SFWA Contracts Committee Advisory on No-advance Contracts

Recently, SFWA's Contracts Committee was made aware of a situation in which a well-liked publisher canceled the publication of a number of books it had contracted to publish. The publisher said the decision was made because of "unexpected changes" at the company. The Committee has reviewed the contract in use, which lacked a provision for such a cancellation. The Committee believes that canceling a contracted book that satisfies the author’s obligations is at odds with the spirit of the contract. Making this situation worse is the fact that these were no-advance contracts. Because no advance was paid, the publisher could make this decision without financial penalties. The authors' books, were, in effect, put in limbo for many months and the authors received nothing but an apology. Besides depriving the authors of the ability to sell the books elsewhere during this delay and putting off any income from the books into the indefinite future, the authors careers suffer as a result.

Publishers of all sizes may find themselves unable to live up to their contractual commitments for a wide variety of reasons, some of which could not have been reasonably anticipated. Hence, the Contracts Committee urges writers to think carefully about signing a contract that provides no advance, or only a nominal advance, while tying up their work for a lengthy period of time. Critically, payment of an advance gives an indication the publisher actually has the financial resources to meet its obligations. Publishers who do not pay advances or pay only nominal advances should include language in their contracts specifying how they can cancel a book and what happens if they should cancel a book, including a specified amount of compensation to the author.

The cancellations were first reported on October 8 by Jason Sanford in his Genre Grapevine column, and discussed on October 9 in Mike Glyer's File 770. Fireside publisher Pablo Defendini issued a statement on October 8, in which he revealed that the five canceled contracts were for manuscripts that were "unpublished and unannounced", and attributed the cancellations to disruptions caused by editorial departures.

Author Meg Elison, one of the canceled authors, did not find this to be a sufficient explanation...and she was livid.



A few days later, Defendini issued an apology. "I can see now how [the cancellation emails] read as callous, uncaring, and dismissive of the authors’ feelings," he wrote. "I’m very sorry for that....My behavior was not consistent with Fireside’s values, and I deeply regret it."

Beyond the Contracts Committee's general warning about no-advance contracts (and if you're part of the small press world, you know how common these are): multiple simultaneous contract cancellations are not frequent or normal, and can signal trouble beyond whatever the publisher offers as an explanation (if it explains at all). Ditto for a publisher that suddenly starts offering to revert rights on request.

Fireside's situation also highlights the risks of signing with a publisher that's essentially a one-person operation (as Defendini admits in his apology). With the best will in the world, the publisher can be sidelined by a single bad event (personal or professional), leading to glitches, errors, and delays in scheduling, payment, and more. Writer Beware's files are stuffed with such stories.

Troubled publishers do recover, or at least hang on. Month9, which canceled dozens of contracts in 2016, is still publishing, as is Permuted Press, which axed an undisclosed number of titles in 2015 (both publishers cited overstocked lists, though in both cases there were other issues as well). In the short term, though, if a publisher is or has been actively shedding writers, it's best to hold off on submitting until it's clearer what's going on.

A massive fire broke out in a three-storey building in the Kasa area here in the wee hours today, the district rural police said. One person was feared dead, but there was no official confirmation yet, they said. The police received a call around 3.30 am about the blaze in the residential-cum-commercial building, located near a temple in the Kasa area of the Dahanu taluka.

The building's ground floor and the first floor, which housed a provisions store and its godown, were completely gutted in the fire, the police said in a release issued here. However, residents of the four apartments on the building's second floor were evacuated, the police said, adding that one person was feared killed in the fire, but there was no official confirmation yet. Three fire engines were rushed to the spot. The flames were doused but the cooling work was still on, the police added.

According to reports, a fire broke out in a building in Mulund area in central Mumbai.

The fire took place at Sheetal Chhaya building located at JN Nagar situated in Mulund. Three fire engines were immediately rushed to the spot.

