My OII colleague Tobias Escher reports on a German decision on website operator liability for user-posted content. A professor unhappy with his reviews on Meinprof.de, such as comments calling him a "psychopath," sued. The site had removed the comments on his complaint, but he nonetheless demanded that the site pay a fine and be enjoined from allowing similar comments to be re-posted. The appeals court sensibly rejected that injunction. According to Tobias:

The court has decided that a general “cease and desist” for unacceptable comments is against the law. As a professor one has to face public criticism that cannot be prohibited ex ante.
...
In general this is a positive outcome for web sites that leverage the wisdom of the crowds as it offers some protection for the often not-for-profit operators of these sites. However, this does not justify defamatory comments on those sites and the court has emphasized the operators’ duty to remove those entries as soon as they are recognized. Last but not least, the subject under public scrutiny does matters as professors might well be made to face personal criticism in their role as public figures while teachers and nurses might have to be treated differently.

German law lacks a CDA Section 230, which immunizes U.S. service providers from defamation liability for user-contributed comments. So RateMyTeachers.com can ignore claims of defamation, leaving U.S. teachers to fight back with words, leaving their own comments or questioning the reliability of the site.

German sites, by contrast, can be held liable for their users' false assertions. If such liability were automatic, triggered immediately upon the posting of a defamatory comment, sites that permitted users to post content might as well paint lawsuit targets on their homepages: anyone could claim to have been defamed there; anyone unhappy with postings could get a heckler's veto against not just individual posts but the site itself. Sensibly, then, the MeinProf.de court limits the potentially unbounded liability in a manner similar to the U.S. caution against prior restraints of speech. The site can't be held liable until it has been given an opportunity to defend or remove the post; those who want to make libel claims against hosts should start by giving the host notice.

My U.S.-centric view is still that posters and their subjects should battle over online defamation between themselves, leaving their online hosts out of the picture. As we all depend on intermediaries to speak online, our speech gets less free with each new burden and risk-sensitivity we put on the intermediaries. Those who feel victimized have access to the same speech technologies to respond -- putting them on a more level playing field than arises when one calls in the law and an intermediary is chilled. In the German context and legal tradition, however, this decision seems to get close.

Admin – I'm working with the mods to make adjustments to the Guidelines and Content Policy based on the feedback from this thread. Our aim is to have clearer policies that allow us to step in and avoid derails and comments aimed at enraging other members and where we can set clear expectations with the members who get moderated. Fundraising – So far, we have raised $5,281.00 in one time contributions (17% of our original goal) and $200.00 in new Subscriptions (8% of our goal). We still have a lot of money in the bank, so while this is not where we wanted to be, there is no imminent emergency. On one hand I'm deeply grateful for the contributions received so far and we'll make the best of it but on the other I know the frustration this generates. We were hoping to have the new entity in place before the fundraising started this year. Since last year's run, we knew we would not be able to spin a full fledged campaign while rebuilding the site; moderation has been busier than usual in the past few months. That being said, we decided to move ahead with the fundraising and do our best. I'm still running to continue with the activities we had planned and we'll keep going with the fundraising activities until we're ready to give access to the new site for testing (more details on that below). Then, we'll put copies of the Pet Tax wall and Cookbook for sale and proceed with the Podcast. Tech – Early access to the new site has been delayed in order to include more complete features and actions that users can test and kirkaracha and I are expecting to make it available by Sunday, September 29. – Added affiliate links to bookshop.org – Fixed multiple errors connecting to external APIs – Server fixes keeping maintenance tasks running without breaking BIPOC Advisory Board – Thyme and I will resume our work with the BIPOC Board this month. So far we're planning on expanding guidelines specific to each subsite and we'll share a draft of these changes on a separate Meta post once it is ready. These contributions are a huge lift and we'll work with the Community Foundation to put that extra revenue to good use. We'll wrap the fundraising by the end of this month with the release of the new site's MVP, the MeFi Cookbook, the Pet Tax wall, the AMA Podcast and a special Halloween Virtual Gala. I've done my best to collect and catalogue all of the storyboards from the production of 1983's Richard Marquand hit Return of the Jedi, driven by wanting to see what unfinished or cut scenes could be revealed.

You can read the entire screenplay, including deleted scenes while looking at the storyboards with a little commentary, or you can see all the storyboards in galleries. I've included some pages with behind the scenes photos and an explanation of my methods as well. If it's deleted scenes you're after, the bulk of those are found the Space Battle and the Rebel Attack sequences. Return of the Jedi ran into some time-and-budget-crunch problems in the last year of production, as well as technical issues, which resulted in some cuts being made to those sequences. Figuring out just what was cut and why was my original motive for the project, and although I'm still missing a lot of the storyboards from those cut sequences, there's enough to get the gist. Oh, and if you are, for some reason, in possession of copies of any of the missing storyboards, please get in touch!
