Civil Rights Division (CRT)
Complaint Adjudication Office
Washington, District of Columbia
Announcement #: 20-ATT-DAT-003
Application Deadline: May 28, 2020

Attorneys with the Complaint Adjudication Office are primarily responsible for writing drafts of Department of Justice Final Decisions in EEO administrative cases. The administrative EEO process begins when a DOJ employee or applicant for employment files an employment discrimination complaint with a DOJ component. The EEO complaint is investigated by the component and, sometimes, depending on the filer's election, the matter is referred to an EEOC Administrative Judge for a hearing. After the investigation (sometimes followed by a hearing) has been completed, the case is sent to the Complaint Adjudication Office for issuance of a Department of Justice decision.

The Office receives a significant number of cases for adjudication every year. Attorneys in the office are expected to thoroughly review the case records, identify the facts germane to the accepted issues, apply the relevant law, and write a clear, smooth draft that is even-handed, addresses the issues fully, and reaches a persuasive conclusion that is grounded in the evidentiary record. Attorneys who perform well are typically those who have a strong ability to organize a large volume of record materials, excellent legal writing skills, an ability to work quickly and consistently when assigned multiple cases, some familiarity with employment discrimination theories including disparate treatment, disparate impact and reasonable accommodation, and, just as importantly, a commitment to consistently write fair, impartial decisions that fully address an employee's discrimination concerns.

True fir spacing trials: 10-year results

Eighteen precommercial thinning trials were established in true fir-hemlock stands in the Olympic Mountains and the west side of the Cascade Range during the period 1987 through 1994. This paper updates a previous report, with results for the first 10 years after establishment. Results are given for (1) all trees, (2) the largest 80 per acre of any species, and (3) those noble fir (Abies procera Rehd.) and Pacific silver fir (Abies amabilis Dougl. ex Forbes) included in the largest 80 per acre. Diameter growth of all species increased with increase in spacing. Height growth of Pacific silver fir decreased with increase in spacing. The largest 80 trees per acre of all species showed some increase in diameter and basal area growth with increased spacing, while height growth declined slightly and volume growth was nearly constant. Over time, these installations will provide a unique source of information on early development of managed stands of these species, for which little information is now available.

True fir spacing and yield trials-a 20-year update

This report updates data and comparisons from previous reports (Curtis and others 2000, Curtis 2008) on a series of precommercial thinning and yield trials in high-elevation true fir–hemlock stands, using data from the 12 replicates for which 20-year data are now available. The stands were varying mixtures of Pacific silver fir (Abies amabilis (Douglas ex Loudon) Douglas ex Forbes), western hemlock (Tsuga heterophylla (Raf.) Sarg.), and noble fir (Abies procera Rehder). Trends noted in the 2008 report continue. Increment in top height was somewhat reduced at wide spacings. Volume increment and basal area increment increased as the residual number of trees increased. There was a small increase in diameter increment of the 80 largest trees per acre at wide spacing. Relative stand densities on the unthinned plots, as measured by stand density index (SDI) and relative density (RD), are still increasing; it appears that the maximum (not yet attained) is probably at least 20 to 25 percent greater than values observed in Douglas-fir.

Terrestrial species viability assessments for national forests in northeastern Washington.

We developed a process to address terrestrial wildlife species for which management for ecosystem diversity may be inadequate for providing ecological conditions capable of sustaining viable populations. The process includes (1) identifying species of conservation concern, (2) describing source habitats, and other important ecological factors, (3) organizing species into groups, (4) selecting surrogate species for each group, (5) developing surrogate species assessment models; (6) applying surrogate species assessment models to evaluate current and historical conditions, (7) developing conservation considerations, and (8) designing monitoring and adaptive management. Following the application of our species screening criteria, we identified 209 of 700 species as species of concern on National Forest System lands east of the Cascade Range in Washington state. We aggregated the 209 species of conservation concern into 10 families and 28 groups based primarily on their habitat associations (these are not phylogenetic families). We selected 32 primary surrogate species (78 percent birds, 17 percent mammals, 5 percent amphibians) for application in northeastern Washington, based on risk factors and ecological characteristics. Our assessment documented reductions in habitat capability across the assessment area compared to historical conditions. We combined management considerations for individual species with other surrogate species to address multiple species. This information may be used to inform land management planning efforts currently underway on the Okanogan-Wenatchee and Colville National Forests in northeastern Washington.

