raul Bocanegra are also expected to be on hand. They introduced AB 1839 in February and moved it strategically through the legislature in Sacramento. While there were few vocal opponents of expanding the tax credit program, the big question was by how much. Many supporters hoped to see the annual pot raised from the current $100 million to at least $400 million, but an exact dollar amount wasn't specified until very late in the legislative process.

In April, the state Legislative Analyst's Office released its hard look at the current tax credit program, pointing out that the state is only getting back 65 cents in tax revenues for every dollar it’s spending on the film and TV subsidy.  The bill to expand the program kept moving.

California's magic number turned out to be $330 million dollars, not as high as chief rival New York State's $420 million per year, but still more than triple California's current offering. Along with the extra cash, AB 1839 also changes the way the tax credit program will be administered.   Rather than using a one-day lottery to determine which productions receive the credit, the state will measure the projects based on their potential to create jobs.   A project that overestimates that potential could be penalized.

Gov. Jerry Brown has headed to the cradle of the Hollywood film industry to sign legislation that more than triples the state's annual tax credit to $330 million a year for films and TV shows produced in California.

Brown says the increase is needed to help prevent other states and countries from hijacking film and TV production by offering their own lucrative incentives.

Brown signed the bill Thursday at the former Grauman's Chinese Theatre, where handprints and footprints of stars from the eras of Humphrey Bogart to Robert De Niro are embedded in concrete.

Under the new system, credit will be awarded based on the number of jobs a production creates and its overall positive impact on the state.

The historic cinema is now called the TCL Chinese Theatre IMAX.

Bill.com and CPA.com Expand Accountant Partner Program

Bill.com and CPA.com have expanded their Accountant Partner Program. The program offers services, resources and technology to help accounting firms solve bill payment challenges for their clients.

The program has been updated to offer services tailored to the needs of large firms. Enhancements include dedicated Bill.com implementers for client portfolios, educational and training resources, and Bill.com accountant-specific features.

The upgrades come in response to a 2017 Bill Payment Trends Survey from Bill.com and CPA.com, which found 77 percent of large accounting firms wish their clients would eliminate paper checks, 75 percent recommend their clients pay their bills online, yet only 25 percent require clients to use a specific solution for digital bill payment. According to Bill.com, this disconnect illustrates an opportunity for client accounting services to be more efficient and demonstrate more value to clients.

The Bill.com Accountant Partner Program now offers:

● Dedicated Bill.com implementation consulting and support for client adoption, including implementers experienced with bill payment in large accounting firms; and

● New features for the Bill.com Accountant Console, a portal that helps firms manage client bill payments. Firms can add and remove staff from multiple clients at once, assign customer roles and permissions, and create reports on billing and system access.

These additions join existing educational resources Bill.com already offers to small and midsize accounting firms.

“The enhanced Accountant Partner Program allows greater collaboration between Bill.com, CPA.com, and accounting firms at every stage of client accounting services,” said Michael Cerami, CPA.com’s vice president of strategic alliances and business development, in a statement. “Whether a firm is targeting prospective or existing clients, the program delivers the tools and resources necessary for firm-wide adoption of digital bill payments.”

Today we celebrate a significant milestone for Montenegro and its people. A decade ago, the country restored its independence. At the same time, Montenegro also joined the Organization for Security and Co-operation in Europe (OSCE), which with 57 participating States is the largest regional security organization worldwide.

By becoming a full-fledged OSCE participating State, and by inviting an OSCE field mission into the country, Montenegro entrusted the OSCE with important responsibilities to assist the country’s development. Hand in hand with Montenegro’s young state institutions and civil society, we embarked on responding to the country’s evolving needs with great enthusiasm.

Evolving democracy

I am proud that we have been able to make a substantial contribution towards further advancing the country’s democratic reform process. Through the hard work and energies of our Montenegrin partners, we can now see that these efforts have borne results and delivered tangible benefits for Montenegrin citizens.

