sto Apple Faces Epic Games-Style China Lawsuit Over App Store Practices By www.macrumors.com Published On :: Tue, 12 Nov 2024 02:12:53 PST A Chinese court has agreed to hear a lawsuit against Apple from Beijing Bodyreader, a developer seeking around $420,000 in damages after their children's posture correction app was removed from the App Store in 2020. Bloomberg reports that the case – the first of its kind to be heard in Beijing's intellectual property court – bears similarities to Epic Games' 2021 lawsuit against Apple. Bodyreader claims Apple unfairly removed their app citing "dishonest" behavior, while also challenging the company's 30% commission on app purchases and its control over the iOS ecosystem. According to court documents reviewed by Bloomberg, Bodyreader argues that Apple's enforcement of App Store policies is inconsistent. The developer notes that after their original app was removed, they successfully published an identical app under a different name, "Qilin Century," which remains available on the App Store. Closed-door hearings began Thursday and could conclude this week. The hearing represents the first time Apple has been forced to defend its standard mobile platform practices against a Chinese developer. Earlier this year, Apple successfully fought off antitrust accusations from a Chinese consumer, but the company still went so far as to appeal to remove references to its market dominance from the ruling. Bodyreader is seeking monetary damages, an apology, and a court declaration that Apple engages in unfair monopolistic behavior. The developer has also requested that Apple be required to allow third-party app stores and external payment links.Tags: Apple Antitrust, ChinaThis article, "Apple Faces Epic Games-Style China Lawsuit Over App Store Practices" first appeared on MacRumors.comDiscuss this article in our forums Full Article Apple Antitrust China

sto Cable T.V. and Customer Retention By strategystreet.blogspot.com Published On :: Wed, 04 May 2011 18:46:00 +0000 Recently, I decided to test the waters for a less expensive television experience. I have been a loyal cable subscriber for thirty-five years, but friends have told me that other systems, especially satellite, are cheaper. I went online to DirectTV.com to check their packages. We have been spending about $112 a month. The equivalent package from DirectTV appeared to be about $81 a month. I was shocked at the size of the price difference. DirectTV was more than 25% less expensive than Comcast, my cable supplier. Given the size of these price differences, I did some investigation in what is happening in the market. Today there are four potential television service suppliers: cable, telephone companies, such as AT&T and Verizon, satellite and internet companies, such as Netflix and Hulu. The cable companies command 60% of the market. Phone companies have less than 15% of the market. The satellite firms, including DirectTV and Dish, control most of the rest. The internet firms are still small, though they may become larger in the future. Over the years, the cable companies have held a high price umbrella over the satellite companies. Now the phone companies are getting under this umbrella as well. The cable companies lost two million subscribers last year. The phone companies picked up most of that loss, while the satellite firms picked up a bit. The combination of the phone and satellite companies took virtually all the growth there was in the market. Customer retention is a big deal. Even in fast-growing markets, you would like to be able to retain your customers when competitors seek them out. The cable companies have sought to retain customers by emphasizing more services to higher spending customers. These customers tend to be less price-sensitive. It appears that the cable companies are going to have to alter their courses. They simply can not afford to let their competitors take away their market share. Eventually, the competition will be as big and as strong as they are. They will lose the market leverage that a leader enjoys. For examples see GM in autos, IBM in the PC market and U.S. Steel in the steel market. The T.V. market is speaking in clear tones. The phone and satellite companies offer a better value proposition. The cable companies have to listen soon. sto The Mobile Phone Industry and Customer Retention By strategystreet.blogspot.com Published On :: Thu, 30 Jun 2011 00:14:00 +0000 The mobile phone industry’s growth has slowed. It is now operating more like a stable, moderate to slow growth market. This is particularly true in Europe. To face the challenge of slower growth in the industry, European mobile operators are turning to customer retention, but they are careful of the customers they seek to retain. The Europeans have observed that less than 20% of an operator’s customers generate to 80% of the operator’s total revenue. This pattern repeats itself in many industries. When we have seen these patterns in other