Surface Temperatures at the Continental Scale: Tracking Changes with Remote Sensing at Unprecedented Detail

Temperature is a main driver for most ecological processes, and temperature time series provide key environmental indicators for various applications and research fields. High spatial and temporal resolutions are crucial for detailed analyses in various fields of research. A disadvantage of temperature data obtained by satellites is the occurrence of gaps that must be reconstructed. Here, we present a new method to reconstruct high-resolution land surface temperature (LST) time series at the continental scale gaining 250-m spatial resolution and four daily values per pixel. Our method constitutes a unique new combination of weighted temporal averaging with statistical modeling and spatial interpolation. This newly developed reconstruction method has been applied to greater Europe, resulting in complete daily coverage for eleven years. To our knowledge, this new reconstructed LST time series exceeds the level of detail of comparable reconstructed LST datasets by several orders of magnitude. Studies on emerging diseases, parasite risk assessment and temperature anomalies can now be performed on the continental scale, maintaining high spatial and temporal detail. We illustrate a series of applications in this paper. Citizens’ Observatories: Five EU FP7 Projects Focused on Citizen Science

Five  projects focused on citizen science began their life in autumn 2012 as a part of the topic ENV.2012.6.5-1 "Developing community based environmental monitoring and information systems using innovative and novel earth observation applications". Their goals include developing novel technologies and applications in the domain of Earth Observation; exploiting portable devices (smartphones, tablets, etc.) and enabling effective participation by citizens in environmental stewardship based on broad stakeholder and user involvement in support of both community and policy priorities.

These projects are:

CITI-SENSE - aiming to empower citizens to both contribute towards, and participate in environmental governance, by developing up to 30 Citizens’ Observatories supporting a range of services related to environmental issues of societal concern with participatory sensing tools and methods being central.

OmniScientis - combining the active participation of the stakeholders, especially citizens, with the implementation of innovative technologies to improve the governance of odour nuisance. OMNISCIENTIS implements an odour monitoring and information system allowing feedback in real-time, based on a web-based Service Platform.

Citclops - developing an observatory based on citizens’ science applications for the bio-optical monitoring of coast and ocean. Specifically, the Citclops action develops systems to retrieve and use data on the colour, transparency and fluorescence of seawater using low-cost sensors and smart phones along with contextual information.

COBWEB - seeking to design, develop and validate the necessary software infrastructure to facilitate and make possible the opportunistic harvesting and quality control of crowdsourced environmental data.

WeSenseIt - enabling citizens to become active stakeholders in information  capturing, evaluation and communication for the water environment including flood risk.

Together these projects will enable sharing of data and information through advanced data management strategies based on open e-collaboration, addressing questions of privacy, data standards, quality and reliability. 

The Facebook  page ‘Citizens’ Observatories’ group acts as one focal point for the development and promotion of ‘Citizens' Observatories worldwide‘ as an essential tool and a common perspective to better observing, understanding, protecting and enhancing our environment.

Article Alert: Scientific names of organisms: attribution, rights, and licensing

Background: As biological disciplines extend into the ‘big data’ world, they will need a names-based infrastructure toindex and interconnect distributed data. The infrastructure must have access to all names of all organisms if it is to manage all information. Those who compile lists of species hold different views as to the intellectual property rights that apply to the lists. This creates uncertainty that impedes the development of a much-needed infrastructure for sharing biological data in the digital world.
 
Findings: The laws in the United States of America and European Union are consistent with the position that scientific names of organisms and their compilation in checklists, classifications or taxonomic revisions are not subject to copyright. Compilations of names, such as classifications or checklists, are not creative in the sense of copyright law. Many content providers desire credit for their efforts.
 
Conclusions: A ‘blue list’ identifies elements of checklists, classifications and monographs to which intellectual property rights do not apply. To promote sharing, authors of taxonomic content, compilers, intermediaries, and aggregators should receive citable recognition for their contributions, with the greatest recognition being given to the originating authors. Mechanisms for achieving this are discussed.

