DNREC, DDA prepare to respond to Delaware Supreme Court’s Dec. 7 decision allowing firearms in state parks and forests

DOVER – The Delaware Supreme Court, by decision dated Dec. 7, 2017 in the matter of Bridgeville Rifle & Pistol Club, LTD, overturned a Superior Court ruling and ended a ban on visitors’ possessing firearms in Delaware’s state parks and state forests. Pursuant to the ruling, visitors may now possess firearms unless they are prohibited by law due to a past conviction for a violent crime, active Protection from Abuse Order, or mental health commitment. Following the Court’s decision to invalidate the existing regulations limiting firearms in state parks and forests, and some Division of Fish & Wildlife properties, the Delaware Department of Natural Resources and Environmental Control and the Delaware Department of Agriculture (DDA) anticipate issuing interim firearm regulations. The interim regulations would respect the State Constitutional provisions on firearms cited by the Court, by implementing the State’s interest in ensuring the safety of the public in a less restrictive manner.

DPH Issues Reminder of Open Testing Dates for TB; Announces Call Center to Close Friday, June 1, 2018

The Division of Public Health is continuing its efforts to encourage former residents and employees of the ManorCare Health Services Foulk Road facility in Wilmington, between January and September 2017, to be tested for tuberculosis (TB). DPH opened a call center on Tuesday, May 29, 2018, to follow up with individuals who had been sent a letter and answer any questions, as well as to field questions from the public. As the number of incoming calls has decreased significantly since the opening, DPH is announcing that the call center will cease operations at 4:00 p.m., Friday, June 1, 2018.

DPH Announces First Flu Deaths of the 2018-2019 Season; Officials Remind Delawareans to Get Vaccinated

The Division of Public Health (DPH) is reporting the first flu-related deaths of the 2018-2019 flu season. A 65-year-old man who was infected with Influenza A passed away last week, making him the first person to die due to flu complications this season. In addition, a 73-year-old man and a 77-year-old woman, both also infected with Influenza A, passed away within the last week. All three individuals were Sussex County residents and all had underlying health conditions.

DNREC initiates new permit program for removal of lead coatings from water tanks

DNREC announced the creation of a new permit program that establishes regulatory conditions for the sandblasting of outdoor water tanks to remove lead-based paint. Contractors often use sandblasting to remove paint from water tanks in preparation for repainting them. Effective immediately, all water tank sandblasting projects involving removal of lead paint are required to have an air quality permit from DNREC that will ensure sufficient containment measures are taken to prevent the release of lead paint chips into the environment.