industries, we have also noted that less than 10% of the total customers generate an astounding 50% of total revenues. These are the really important customers in an industry. A company must retain its key customers. In the mobile phone industry, as in most industries, the largest 20% of the industry’s customers are likely to be what we would call Core customers for the industry’s larger competitors. A Core customer allows supplier company to earn at least the cost of capital through a business cycle. The retention of these core customers is of paramount importance to long term company success. It costs a great deal more to find a new customer than to retain and build the relationship with a customer you already have. In the European mobile phone industry, carriers have found that it costs ten times more to acquire a customer than to retain one. The industry has found another important phenomenon associated with customer defection. Recent research has told it that defection is a social phenomenon. If defecting customers leave an operator, they usually are not quiet about it. They tell their friends. In turn, some of their friends defect as well. So, the loss of a Core customer to an operator will often bring with it the loss of several other Core customers. The mobile phone operators in Europe are working on retention by focusing particularly on those Core customers most likely to defect. These operators have analyzed the value of their customers and have assigned a rating to each customer. When a customer calls a call center, the information about the customer, including his rating, is readily displayed on the service representative’s screen. This customer specific information enables the service representative to respond with different value offers, depending on the importance of the customer. Most of these offers reflect lower prices for a potential defector. But the industry is responding to potential defections with more than simple price reductions. Some companies are developing personal calling rates and plans tailored to individual Core customer habits. One European company instituted this individual approach and cut its percentage of customers defecting each year in half, from 20% to 10%. The industry has found another important phenomenon associated with customer churn. Recent research has told it that defection is a social phenomenon. If defecting customers leave an operator, they usually are not quiet about it. They tell their friends. In turn, some of their friends defect as well. So, the loss of a core customer to an operator will often bring with it the loss of several other core customers. sto The Hopi Prophecy Stone and the Future of the Earth By robbby-robinson.blogspot.com Published On :: Mon, 27 Jun 2011 07:09:00 +0000 The Hopi prophecy for the year 2012 is the most important one, in my opinion. Whereas many prophecies speak of this "end of the world," the Hopi are the ones who've given us the most specific instructions for what to do.According to most ancient prophecies, the Shift of Ages in 2012 is not necessarily the end of the world. It could be the end of an era of darkness on the Earth. But according to the Hopi prophecy, WE are the ones who get to choose. The future, or lack of it, is up to us! While the Hopi had an oral rather than written tradition, they also created images that helped to tell the story, as reminders. The one that is of most interest here is called the Hopi Prophecy Stone. Although the stone has been much damaged and even altered, we will be addressing it as the Elders say it was, before its discovery by the white people. The Hopi Prophecy Stone depicts the Creator of the world (far left), and beside him, the Circle of the World, which it was the Hopi's task to protect. In the Creator's hand is held the two destinies humanity can choose -- one that leads to a good resolution and one that leads to a dead end.The box represents all the people. The diverging point of the Creator's path shows a time when some people would break away from the true path, and go the way of falseness and wickedness. The path at the bottom represents the true path, the path of goodness. It shows 3 calamities, as circles representing "shaken gourds" or world-shaking events, which some have interpreted as world wars. A third world war would therefore be indicated. (Could it be the unremitting war that the USA has conjured up against the Middle East? We can hope that nothing worse is predicted.)In between and beyond the calamities, the sign of growing corn (life) combined with the sign of a cane (long life) reasserts humanity's continuity. The last circle is said to be the final calamity, the purification of evil from the face of the Earth. At the end of the righteous path, we find the Creator waiting for us again: the beginning and the end, the alpha and the omega. This is the spiritual path, the path of goodness and kindness.Reunion with the Divine is the goal and destination of this path. I would add to this