Article Alert: Ten Ways Remote Sensing Can Contribute to Conservation

Abstract: In an effort to increase conservation effectiveness through the use of Earth observation technologies, a group of remote sensing scientists affiliated with government and academic institutions and conservation organizations identified 10 questions in conservation for which the potential to be answered would be greatly increased by use of remotely sensed data and analyses of those data. Our goals were to increase conservation practitioners’ use of remote sensing to support their work, increase collaboration between the conservation science and remote sensing communities, identify and develop new and innovative uses of remote sensing for advancing conservation science, provide guidance to space agencies on how future satellite missions can support conservation science, and generate support from the public and private sector in the use of remote sensing data to address the 10 conservation questions. We identified a broad initial list of questions on the basis of an email chain-referral survey. We then used a workshop-based iterative and collaborative approach to whittle the list down to these final questions (which represent 10 major themes in conservation): How can global Earth observation data be used to model species distributions and abundances? How can remote sensing improve the understanding of animal movements? How can remotely sensed ecosystem variables be used to understand, monitor, and predict ecosystem response and resilience to multiple stressors? How can remote sensing be used to monitor the effects of climate on ecosystems? How can near real-time ecosystem monitoring catalyze threat reduction, governance and regulation compliance, and resource management decisions? How can remote sensing inform configuration of protected area networks at spatial extents relevant to populations of target species and ecosystem services? How can remote sensing-derived products be used to value and monitor changes in ecosystem services? How can remote sensing be used to monitor and evaluate the effectiveness of conservation efforts? How does the expansion and intensification of agriculture and aquaculture alter ecosystems and the services they provide? How can remote sensing be used to determine the degree to which ecosystems are being disturbed or degraded and the effects of these changes on species and ecosystem functions?

A new EU BON acknowledged paper "Advancing species diversity estimate by remotely sensed proxies: A conceptual review" has been recently published in the journal Ecological Informatics.

Abstract: 

Many geospatial tools have been advocated in spatial ecology to estimate biodiversity and its changes over space and time. Such information is essential in designing effective strategies for biodiversity conservation and management. Remote sensing is one of the most powerful approaches to identify biodiversity hotspots and predict changes in species composition in reduced time and costs. This is because, with respect to field-based methods, it allows to derive complete spatial coverages of the Earth surface under study in a short period of time. Furthermore, remote sensing provides repeated coverages of field sites, thus making studies of temporal changes in biodiversity possible. In this paper we discuss, from a conceptual point of view, the potential of remote sensing in estimating biodiversity using various diversity indices, including alpha- and beta-diversity measurements.

Earth Observation for Ecosystems Monitoring in Space and Time: A Special Issue in Remote Sensing

A new EU BON acknowledging special issue "Earth Observation for Ecosystems Monitoring in Space and Time: A Special Issue in Remote Sensing" published in the open access journal Remote Sensing provides a collection of  important researchers in the field, as well as the most challenging aspects of the application of remote sensing to study ecosystems. 

The special issue represents a stimulating discussion concerning innovative techniques/approaches that are based on remote sensing data, which are used for the study of ecosystems at different spatial and temporal scales. Research scientists and other subject matter experts submitted innovative and challenging papers that showed advances in several topics:
 
- estimating the spatial distribution of plant species richness by Light Detection and Ranging (LiDAR) and hyperspectral
data,
- assessing habitat quality of forest corridor based on NDVI,
- applying remote sensing to study (marine) coral ecosystems,
- identifying ecosystem functional types,
- distinguishing between different forest trunk size classes from remote sensing,
- detecting changes in forest patterns,
- applying light use efficiency models to estimate vegetation productivity,

EU BON at the BACI Workshop "Remote sensing applications related to land use/change"

From 9 to 11 November in Vienna, Austria the EU H2020 project Detecting changes in essential ecosystem and biodiversity properties – towards a Biosphere Atmosphere Change Index: BACI has organised a special workshop titled "Remote sensing applications related to land use/change" with the aim to facilitate co-design and co-production of knowledge with regard to innovative applications of remote sensing products.

EU BON project partner Duccio Rocchini was among the invited lecturers at the event. His talk titled "Like in a Rubik’s cube: Recomposing Biodiversity Information by Remote Sensing Data" introduced some experience from EU BON.

  

The overarching objective of BACI is to tap into the unrealized potential of existing and scheduled space-borne Earth observation data streams to detect changes in ecosystem functioning and services that have repercussions for essential biodiversity variables, land use potentials, and land-atmosphere interactions.

