Martin Place tent dwellers pack up after being told their time was up

Emotions were high at Sydney's Martin Place, as some of the homeless people living there packed up their belongings. The tent-dwellers have been camped in the heart of Sydney's financial district for several months and last week their presence led to a stoush between the City of Sydney and the New South Wales Government. Yesterday the State Parliament voted to give police new powers to shut down the settlement. Faced with the prospect of the police moving in, many living there have decided to head elsewhere.

(United States First Circuit) - Reversed the order to dismiss the plaintiff's copyright and trademark claims stemming from a songwriting contest. Plaintiff entered a songwriting competition and agreed to the terms of the contest rules including an arbitration provision. Plaintiff did not win the contest, but alleges that the song he submitted was used by defendant for a music video. The court held that defendant was not a party to the arbitration agreement and could not invoke its provisions.

(United States Federal Circuit) - Affirmed that a Fifth Amendment takings claim was not ripe in a case where the plaintiffs alleged that the U.S. government had caused a compensable taking by barring repairs to forest-fire-damaged roads which provided the only means to access their patented mining and homestead claims within the Santa Fe National Forest. In finding that their regulatory taking case was not yet ripe for review, the appeals court noted that plaintiffs had not yet applied for a permit to reconstruct the forest roads.

(California Court of Appeal) - Held that a skier could not proceed to trial on her negligence claims alleging that, after hurting her knee, she was helped down the mountain by a ski patrol when the rescue sled in which she was riding went out of control and hit a tree. Affirmed summary judgment for the ski resort.

(United States Ninth Circuit) - Affirmed. Twenty-three defendants appeal the denial of their motions for sentence reductions based on retroactive Sentencing Guidelines revisions. The panel affirms, finding the district court was not required to grant their motions because the sentences were below the range in the Sentencing Guidelines.

Martinez-Perez v. Sessions

(United States First Circuit) - Affirmed the denial of an asylum claim in a case where an immigrant claimed mistreatment in Honduras because of her Afro-Honduran race and physical disability caused by polio. The Board of Immigration Appeals rejected her asylum application upon finding that the harassment she endured in Honduras did not rise to the level of persecution. Agreeing with the Board's assessment, the First Circuit denied her petition for judicial review.
