The Court:- Mr. Mitra, learned senior advocate prays for hearing of this application under section11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the said Act) on the ground that the arbitrability of a dispute should not be decided by this Bench. This issue should also be decided by the learned arbitrator. Mr. Mitra further contends that once there is an arbitration clause and arbitration has been invoked under section 21 of the said Act, all that this court is supposed to do is to appoint an independent person to act as an arbitrator.

Mr. Sinha, learned advocate for the respondent opposes such prayer and submits that the order passed under section 9 of the Arbitration and Conciliation Act, 1996 in favour of Mr. Mitra's client, has been challenged before the Hon'ble Division Bench. Mr. Sinha has produced an order dated 15th April, 2024 passed in the appeal preferred by the respondent. The question of jurisdiction of the arbitrator to decide the dispute has been raised. The Hon'ble Division Bench had observed that it would be up to the learned single judge whether to decide the question or to adjourn the proceedings, in order to enable the Division Bench to proceed. Mr. Sinha submits that the erstwhile Single Bench had adjourned this matter, on the basis of the order of the Hon'ble appeal Court.

A new study led by researchers at McGill University finds that people who get their news from social media are more likely to have misperceptions about COVID-19. Those that consume more traditional news media have fewer misperceptions and are more likely to follow public health recommendations like social distancing.

In a study published in Misinformation Review, researchers looked at the behavioral effects of exposure to misinformation by combining social media analysis, news analysis, and survey research. They combed through millions of tweets, thousands of news articles, and the results of a nationally representative survey of Canadians to answer three questions: How prevalent is COVID-19 misinformation on social media and in traditional news media? Does it contribute to misperceptions about COVID-19? And does it affect behavior?

Misjudging information can spiral out of control in hours. Researchers at the Harvard Kennedy School highlight that misinformation is a major threat to global public health(opens in a new tab), especially when there is a large lag between the emergence of a disease and an effective solution. Examining COVID-19, they identified that the lag time for vaccine development has created a vacuum for scepticism to grow and misinformation to spread – which has been amplified by bots and trolls.

Social media is designed to share information we believe to be correct, quickly, and works on gut-based intuitions where patterns are rapidly recognised, and biases quickly confirmed.

Misinformation is having a serious impact on our health worldwide.

One of the most important things to learn is that misinformation and especially disinformation do not just affect us cognitively, they affect us emotionally. They often trigger an emotional response. They can make us outraged or angry, and self-righteous. And this can activate us to do something, like press the share button. Tuning in to our emotions, to how information makes us feel, can help us recognize when someone might be trying to manipulate us into becoming part of their disinformation campaign.