PhD Offer: monioring biodiversity variables from satellite remote sensing using artificial intelligence methods

The Faculty of Geo-Information Science and Earth Observation (ITC) at the University of Twente has recently launched an investment programme to strengthen its international academic fields. For 11 pioneering-multidisciplinairy projects a PhD-position is made available, three of them already are filled in. The Department of Natural Resources (NRS) specialises in advanced spatial and temporal analysis and technique development for the environment as well as sustainable agriculture.

Job Description: 

The aim of this PhD project is to develop a cloud based artificial neural network for processing large remotely sensed data sets in order to generate essential biodiversity variables (as defined by Pereira et al. (2013) and Skidmore et al. (2015)). The PhD candidate, in combination with supervisors and programming support, will develop innovative artificial intelligence techniques for estimating biodiversity variables using massive cloud based data sets of satellite remotely sensed, in situ and ancillary data. Potential candidate biodiversity variables to be retrieved from satellite remote sensing include pertinent indicators of ecosystem function, ecosystem structure and species traits. The research will result in a PhD thesis.

Potential of satellite remote sensing to monitor species diversity

The importance of measuring species diversity as an indicator of ecosystem health has been long recognized and it seems that satellite remote sensing (SRS) has proven to be one of the most cost-effective approaches to identify biodiversity hotspots and predict changes in species composition. What is the real potential of SRS and what are the pitfalls that need to be avoided to achieve the full potential of this method is the topic of a new research, published in the journal Remote Sensing in Ecology and Conservation.

The new study, supported by the FP7 funded EU project EU BON takes the assessment of diversity in plant communities as a case study. Showing the difficulties to achieve high results by relying only on field data, the paper discusses the advantages of SRS methods.

"In contrast to field-based methods, SRS allows for complete spatial coverages of the Earth's surface under study over a short period of time. Furthermore, it provides repeated measures, thus making it possible to study temporal changes in biodiversity," explains Dr. D. Rocchini from Fondazione Edmund Mach, lead author and WP deputy leader / task leader in EU BON. "In our research we provide a concise review of the potential of satellites to help track changes in plant species diversity, and provide, for the first time, an overview of the potential pitfalls associated with the misuse of satellite imagery to predict species diversity. "

Traditionally, assessment of biodiversity at local and regional scales relies on the one hand on local diversity, or the so called alpha-diversity, and on the other, on species turnover, or beta-diversity. Only in combination of these two measures can lead to an estimate of the whole diversity of an area.

While the assessment of alpha-diversity is relatively straightforward, calculation of beta-diversity could prove to be quite challenging. This is where increased collaboration between the remote sensing and biodiversity communities is needed in order to properly address future challenges and developments.

The new research shown the high potential of remote sensing in biodiversity studies while also identifying the challenges underpinning the development of this interdisciplinary field of research.

"Further sensitivity studies on environmental parameters derived from remote sensing for biodiversity mapping need to be undertaken to understand the pitfalls and impacts of different data collection processes and models. Such information, however, is crucial for a continuous global biodiversity analysis and an improved understanding of our current global challenges."concludes Dr. Rocchini.

EU BON workshop "Biodiversity research for and by citizens in Eastern Europe: tools, information services and public engagement"

The EU BON workshop "Biodiversity research for and by citizens in Eastern Europe: tools, information services and public engagement" was organized to present the EU BON citizen science gateway, share accomplishments of the project, promote products, raise and discuss challenges of citizen science and facilitate networking between countries, especially eastern and central European countries.

There were 33 participants from Baltic countries and Finland and EU BON partners from Norway, Spain, Israel and Brussels. First day was showcasing the citizen science initiatives in Estonia, following best practice examples from EU BON consortium. During the second day the participants got a chance to learn the tools and methods for citizen science data management by ECSA and EU BON. This was followed by world cafe style discussion about the needs of citizen science initiatives and Pan-European citizen science gateway. One of the important conclusions for Baltic countries is that there is a need for stronger collaboration and supportive infrastructure to make citizen science more effective and also deliver accessible data to research community.