On Friday, a massive fire had broken out in a mobile shop near Ghatkopar Railway Station. The incident occurred around 2.40 PM at Top Ten Mobile Shop, Near Ghatkopar Guest House, Opposite Platform no.1. Soon four fire engines and ambulances were rushed to the spot. Four fire tenders also deployed. As per the initial report, no casualties were reported in the incident.

A fire broke out at a building in South Mumbai in the wee hours of Wednesday and firefighters managed to douse the flames. No injuries or casualties have been reported in the fire. A blaze broke out at the Dharam Villa building situated on Bhulabhai Desai Marg at around midnight.

The first call to the fire station was received at 12:36 am and eight fire tenders were rushed to the spot. According to fire officials, the level III fire was confined to doors, lift, and staircases on the fourth, fifth, seventh and eighth floor of the nine-floor building, which includes a basement.

Mumbai city suburbs of Tilak Nagar, located in Chembur faced another fire hazard on Wednesday evening. According to reports, building no 50, which is a multi-storey establishment which is located near Saraswati school caught fire. Four fire engines and water tankers were dispatched to the spot.

In a similar incident, a fire had broken out at Sadhana Industrial Estate near Mahindra Tower, Worli around 4.30 pm on December 29. Eight fire engines, two fire tenders, seven jumbo tankers were rushed to the spot. The ground-plus three-storey commercial structure was completely engulfed in smoke, said a fire official. Twelve firemen were rushed to the hospital, after they complained of suffocation.

A month ago, a deadly blaze at ESIC Kamgar Hospital at Marol in suburban Andheri had claimed six lives and left more than 30 injured. The building had neither a fire NOC nor occupation certificate. Ten fire tenders and 15 ambulances were rushed to the spot. The fire brigade officials said 147 people were rescued from the hospital, which includes patients as well as staff members.

A habitual wife-beater has landed behind bars for trying to burn down his neighbour's house when the latter tried to rescue the woman during a fight. After the secretary of Shivswaraj Society in Pant Nagar, Ghatkopar filed a complaint against the accused Alok Verma, 35, the local cops arrested him.

According to the police, Verma used to often fight with his wife and beat her up while drunk. Speaking to mid-day, secretary Rajgopal Nadar said, "On April 26, Verma reached home inebriated and started fighting with his wife. He even threw the food outside the house and vandalised the utensils inside. Soon after, his son came to my house and begged me to save his mother."

Nadar went to their house and tried to stop Verma. "When I was trying to talk to him, he suddenly pinned his wife to the floor and started punching her. I immediately pulled him up and shouted at him, asking him to leave or else I would call the cops," Nadar said.

According to the complainant, Verma felt insulted at being yelled at and in turn threatened Nadar with harm. However, Nadar took his words lightly as he was drunk. Around midnight, the accused returned with petrol and set the door to Nadar's home on fire.

When one of the residents smelled something burning, he went out to check and saw flames had engulfed Nadar's door and window curtains. However, the neighbours rushed to the house with water and managed to douse the fire.

"Initially, we were not aware of how this happened. But later when I checked the CCTV footage from the cameras outside my door, I saw who the culprit was. After that I approached the Pant Nagar police and filed a complaint against Verma," said Nadar.

When contacted, Rohini Kale, senior police inspector of Panth Nagar police station, said, "The accused has been arrested under various sections of the IPC. The matter is being investigated."

A major fire broke out at a Big Bazaar outlet in Matunga West area on Monday afternoon. As per reports, the fire broke out in a ground-plus-one building housing. However, no casualties have been reported so far.

Several Fire Brigade personnel, one ambulance and a Quick Response Vehicle reached the spot to douse the flames. Five fire engines have also been deployed at the spot, said the officials.

All the people inside the store at the time of the fire were reportedly were to rushed out to safety and no casualty has been reported as yet. Firefighting operations were continuing.

A similar incident occurred last week in South Mumbai. According to reports, a fire broke out at the famous Crawford Market area. Reports also state that four fire engines were immediately rushed to the spot.

The fire engines are currently making efforts to douse the flames at Crawford Market. No casualty was reported in the incident, he said.

The blaze erupted around 10.50 am at the shopping centre located behind a mosque on Abdul Rahman Street and spread rapidly in the complex, the official said.