The responsibility displayed in overcoming the recent political crisis is important above all for the people of this country but it is also a positive signal that resonates in the wider region. Political leaders managed to bridge their differences by reaching a compromise that will serve the public interest. It showed us that a crisis can turn into an opportunity.

With strong leadership to success

Leadership, a long-term vision and willingness to compromise will all be greatly needed in the coming months to ensure full implementation of all adopted laws and agreements, thereby creating a level playing field for the parliamentary elections scheduled for this autumn. The elections will be an important test for the country. At present, the Mission to Montenegro is providing technical assistance to the State Election Commission, who will play a key role in the administration of the coming elections.

Public trust requires commitment

Full implementation of necessary laws is vital, particularly in countering transnational threats, strengthening the rule of law and protecting media freedoms. That is where the OSCE can help. We will continue providing assistance in the implementation of many aspects of the reform process in accordance with our mandate. The OSCE, as a strategic partner, can continue to assist Montenegro in developing strong and independent institutions that enjoy wide public trust. Key changes need time, dedication and commitment by all stakeholders.

Diversity and pluralism a key objective

Looking at the broader international context, we see mounting challenges and a complex security environment. Armed conflict is once again a reality on European soil. Unprecedented waves of refugees and migrants continue to test the unity of the international community, and extremist movements continue to promote radical ideologies that threaten dialogue and peaceful coexistence. In these challenging circumstances, building and empowering diverse and pluralistic communities is fundamental, as is the promotion of dialogue and tolerance.  

These challenges show how volatile stability can be and how crises can escalate into violent conflict. Particularly in times of growing tensions, they also underscore the importance of the OSCE’s unique role as a platform for dialogue and as a driver for joint action.

Regional security – Montenegrin security

Only last year, the OSCE marked the 40th anniversary of the Helsinki Final Act, which is the foundation of our security order and the OSCE’s comprehensive approach to security. It is thanks to this heritage that the OSCE Mission to Montenegro has become engaged in many diverse activities, from destroying heavy weapons and unsafe and obsolete military ammunition to supporting the rule of law, democratic policing and good governance, or enhancing environmental awareness and security.

We are pleased with what the OSCE has accomplished not only in Montenegro, but across the Western Balkans. The Organization has played an important role in post-conflict rehabilitation, promoting human rights and building democratic institutions. We have not acted alone but in co-operation with our national and international partners. We believe that strong partnerships offer the best guarantee for broad participation, effectiveness and our joint success.

Legitimate aspirations of today – concrete realities of tomorrow

We commend Montenegro’s achievements, its commitment to further democratic progress, and its role as a recognized factor for stability in the region. Working closely with the Montenegrin authorities and citizens, the OSCE will further develop its role as a partner that is responsive to the country’s evolving strategic priorities. We stand ready to support Montenegro as it continues to progress along the path of reform, where the legitimate aspirations of today can become the concrete realities of tomorrow.

Surveillance amendments in new law in Germany pose a threat to media freedom, OSCE Representative says, asks Bundestag to reconsider bill

VIENNA, 8 July 2016 – OSCE Representative on Freedom of the Media Dunja Mijatović, today expressed concern about a proposed law on the German Foreign Intelligence Agency (BND, Bundesnachrichtendienst), which was debated in the Bundestag, Germany’s Federal Parliament, today.

“Increasing surveillance capabilities of journalists is a clear threat to media freedom,” Mijatović said. “This draft law runs counter to the very core of fundamental freedoms such as media freedom and freedom of expression.”

The draft law increases BND’s capabilities to place foreign journalists under surveillance. Moreover, no exemption is made for the work of journalists, and journalists without citizenship of the European Union can be subjected to surveillance without an explicit court order.

“I call on the German Bundestag to revise the current draft law and ensure proper the protection of journalists regardless of their nationality,” Mijatović said.

The OSCE Representative on Freedom of the Media observes media developments in all 57 OSCE participating States.
