sexual What China’s sexual revolution means for women By webfeeds.brookings.edu Published On :: Thu, 09 Apr 2015 15:30:00 -0400 Two decades ago, Hillary Clinton delivered a speech in Beijing that inspired feminists around the world, declaring “women’s rights are human rights.” Since that declaration, a lot has changed for women globally. But what has changed for women in China? While Chinese women today have increased freedoms, there is still a long way to go before gender equality is realized. Civil unrest concerning gender inequality recently made headlines in China and abroad when a group of five female protesters in China were arrested and jailed for publicly demonstrating against gender inequities, such as inequality in higher education and domestic violence. This incident underlined much of the commentary at a recent Brookings’s John L. Thornton China Center forum on women’s issues and gender inequality in China, during which the following key messages were conveyed: China is in the midst of a rapid, if quiet, sexual revolution China’s first and leading sexologist, Li Yinhe, delivered a keynote address that emphasized that when it comes to sex, China is in the midst of an “era of important changes.” Li explained that all sexual activities before marriage were illegal in China before 1997 because of a “hooliganism law,” and a woman could be arrested for having sex with more than one man. Thus, premarital sex was forbidden. In surveys in 1989, only 15% of citizens reported having premarital sex—and “most of them were having sex with their permanent partners,” Li said. That law was overturned in 1997, and recent surveys show that 71% of Chinese citizens admit to having sex before marriage. This is a dramatic change in a short period of time, and marks what Li asserts is a sexual revolution for Chinese citizens. Chinese law still lags behind changes in social customs While some sex laws have adapted, others are far behind. Li highlighted some “outdated” sex laws in China that are still “on the book[s],” but that are no longer strictly obeyed by the Chinese people. Li said the indicators are clear that the force of these laws is waning. There are fewer people being punished for these offenses and the punishments are becoming increasingly less severe. Her discussion stressed four areas where public opinion has changed drastically over the last few decades, but Chinese laws haven’t adapted: Pornography: Pornography isn’t considered to be protected as it is in the U.S. In contrast, Chinese law strictly prohibits creating and selling porn. In the 1980s, porn publishers would be sentenced to death. Now the punishment is less severe—for example, a 24-year-old Beijing woman published seven “sex novels” online. Her viewership was 80,000 hits on her novels, but her punishment was only six months in criminal detention. Prostitution: Prostitution is another activity affected by outdated laws in China, where any solicitation of sex is strictly illegal. In the early-1980s through late-1990s the punishment for facilitating prostitution was severe. In 1996, a bathhouse owner was sentenced to death for organizing prostitution. Now, prostitution is widely practiced and the most severe punishment for organized prostitution is that those managing sex workers are ordered to shut down their businesses. Orgies and sex parties: Chinese law used to brutally punish swingers and individuals who planned sex parties. For example, in the early-1980s “the punishment for spousal swapping was death…[and] people would be sentenced to death for organizing sex parties,” Li explained. But this is another area where the punishment for the law has now become less strict. In 2011 in Nanjing, an associate university professor organized a sex party with 72 people, and the “punishment for him was three and a half years in prison.” Also, in 2014 in Shanghai, some citizens recently organized an online sex party, and their punishment was only three months of criminal detention. According to recent private surveys, “many people are [engaging] in sex parties or orgies.” While in theory these are punishable by criminal law, “no one reports [them], so they do not get noticed,” Li said. Homosexuality and same-sex marriage: In regards to homosexuality, Li was quick to note that China’s view of homosexuality is historically very different from Western views. For example, in some U.S. states, laws “criminalized or deemed homosexual activities illegal.” But throughout China’s history, there were not severe repercussions or the death penalty for homosexuality, and it “was never illegal.” However, this is not the case for same-sex marriage. Li thinks it will be “hard to predict” when same-sex marriage might be legalized. Chinese women will have sexual freedom, but when isn’t clear So what does the future hold for these laws? Li explained that sex is a “hot topic” right now in Chinese public debate, and the “general consensus among legal scholars and sociologists is that these [outdated] laws need to be removed.” Those who oppose removing these laws are “in the minority.” While that may be true, she suggested it would be difficult to “form a timetable” when politicians might consider amending these laws. As for the five young women sentenced to jail last month, Li said she usually tries to stay out of politics, but thinks people “should stand up and speak out” when their own rights are being violated. Li argued that jailing these women for expressing their opinions violated the rights of all women—and hopes that other women speak up about their arrest. It is a crime in its truest form that puts a woman’s safety and security in question. Sexual harassment is not only difficult to experience, but also an adverse event that is difficult to eliminate. We have heard stories related to sexual harassment in workplaces several times and about female employees getting wrong hints from their male colleagues (managers at times), dirty looks, unwanted dinner invitations, being touched inappropriately or hearing lewd comments. Sexual harassment should be dealt smartly and tactfully. We have listed six such measures to tackle sexual harassment in a workplace:1. Get in touch with the HR team: Almost every organization has a dedicated Human Resource cell that looks after anti-harassment policies. A woman who falls prey to sexual harassment should immediately get in touch with the anti-harassment team of the HR division for immediate action against the accused and his untoward behavior. Also, the HR team possess good knowledge of anti-harassment policies, which they should implement without any delay.2. Document the situation: Do not endure sexual harassment and report it immediately. Find out if there are other victims also, gather witnesses and secure the statement of witnesses in written. Also, find out if there are any video recording or CCTV footage of the event. Put all documents and video recordings in front of the HR or top management while complaining.3. Inform the supervisor: Whoever is harassing you, be it your team member or somebody from other teams, inform your immediate supervisor about the entire incident. Write an official email citing the incident and request the supervisor for a personal meet. A supervisor has the right to know about what is going on with the team members. 