Task force will make recommendations on how to resume jury trials, given coronavirus concerns

DES MOINES — The Iowa Supreme Court has asked a group of criminal and civil lawyers, judges and court staff from judicial districts across the state to make recommendations on how criminal and civil jury trials will resume with coronavirus health restrictions.

The court is asking the 17-member Jumpstart Jury Trials Task Force to develop temporary policies and procedures for jury trials that will ensure the “fundamental rights of a defendant” to a jury trial, while at the same time “protecting the health and safety” of the jurors, attorneys, judges and the public, said Des Moines lawyer Guy Cook, co-chairman of the task force.

The court, Cook said Thursday, has put together a “good cross-section” of professionals who have experience with civil and criminal trials.

Task force members are:

• Associate Supreme Court Justice Mark McDermott, chairman

• Guy Cook, Des Moines criminal and civil attorney, co-chairman

• 4th Judicial District Judge Michael Hooper

• 5th Judicial District Judge David Porter

• Angela Campbell, Des Moines criminal defense attorney

• Jim Craig, Cedar Rapids civil attorney, president of Iowa Defense Counsel Association

• Janietta Criswell, clerk and jury manager, 8th Judicial District, Ottumwa

• Kathy Gaylord, district court administrator, 7th Judicial District, Davenport

• Patrick Jennings, Woodbury county attorney, Sioux City

• Julie Kneip, clerk of court, 2nd Judicial District, Fort Dodge

• Bill Miller, Des Moines civil attorney, chairman of Iowa State Bar Association litigation

• Todd Nuccio, Iowa state court administrator

• Jerry Schnurr, Fort Dodge civil attorney and president-elect of Iowa State Bar Association

• Jennifer Solberg, Woodbury County chief public defender

• Chad Swanson, Waterloo civil attorney, president of Iowa Association of Justice

• Brian Williams, Black Hawk county attorney

• Mark Headlee, information technology director of Iowa Judicial Branch

The committee will review the current schedule to resume jury trials that the court has established in consultation with public health officials and other health care providers, and recommend whether the schedule should be altered, according to the court’s order.

Jury criminal trials can resume July 13 and civil trials Aug. 3, according to the order.

The task force also will make recommendations for how those trials should proceed, according to the court’s order.

Members should develop policies and procedures aimed at protecting the health and safety of jurors, court staff, attorneys, judges and visitors throughout the trial process, particularly during the identification of potential jurors, summons of potential jurors, jury selection, trials, jury instructions and jury deliberations.

Cook said members will have to consider the challenges for each type of trial. More jurors, for example, are needed in a criminal case, so space and logistics will have to be considered with social distancing requirements.

That will be more difficult in the rural courthouses that have less space.

A pool of 80 to 100 potential jurors are sometimes summoned for felony trials in larger counties, but that, too, may be a challenge with social distancing.

Another possibility would be requiring masks, but how will a mask affect the credibility of a witness if it hides the person’s facial expressions, Cook said.

These are all issues the members may encounter.

Steve Davis, Iowa Judicial Branch spokesman, said the goal is one uniform statewide plan, but it’s possible that each district may have some discretion, as in the previous orders issued during this pandemic, because of the differences in each county.

Davis said the task force members were chosen based on gender, background and geographic area.

The recommendations should be submitted to the court the first week in June.

Davis said he didn’t yet know when the task force would start meeting by phone or video conference or how often.