Several electronic goods, plastic, stationery items and electric installations were gutted in the fire, he said.

Four fire engines, as many water tankers, and a quick response vehicle were rushed to the spot, he said. The fire brigade personnel managed to extinguish the flames after hectic efforts for about an hour, he said.

The exact cause of the blaze was yet to be ascertained, the official said, adding that a probe was on into the incident.

As many as 160 personnel of the Mumbai Fire Brigade (MFB) have been keeping your city clean in an effort to prevent the spread of the deadly novel Coronavirus. Thirty-two teams of the MFB have sanitised more than 3,000 places, including hospitals and containment zones, over the past month.

The MFB teams, following the instructions of the BMC's health department, have disinfected 3,063 spots using 2.47 lakh litres of sodium hypochlorite. They have been disinfecting hospitals and the areas, which have been sealed following a spurt in cases of COVID-19 infections, on alternate days. The fire department said they are using 17 quick response vehicles, nine mist blowing machines and six boom mist machines to sanitise the affected places.

The real challenge is to disinfect the gullies around the houses and narrow pathways in the slum where hardly one person can walk at a time, said an officer from the MFB. "The number of containment zones in the slum has increased, but the fire brigade team is working hard to sanitise all the areas in time, and effectively," the officer added.

There are at least 160 firefighters who are working indefatigably to sanitise the streets and buildings in these times.

A report in this paper detailed how fire brigade personnel are divided into 32 teams and are sanitising more than 3,000 spots in the city, including, of course, hospitals and other places. The service has pressed its machinery into effect but it is in the end, the human chain that is driving the humongous effort of sanitising a teeming, and impossibly crowded city.

Let us recalibrate some aspects of our life and living, post these measures. One of those must be a more conscious effort to fighting fires. Let us make things easier for these firemen. This means working fire equipment in residential buildings. Do press upon the housing society committee that it is absolutely non-negotiable that they have firefighting equipment in the building premises.

We must also have residents attending the drill and familiarising themselves with the working of fire extinguishers, otherwise, the installation is merely cosmetic.

Learn from credible websites about what constitutes as the first response during fires. Knowledge about how to react first, before the experts reach, is important.

Try to keep stairwells and passages free in all buildings for a getaway in case of fire. Landlords of commercial buildings must check if compounds can be de-congested for easier access in case of fire. Easier said than done in a city where every inch of space is a luxury, but some method to the parking madness may be effective to some degree.

Small measures can go some way to make life easier for our firefighters. A more concerted effort is needed, so that we become allies with our men in blue, who are today preoccupied with protecting us in a different way.

A fire broke out at near Ganesh talkies in Lalbaug on Saturday evening.

Fire fighters rushed to the spot and extinguished the fire using three fire jets. So far no casualties have been reported and the cause of fire is yet to be ascertained

The fire was confined to electric wiring, electric installation, wooden furniture, steel furniture, Ganesh idol making fibre frames, raw material, oil, washing machine, clothes, chairs, Ganesh idols, wooden base, scrap material, mattress, cement sheet and tarpuline sheet etc. 

A fire was reported on the sixth floor of Atlas building in Napean Sea Road, on Tuesday morning. While no casualties were reported, two women were rescued from the building, a fire official said.

The fire was reported in the 11-storey residential building at 4:41 am on Tuesday and the fire brigade arrived at the scene at 4:55 am. As the intensity of the fire increased it was reported as a Level 2 fire. It gutted its two bedrooms, electric wiring and installations, wooden beds, bedding, furniture, and clothing, the official said.

The fire was brought under control within four hours, at 8.40 am, with the help of eight fire engines. The cause of the fire is yet to be ascertained, the official added.

A fire broke out in an apartment on the sixth floor of the Atlas building on Napean Sea Road on Tuesday morning. While the occupants managed to rush down to safety, two women on the upper floors got stuck and were rescued by the fire brigade personnel.

