(Supreme Court of California) - Held that a city's practice of annually transferring funds from a city-operated electric utility to the city's general fund did not run afoul of the California Constitution, which prohibits local governments from imposing any tax without voter approval. A citizen association brought this suit arguing that the city was, in effect, using utility rates to impose a tax without voter approval. Rejecting this contention, the California Supreme Court reversed the court of appeal.

(Court of Appeals of New York) - In a civil action, arising from an auto accident allegedly caused by defendant school district's sign distracting and obstructing passing drivers on a roadway, the trial court's conclusion that plaintiff should not be permitted to serve late notice of a claim is reversed where the trial court abused its discretion in determining that defendant would be substantially prejudiced without any record evidence to support that determination.

(California Court of Appeal) - In a case involving helmets worn by professional football players the manufacturers of the helmets were being sued by multiple parties, so the manufacturer sued their insurers for indemnity. The insurers wanted to continue in extended discovery and demanded logs of documents withheld during prior discovery, but the court held that a stay of discover is appropriate, while the manufacturer must also provide privilege logs, reversing the trial court's decision as to the stay and affirming its order as to the privilege logs.

UPMC-Braddock Hosp. v. Sebelius

(United States Third Circuit) - District court's grant of summary judgment in favor of the Secretary of the United States Department of Health and Human Services, denying a reimbursement claim for loss on depreciable assets resulting from a merger between two non-profit medical corporations is vacated and remanded where: 1) the Secretary's interpretation of the related party regulations, requiring examination of whether the parties were related pre- and post-merger, is contrary to the plain language of the regulations, and under the proper, pre-merger test, the parties were not related at the time of the transaction; and 2) the district court's determination that the merger was not a bona fide sale was not based on substantial evidence, in light of errors made in determining the value of certain assets.