Some workshop participants also took part of Tartu Mini-BioBlitz on 29th June, first BioBlitz in Estonia. BioBlitz participants observed 239 species of animals, plants and fungi .

Article Alert: Measuring Rao's Q diversity index from remote sensing: An open source solution

Key in ensuring the effectiveness of conservation efforts and maintaining ecosystem health, measuring biodiversity can benefit greatly when remote sensing data comes into the equation. A new EU BON related paper, published in the journal Ecological Indicators, proposes open source solutions for measuring the important Rao's Q index, when it comes to remote sensing data.

Abstract: 

Measuring biodiversity is a key issue in ecology to guarantee effective indicators of ecosystem health at different spatial and time scales. However, estimating biodiversity from field observations might present difficulties related to costs and time needed. Moreover, a continuous data update for biodiversity monitoring purposes might be prohibitive. From this point of view, remote sensing represents a powerful tool since it allows to cover wide areas in a relatively low amount of time. One of the most common indicators of biodiversity is Shannon's entropy H′, which is strictly related to environmental heterogeneity, and thus to species diversity. However, Shannon's entropy might show drawbacks once applied to remote sensing data, since it considers relative abundances but it does not explicitly account for distances among pixels’ numerical values. In this paper we propose the use of Rao's Q applied to remotely sensed data, providing a straightforward R-package function to calculate it in 2D systems. We will introduce the theoretical rationale behind Rao's index and then provide applied examples based on the proposed R function.

Latest in our RIO Collection: Guidelines for scholarly publishing of biodiversity data from Pensoft and EU BON

While development and implementation of data publishing and sharing practices and tools have long been among the core activities of the academic publisher Pensoft, it is well-understood that as part of scholarly publishing, open data practices are also currently in transition, and hence, require a lot of collaborative and consistent efforts to establish.

Based on Pensoft's experience, and elaborated and updated during the Framework Program 7 EU BON project, a new paper published in the EU BON dedicated collection in the open science journal Research Ideas and Outcomes (RIO), outlines policies and guidelines for scholarly publishing of biodiversity and biodiversity-related data. Newly accumulated knowledge from large-scale international efforts, such as FORCE11 (Future of Research Communication and e-Scholarship), CODATA (The Committee on Data for Science and Technology), RDA (Research Data Alliance) and others, is also included in the Guidelines.

The present paper discusses some general concepts, including a definition of datasets, incentives to publish data and licences for data publishing. Furthermore, it defines and compares several routes for data publishing, namely: providing supplementary files to research articles; uploading them on specialised open data repositories, where they are linked to the research article; publishing standalone data papers; or making use of integrated narrative and data publishing through online import/download of data into/from manuscripts, such as the workflow provided by the Biodiversity Data Journal. Among the guidelines, there are also comprehensive instructions on preparation and peer review of data intended for publication.

Although currently available for journals using the developed by Pensoft journal publishing platform ARPHA, these strategies and guidelines could be of use for anyone interested in biodiversity data publishing.

Apart from paving the way for a whole new approach in data publishing, the present paper is also a fine example of science done in the open, having been published along with its two pre-submission public peer reviews. The reviews by Drs. Robert Mesibov and Florian Wetzel are both citable via their own Digital Object Identifiers (DOIs).

Symposium: Remote Sensing for Conservation - ZSL 2014

The ZSL symposium on Remote Sensing for Conservation will take place on the 22nd and 23rd of May 2014 at ZSL in London.  This symposium will highlight integrative approaches for an improved ecological understanding of the mechanisms shaping current changes in biodiversity patterns, while triggering new research directions in remote sensing science and the development of new remote sensing products.

Adaptation Strategies to Global Environmental Change in the Mediterranean City (Athens, Greece)

The international Conference will explore the potential of earth observations and thrust climate information transfer from the science to the stakeholder application realm, in order to develop suitable adaptation measures at national and regional levels. It will identify best adaptation programs and approaches to global environmental change in Mediterranean-climate cities. It will enhance and strengthen European and international cooperation in the context of the activities within the Group on Earth Observations (GEO), and promote tools and options for adaptation strategies. The Conference will help local and regional authorities and stakeholders to gain insight on the role of EO-based services in adapting to climate chance impacts in urban hot- spot areas. 8th GEO European Projects Workshop (GEPW-8), Athens, Greece

The European Commission announces the 8th GEO European Projects Workshop (GEPW-8) which will take place in Athens, Greece, on 12 and 13 June, hosted by the Greek GEO Office - National Observatory of Athens and co-organized by the Mariolopoulos-Kanaginis Foundation for the Environmental Sciences.