4. Draw a line: It is good to engage in jokes and informal talks with colleagues, but do not forget to draw a line and maintain a gap between you and the male colleagues. Be direct and straightforward and speak up when you are not liking their attitude or behaviour towards you. Ask them to stop their 'over-funny' acts and not to cross limits. This will help you tackle sexual harassment in the initial stage right after you get wrong vibes.5. Talk to the harasser: Do not stay away from the accused and speak with him directly. If he does not apologize and discontinue doing so, let him know that you are going to file an official complaint for being sexually harassed at workplace. If he still continues to harass, take strict and immediate action. Women have the right to go for legal actions too. 6. Get in touch with senior management: If everything fails and your supervisor cannot take any action against the event, get in touch with the senior management of the organization. Put forth all evidences including video footages and written statements and let the senior management know about it. Ensure that the management handle the situation tactfully and take strict steps against the accused.Many women who are victims of sexual harassment tend to stay quite because of threats or the fear of losing their jobs. However, this is not the solution to prevent sexual harassment. Women must raise their voice if they are molested or sexually abused in their workplaces. Only if their voices are raised, they will get the strength to fight against such ill acts. Based on a discussion with Minister for Women and Child Development Maneka Gandhi, the DoPT (Department of Personnel & Training) issued fresh guidelines regarding 'sexual harassment of women at workplace' in December 2016. Following are the guidelines the DoPT issued: 1. Brief details of the implementation of the Sexual Harassment of Women at Workplace Act including the number of cases received and disposed shall form a part of the Annual Report of all ministries/ departments and authorities there under.2. The enquiry of cases must be completed within 30 days and under any circumstances within 90 days from the date of the complaint.3. The ministries/ departments etc. have to keep a watch on the complainant so as to ensure that she is not victimized in any manner because of her having filed the complaint. The aggrieved woman has been given further option to send representation to the Secretary or head of the organization in case she feels that she is being victimized because of her complaint. The concerned authority will be required to dispose of this complaint within 15 days.4. "I don't think it will come as a surprise for anyone to say that my world completely changed in the fall of 2017. My job, many of my relationships, my standing in my own industry were all gone in just a matter of hours," Spacey said during a podcast. He was dropped from the "House Of Cards" show after allegations surfaced. He has mostly kept a low profile since the slew of sexual assault claims first came up. He has always denied the claims. He was also removed from the completed movie "All The Money in the World", which was reshot with actor Christopher Plummer. Spacey was asked during the podcast to reflect on the current coronavirus pandemic causing global and widespread devastation. The actor, who has not appeared in a professional movie or series since the accusations were made, said: "I don't often like to tell people that I can relate to their situation because I think it undermines the experience that they may be having which is their own unique and very personal experience." Spacey added: "But in this instance I feel as though I can relate to what it feels like to have your world suddenly stop. sexual Lihaaf is about alternate sexuality, says Rahat Kazmi By www.mid-day.com Published On :: 27 May 2018 01:57:46 GMT Kashmiri filmmaker Rahat Kazmi is best known for his film Mantostaan When Rahat Kazmi first shared the idea of making a film on Lihaaf with Tannishtha Chatterjee and Sonal Sehgal, they asked him if he would really dare to do such a thing. After all, Lihaaf has been fodder for controversy ever since Ismat Chughtai wrote it. It has been an uphill road for this Kashmiri filmmaker, who is best known for his film Mantostaan, that was based on four short stories by Saadat Hassan Manto. Kazmi's Lihaaf, that recently unveiled its first look at the Cannes Film Festival, has the world's attention now, especially, since Marc Baschet, Academy Award-winning producer came on board. Things are looking much more grand than Kazmi had imagined a year ago. "I read Lihaaf for the first time as a teenager. I have always been drawn towards Urdu literature, having grown up in Kashmir. Stories of Chughtai and Manto are always fascinating. When you read them at a young age, they seem obscene, but as you grow older, you know better. My friends and I experienced something similar too. And I would keep going back to Lihaaf," says the 36-year-old. Having read it in English, Kazmi hunted down the Urdu version too, which was not easy given the controversy surrounding it. After it was published in 1942 in Urdu literary journal Adab-i-Latif, Chughtai had to defend herself in Lahore Court having being charged with obscenity. Kazmi's film, in fact, starts at the point where the police comes to Chughtai's house in [then] Bombay to summon her. A still from the film "The film has two parallel tracks — that of Lihaaf, the story, and that of the trial which is the outcome of the story. It's interesting that the story itself is a true account. Ismat's family confirmed to me that she indeed knew a begum on whom the story was based. And later, a grown up Ismat met her when she had remarried, and had children too," Kazmi says. It was not easy for him to convince Chughtai's family to grant him permission to make the film. "It's difficult for them to trust anyone. I met her daughter Sabrina and her grandson, Ashish Sawhny. When they got to know about Mantostaan, and the recognition it got internationally, they saw in me someone they could trust," he says. In the film, Chatterjee plays Chughtai while Sehgal, Begum Jaan. Interestlingly, Baschet wanted to associate with the film after he saw the first cut. Until then, it was an independent production shot in three months. Lihaaf, Kazmi stresses, is not as much about homosexuality as it is about alternate sexuality. "This is a common misconception. Begum Jaan falls for her masseuse Rabbo only after she fails to find love in her husband. It's more about love and the need for physical affection." The visuals are a mix of risqué and suggestive. "The best thing about Chughtai and Manto is that they don't judge their characters. I have tried to do the same," he says. Now, as the film prepares for a world premiere — the choice is between Toronto and Venice — we ask Kazmi if he's concerned about reactions on home ground. "For me, it was cathartic to make it. As far as controversies are concerned, let's cross that bridge when we come to it," he says.