The Mumbai Fire Brigade said the fire was reported at 4.41 am and they reached the site at 4.55 am with three fire engines, four jumbo tankers and one turntable ladder. However, they faced hurdles as the road leading to the building was packed because of parking.

"The team reached on time, but there several vehicles were parked on the road, blocking fire fighting vehicles' way to the building," said local corporator Jyotsna Mehta.

The firemen then went to the opposite building and were able to douse the flames after almost four hours. Deputy Fire Officer A J Mishra also pointed out that the parking was one of the major hurdle in the operation. "There was a strong wind too," he said. "We got a water connection and started operation from the opposite building to stop the vertical spread of the fire. So the major casualty averted," he said, adding that the fire was brought under control around 8.40 am.

A fireman said, "The residents left all the doors of the flat open. So it was difficult to search the origin of the fire. Besides, there wasn't a fire fighting system inside the building that is more than 30 years old."

The cause of the fire is not known.

A fire broke out at Vishnu Mahal, a residential building near Wankhede Stadium on Wednesday morning. This the second fire incident on consecutive days in south Mumbai.

The flames started in one of the apartments on the second floor of the building at D road, Marine Drive. There was a fire extinguisher in the building which helped to douse it before it spread. No one reported injured. The cause of the fire is yet to be ascertained.

Yesterday there was a fire incident at 10-storey Atlas building on Napean sea road. It took four hours for the fire brigade to control the fire due to strong winds and initial hurdles of parking cars.

This is the second fire incident to reported in a single day. Earlier in the day, a fire broke out at Vishnu Mahal, a residential building near Wankhede Stadium. The flames started in one of the apartments on the second floor of the building at D road, Marine Drive.

There was a fire extinguisher in the building which helped to douse it before it spread. No casualty was reported in the fire.

It is hard to believe that I will not see him again, in person. The worst part is that I couldn't be there with him and his family for the final rites. I met him in the latter part of 2019. He was jovial. I remember looking at him and thinking that the worst phase of his life is behind him. There wasn't an iota of [weakness] in his eyes. One couldn't, from his body language, gauge that he was enduring any pain or difficulty. The unfortunate turn of events was unexpected.

More than being his co-star, I was a fan. I loved Rishi and Neetu, as a couple, and wouldn't miss a single film of the duo. For me, the turning point [in my career] came when I signed a movie with him. Rishi was the one who recommended my name to Nasir Hussain, and that's how I landed up in Zamane Ko Dikhana Hai.
 
The first shot that we did together was for the song Poocho na yaar kya hua. I remember it vividly. I had to do a dance sequence and then hug him. I was shivering because I was a fan.

We shot [Hoga tumse pyara kaun] on a train, and it was a surreal experience. It was hot, and we were trying to look our best, and do the best that we could. Unfortunately, my scarf caught fire, and, like a true hero, Rishi ran towards me and rescued me. 

He was a foodie. I'd get prawns and fish curry to the sets and we would eat together. More than him, we loved his Punjabi lunch that Neetu would send. Neetu would send healthy food, but she never knew that he'd, in fact, be eating his co-stars' meals.

He is going to be missed. My heart goes out to Ranbir and Ridhima.

A 35-year-old police constable on lockdown duty here in Maharashtra was injured after a man allegedly assaulted him and tried to set him ablaze, an official said on Wednesday. The accused, identified as Arun Sinh Jadhav, has been arrested, he said. The incident took place near Maloli village in Malshiraj tehsil of Solapur on Tuesday night when the constable was asking people to stay indoors, a duty officer at Velapur police station said.

"At that time, Jadhav came in his car and started abusing the policeman. The accused sought an explanation from the constable as to why he had gone to check his brother's hotel," the official said. Jadhav snatched the policeman's phone and threw it on the road. He then allegedly slashed the constable's left hand and face with a blade and started thrashing him, the official said. "The accused then took out a bottle of petrol from his car and allegedly poured it on the policeman. However, a
police patil (village-level official) and some others caught hold of Jadhav and stopped him from setting the constable on fire," the official said.

The constable, who is attached to Velapur police station, later lodged a police complaint in connection with the incident.