The eighth of the annual series of GEO European Projects Workshops is intended to bring all those interested in and actively contributing to the Global Earth Observations System of Systems (GEOSS) from all over Europe together, in order to present their work and discuss how Europe can contribute to this international effort, especially in the wake of the launch of the new EU Framework Programme for Research, Horizon 2020, and renewal of the mandate of GEO for another 10 years through the endorsement of the 2014 Geneva Declaration.

Citizens’ Observatories: Empowering European Society - Open Conference

The European Commission Directorate-General for Research & Innovation and the European Union-funded Citizens’ Observatories projects invite you to the conference "Citizens’ Observatories: Empowering European Society", to be held on 4th December 2014 at the Management Centre Europe, Brussels.
 
This one day conference will look at the role and opportunities for active citizen participation in environmental monitoring and policy making. The event will provide opportunities to engage with experts and practitioners working across a range of European citizen science initiatives and policy making bodies, and to find out more about the work of the five Citizens’ Observatory projects.
 
The event includes two main sessions for stimulating the discussion:
  • "Citizens Observatories and their value for decision making" - talks from the Commission, from EEA, from EPAs, from local authorities and also representatives from citizens, with their own views and experiences, followed by a round table with the speakers where we can discuss about the usefulness of Citizen Science in environmental policy (suitable scenarios for first implementations, possible ways of collaboration and channels of communication, fears and expectations of policy makers and also of citizens, benefits, market exploitation, etc). Seed questions will be fine-tuned in the upcoming weeks.
  • "Panel session on Challenges of Citizens’ Observatories" -  a second round table focused on challenges these initiatives are facing (sustainability, governance, data protection, big data, legitimacy of actions by scientists, etc.) both with researchers and decision makers.

What can Remote Sensing do for the Conservation of Wetlands?

The International Symposium "What can Remote Sensing do for the Conservation of Wetlands?" will take place on 23 October 2015 in parallel with the XVI Congreso de la Asociación Española de Teledetección (XVI Meeting of the Spanish Remote Sensing Association) in Seville, Spain.

The Symposium aims to become an interdisciplinary meeting for wetland managers and scientists interested in remote sensing as well as remote sensing experts doing research in wetlands.

Wetlands are fragile and dynamic ecosystems sensitive to changes in climate and land-use, and rich in biodiversity. For centuries they were considered to have little or no value, and most have been drained or transformed. In 1971 the first international convention for the protection of Wetlands, the Ramsar Convention, was signed to promote their conservation and sustainable use. Now it is recognized that wetlands provide fundamental ecosystem services, such as water regulation, filtering and purification, as well as scientific, cultural, and recreational values. Wetlands constitute an extensive array of ecosystems ranging from lakes and rivers to marshes and tidal flats. An increasing number of wetlands have some kind of legal protection, and many wetlands are monitored and actively managed.

Biodiversity research for and by citizens in Eastern Europe: tools, information services and public engagement

Citizens in democratic society are no longer just passive bystanders when science is in focus. They show interest in results, ask for consultation and contribute with data. For many fields of research citizen science data are valuable additional information.
 
The FP7 project Building the European Biodiversity Observation Network - EU BON (http://eubon.eu/) now organizes a dedicated Citizen Science Workshop to explore the opportunities and tools for citizens in Eastern Europe to engage in biodiversity research. The workshop will take place on 27-28 June 2016 at the University of Tartu Natural History Museum, Estonia.
 
Engaging citizens is a challenge both for society and for researchers. There are new tools and methods which allow to manage citizen science projects, collect data and provide feedback to citizen scientists. The workshop will present EU BON results of citizen science mobilizing efforts for biodiversity research, provide training for citizen science tools and showcase some examples of Estonian projects and European initiatives. Workshop will also make an effort to prioritize recommendations and next steps for citizen science integration into biodiversity research.

