Letters: Striking a balance (4/29/20)

Striking a balance Easing the restrictions on COVID-19 risky activities is like setting a speed limit on our roads. The higher the speed limit, the greater the freedom to drive as one pleases, and the greater the number of statistically probable deaths. There are those who would advocate for unfettered freedom notwithstanding higher death rates, and vice versa. The political and economic challenge is in finding a socially acceptable balance. Although one might differ from our elected leaders on where to set the limits, or how fast to proceed in adjusting those limits, there is going to be a trial-and-error period during which data and societal feedback will trend toward an acceptable trade-off between freedom and harm. Let’s cut our local leaders some slack as they attempt to strike a balance.

St. Pierre v. Retrieval-Masters Creditors Bureau, Inc.

(United States Third Circuit) - Held that unpaid highway tolls are not the type of debt that can support a claim under the federal Fair Debt Collection Practices Act (FDCPA). A driver who failed to pay tolls on the New Jersey Turnpike because his electronic payment account was in arrears filed a class-action complaint alleging that a debt collection agency used impermissible means to collect the debt. Affirming dismissal of his complaint, the Third Circuit held that highway tolls are a legal obligation in the nature of a tax that falls outside the scope of the FDCPA.

In re Tribune Media Co.

(United States Third Circuit) - Held that the bankruptcy court correctly disallowed a claim brought by the debtor's former employee. A former television station employee argued that the station, whose owner was now in bankruptcy, was liable for unlawful racial discrimination. Affirming summary judgment against his claim, the Third Circuit concluded that he failed to raise a triable issue and, further, that it was too late for him to challenge the bankruptcy court’s jurisdiction to hear his discrimination claim, since he never objected to this during bankruptcy proceedings.

Trinity Industries Inc. v. Greenlease Holding Co.

(United States Third Circuit) - Vacated a ruling allocating the costs of cleaning up a contaminated manufacturing site. A successor company brought a contribution action against its predecessor company seeking to recover the costs it had incurred when government regulators forced it to remediate the site. The district court arrived at a percentage method of splitting the costs between the two companies, but on appeal the Third Circuit reversed and remanded for further proceedings.
