Los Angeles County filed a misdemeanor criminal complaint against SoCalGas for a natural gas leak that continued for months and caused damage to residents. The criminal charges were resolved by a plea agreement, where a no contest plea was entered to the charge of failure to immediately report gas leak. Plaintiffs sought to set aside plea agreement and seek restitution under the California Constitution. The appeals court held that victims do not have a right to appeal a criminal case judgment, but they do have a right to restitution. However, restitution is only available for crimes where there is an actual conviction.

(United States DC Circuit) - Vacated. A district court conclusion that executive orders regarding relations between the federal government and its employees was unlawful was in error. The district court lacked jurisdiction.

(United States Federal Circuit) - Appeal from Patent Trial and Appeal Board which held certain patent submittals unpatentable and denied plaintiff the opportunity to amend. Patent submittals relates to a method of drilling assistance for dental work and, the Board ruled, were based on previous patents. Court of Appeals affirmed in part, vacated in part, and remanded in part. Court of Appeals agreed that certain patent submittals were unpatentable, but vacated the denial of the motion to amend

(United States Fourth Circuit) - Affirming the remand of a case involving a dispute between a government contractor and its subcontractor because the party seeking to remove to federal court filed an untimely notice to remove and had waived its right to remove by engaging in substantive defensive action in state court prior to filing a notice of removal by filing counterclaims in state court.

(United States Ninth Circuit) - Held that President Trump's executive order withholding all federal grants from so-called sanctuary cities was unconstitutional. California municipalities brought this suit arguing that the executive order violated the principle of Separation of Powers as well as the Spending Clause, which vests exclusive power to Congress to impose conditions on federal grants. In a 2-1 decision, the Ninth Circuit agreed and affirmed summary judgment in favor of the municipalities. However, the panel vacated the nationwide injunction based on an absence of specific findings justifying the broad scope, and remanded for further findings.

(United States Seventh Circuit) - Vacated and remanded. The denial by an administrative law judge of an individual's application for disability benefits based on mental health impairments and its subsequent affirmation by the district court were vacated because the ALJ didn't adequately account for the person's difficulties with concentration, persistence, or pace in the workplace.

(United States Ninth Circuit) - Stay of the district court order granting Plaintiffs injunction is not warranted. Plaintiffs sued Defendants to enjoining them from reprogramming funds from the Department of Defense toward building a barrier along our country’s southern border. The appeals court concluded that Plaintiffs have a strong likelihood that they will prevail in this litigation.