Spaniens Richter tanzen nach der Pfeife der Politiker

Wegen fragwürdiger Anklagen, Urteile und Ernennungen gerät die spanische Justiz zunehmend ins Zwielicht. Die politischen Parteien haben zu grossen Einfluss auf die Ernennung der Richter.

Dass die spanische Justiz langsam arbeitet und völlig überlastet ist, ist allseits bekannt. Dass aber die politischen Parteien Einfluss bis in die obersten Richtergremien haben, war den Bürgern lange Zeit nur wenig bewusst. Doch das änderte sich jüngst mit der Ernennung des Vorsitzenden des Generalrats der Justiz (Consejo General del Poder Judicial). Das Gremium entscheidet über die Besetzung der wichtigsten Richterposten im Land.

Kaum war bekanntgeworden, dass Manuel Marchena, ein konservativer Richter an Spaniens oberstem Gerichtshof, zum Vorsitzenden dieses Rats gekürt werden sollte, drang Jubel aus dem Senat. Ignacio Cosido, der Sprecher der konservativen Fraktion in der kleinen Parlamentskammer, liess seine 146 Amtskollegen per Whatsapp wissen, dass man mit Marchenas Ernennung Einfluss auf die Prozesse gegen korrupte Politiker in den eigenen Reihen erlangen werde, denn man könne jetzt die Strafkammer des obersten Gerichts «von hinten kontrollieren». Die Textnachricht wurde der Zeitung «El Español» zugespielt, ein Aufschrei ging durch die gesamte Medienlandschaft.
 
Kuhhandel zwischen Parteien

Auch aus den Reihen der Richter wurde Kritik laut. Ramón Trillo, ehemaliger Vorsitzender einer der Kammern des obersten Gerichtshofs, rügte, dass die Richter immer mehr am Gängelband der Politik geführt würden. Die Verflechtung zwischen Richtern und Parteien beeinträchtige das Ansehen der Justiz. In der Tat ist die Auswahl der 20 Richter des Generalrats der Justiz eine Art Kuhhandel zwischen den führenden Parteien. Wenn das rechte Lager den Präsidenten stellen darf, dann dürfen die Linken die Mehrheit, nämlich 11 der Richter, ernennen und umgekehrt. So stand es klipp und klar in der Textnachricht von Cosido.

Marchena blieb nichts anderes übrig, als seine Ernennung zum Präsidenten des Generalrats der Justiz abzulehnen. Dafür will er nun an seinem brisantesten Fall weiterarbeiten, nämlich am Prozess gegen den ehemaligen katalanischen Vizeregierungschef Oriol Junqueras und 17 weitere katalanische Separatisten. Der Prozess soll im Januar beginnen.

Junqueras, der seit über einem Jahr in Untersuchungshaft sitzt, liess bereits über seinen Anwalt mitteilen, dass er Marchena wegen Befangenheit ablehnen werde. Eine Gruppe von vier Mitangeklagten folgte diesem Schritt. Marchena sei der Protagonist eines Paktes, der darauf abziele, die spanische Justiz zu kontrollieren, hiess es zur Begründung. Die offenkundige Nähe zu einer bestimmten politischen Gruppierung lasse Zweifel an seiner Neutralität bei diesem Prozess aufkommen. Die Angeklagten stützten ihren Befangenheitsantrag unter anderem auf die Textnachricht von Cosido.
 
Umstrittener Vorwurf der Rebellion

Für die inhaftierten Katalanen sieht es nicht günstig aus. In der Anklageschrift von Pablo Llarena, ebenfalls einem konservativen Magistraten des obersten Gerichtshofs, wird der Vorwurf erhoben, die katalanischen Politiker hätten eine «Rebellion» angezettelt, um die Unabhängigkeit ihrer Region zu erreichen. Llarena wirft ihnen im Weiteren zivilen Ungehorsam und die Veruntreuung öffentlicher Mittel bei der Durchführung der illegalen Volksabstimmung für die Loslösung Kataloniens von Spanien vor. Im Ausland hat man keine «Rebellion» erkannt. Die Behörden in vier europäischen Ländern haben Auslieferungsgesuche der spanischen Justiz gegen den ehemaligen katalanischen Regierungschef Carles Puigdemont und einige seiner Getreuen deshalb abgelehnt.
 
