(United States Ninth Circuit) - Reversing a district court order decertifying a class action relating to an alleged aphrodisiac called 'Cobra Sexual Energy' because the district court abused its discretion in decertifying the class on the basis of the plaintiff's inability to prove restitution damages through the full refund model because plaintiff's damages model matched his theory of liability and because his damages model was supportable on evidence that could be introduced on trial and whether plaintiff could provide damages to a reasonable certainty on the basis of his full refund model was a question of fact to be decided at trial.

Nutraceutical Corp. v. Lambert

(United States Supreme Court) - Held that the federal rule governing appeals from orders granting or denying class certification is not subject to equitable tolling. The plaintiff contended that his failure to comply with the 14-day limit specified in Federal Rule of Civil Procedure 23(f) should be tolled, because he had acted reasonably in the particular circumstances here. Disagreeing, the U.S. Supreme Court declared that the time limit for appealing class certification rulings cannot be equitably tolled. Justice Sotomayor wrote the unanimous opinion.

I've been interested in the topic of contraception and faith for quite some time, both in light of my own unwillingness to think about contraception in theological terms in the early years of my marriage (an unwillingness I have observed in others as well), and also in the way decisions about contraception spill into the public square. As the series comes to a close, I wanted to recap the series of posts that provide personal stories and comprehensive views on contraception

Are Christians Afraid to Talk about Contraception?

As I wrote in this introdution to this series, "I hope that this range of voices and perspectives will aid us in thinking through these decisions in a way that brings God into the conversation. How God’s great grace blots out our sin.

In Romans 1:28–32, Paul describes most of human history outside of Jesus. From envy and pride to disobedience and evil, we all struggle with these issues in ways large and small. You might be surprised how much. Take a moment of truth and watch the clip above as we walk through each of the items in Paul’s list and ask where we stand. Like me, you might find that you fit the description, too.

Now let me tell you about the truth that sets us free because Jesus loves us. Because of the atonement, through the shedding of his blood, he covers over our sins. He literally blots out our sins, past, present, and future. Because we are unable to forgive ourselves, God says he is going to forgive us. It is his great grace that transforms lives.

(United States Third Circuit) - Remanded for reconsideration of whether former employees of an asbestos mining and processing operation in Montana could bring a negligence suit against the now-bankrupt company's insurers. The insurers sought a declaratory judgment that the former employees, who now suffer from asbestos disease, were barred from proceeding with their lawsuit because the bankruptcy court had already created a trust to compensate persons injured by the company's asbestos. On appeal, the Third Circuit affirmed in part and vacated and remanded in part.