Auch in Spanien regt sich Unmut über die Art, wie die Justiz den Katalonien-Konflikt behandelt. Vor einigen Tagen unterzeichneten 300 namhafte spanische Juristen und Verfassungsrechtler ein Manifest, in dem sie einen Prozess wegen «Rebellion» gegen die katalanischen Unabhängigkeitsbefürworter als «Irrtum» bezeichneten und die Freilassung der katalanischen Politiker verlangten. Der Untersuchungsrichter und die Staatsanwaltschaft hätten sich bei ihren Anschuldigungen auf den Artikel 472 des Strafgesetzbuchs gestützt, der die Anwendung von Gewalt mit Einsatz von Feuerwaffen oder Sprengstoff voraussetze. Dies sei aber mitnichten der Fall gewesen.
 
«In dubio pro banco»

Für grösste Empörung sorgte kürzlich auch ein umstrittenes Urteil beziehungsweise eine abrupte Kehrtwende des obersten Gerichtshofs. Ein Entscheid zu den Grundbuchgebühren bei Hypothekarverträgen fiel zuerst zugunsten der Bankkunden aus, kurz darauf wurde er ins Gegenteil korrigiert. Den Banken wurden damit Rückzahlungen an die Kunden in Höhe von mehreren Milliarden Euro erspart. «In dubio pro banco» (im Zweifel für die Bank), höhnten die Medien. «Mit diesem Urteil stehen wir da, als ob wir nach der Pfeife der Banken tanzen würden», räumte Nicolás Maurandi ein, einer der 28 Richter am obersten Gerichtshof.
 
Blamiert hat sich Spaniens Rechtsprechung auch im Ausland. So urteilte der Europäische Gerichtshof für Menschenrechte in Strassburg im November, dass der baskische Politiker Arnaldo Otegi, der einst als Anwalt für Mitglieder der baskischen Terrororganisation ETA arbeitete, keinen fairen Prozess erhalten habe. Die spanische Justiz muss nun ein gegen ihn verhängtes Berufsverbot überprüfen. Spanien ist allerdings nicht das einzige Land, dessen Urteile von europäischen Gerichten kassiert werden.

Das gleiche Gericht verhängte eine Geldbusse von 14 400 Euro gegen Spanien, weil spanische Richter zwei jugendliche Katalanen zu einer Gefängnisstrafe verurteilt hatten; die beiden hatten bei einer Demonstration ein Bild des früheren Königs Juan Carlos verbrannt. Die belgischen Behörden wiederum nahmen einen mallorquinischen Rapper namens Josep Miquel Arenas in Schutz, weil er wegen Majestätsbeleidigung sowie der «Verherrlichung» von ETA-Verbrechen für drei Jahre hinter Gitter gehen sollte. Der unter dem Künstlernamen Valtonyc bekannte 25-Jährige kann weiterhin nicht nach Spanien reisen, ohne festgenommen zu werden.
 
Unabhängigkeit nicht gewährleistet

Die Staatengruppe gegen Korruption (Greco), eine Unterorganisation des Europarats, monierte in ihrem letzten Bericht die undurchsichtigen politischen Geschäfte bei der Ernennung von Richtern. Sie empfahl, mindestens die Hälfte der Richter sollte von den Kollegen ernannt werden und nicht vom Parlament oder vom Senat. Die unselige Praxis reiche bis in die Provinzen Spaniens und müsse dringend korrigiert werden.

Die Greco vermisst auch objektive Kriterien bei der Kandidatenauswahl. Die zwölf Mitglieder des spanischen Verfassungsgerichts müssen nicht einmal Richter sein, es genügt, dass sie eine juristische Laufbahn eingeschlagen haben. Vier der Mitglieder des Verfassungsgerichts, das sich mit den heikelsten gesellschaftlichen Themen befasst, werden vom Parlament ernannt, vier vom Senat, zwei von der Regierung und nur zwei vom obersten Richtergremium. Es verwundert nicht, dass Spanien bei den jährlichen Umfragen über die Unabhängigkeit der Justiz immer einen der hintersten Ränge belegt.