interpretation that the true path is the humble path, the one closest to the Earth and nature, grounded. In this image, it is the path that is closest to the Creator.I believe the upper path being the false trail, shows that the path of domination, of power/control, of seeking to be superior over others, is definitely a wrong turn. And that a way of living in balance and respect with nature is part of the good path. Something Native Americans have warned Europeans from the beginning. (This may be another reason Wicca and Paganism are increasing in popularity, as more people leave the wicked path behind.)I think it is also not coincidence that the sign of the corn is used. Life could have been signified by the cane alone. But it is a growing plant that indicates the path of goodness, and the fruit of that path.Nature is the good path. Although here I have drawn in the heads of the figures, the Elders say that the figures on the Hopi Prophecy Stone originally had no heads. (I've indicated this with the heads not joined to the bodies.)This could indicate that those following the path of wickedness are not choosing wisely. That would seem to be evident, as we can now see the inevitable result of small personal wickednesses such as greed, self-interest, insecurity, animosity, etc. Even more visible are the growing results of these: violence, war, domination, sacrificing of others and the future for personal gain, etc.According to Martineau, however, it signals that death must come of following the wicked path. Perhaps both meanings would apply. The zigzag path seems to indicate that the way of wickedness is irresolute and crooked. It reminds me of politicians promising first one thing and then the opposite, depending on whatever people want to hear. Being guided by greed, control, and fear, the Path must veer hither and yon according to the needs of the moment. By contrast, the path of truth is always aimed at the Divine, and does not waver in momentary crises.Notice that before the third calamity, the corn symbol touches the top line. This shows that people on the path of wickedness can change direction at that point, and rejoin the path of goodness. After that point, it is too late, for humanity's careless wickedness brings us to a dead end. The back-curving line shows a point of no return. The symbol of the corn becomes even more prophetic, as we now seem to have seen the end of natural corn. GMOs have invaded even the purest corn stocks in the world.Perhaps it is no coincidence that corn is used as a symbol of life, here. Of course, it was a staple crop of the Hopi. But perhaps the corn touching the wicked path is also a symbol that we can choose the wicked way with our food supply, like genetically altering them. Perhaps the path from goodness to wickedness goes both ways? The Hopi Prophecy Stone shows us that the parameters of our choice determines the future we will have. Are we headed toward a Golden Age? Or extinction? It is not a matter of what we wish for. It is a matter of what actions we take. The Hopi prophesy tells us what we must do to create a positive future for the Earth -- a future in which humanity continues to exist. This makes it the most important of all the 2012 predictions. Not just doom and gloom, nor hope and pray, but the concrete actions and mindsets that will see us through! With Bright Blessings, Full Article Earth Future Prophecy Stone WiccaSpiritualitycom

sto Midwest Schools and Bookstores By greglsblog.blogspot.com Published On :: Thu, 12 May 2016 15:08:00 +0000 I'm just back from a twelve day trip up to Chicago, Milwaukee, and Minneapolis-St. Paul, where I did a bit of research and visited a bunch of schools and children's indie bookstores. The trip started inauspiciously, when my flight was canceled because the wind blew the plane onto a belt conveyor. Eventually, I made it to Chicago, though, where the weather looked like this: Still, I had arrived ahead of time so I could go down to the Museum of Science and Industry, which has a World War II German u-boat and a chicken incubator. Next two days were the actual school visits, arranged at Henry Puffer Elementary and Liberty Elementary by Anderson's Book Shop and at Attea Glenview School and Rondout School by The Book Stall. Afterwards, I got to hang out with Robert from The Book Stall and stopped by for a couple of pics. Posing with posters Then I was off to Milwaukee for a school visit at Atwater Elementary arranged through the Boswell Book Company. It was my first time I'd ever been to Milwaukee, but sadly didn't have a chance to sightsee, because it was off to Minneapolis-St. Paul for three days of school visits. Visits at North Trail Elementary and Brimhall Elementary were through Addendum Books; those at Crestview Elementary and Little Canada Elementary were through the Red Balloon Bookshop; and at Valley View Middle School, through Wild Rumpus Books. Snake! I had some free time, so I went over to Addendum Books for some pics and had a fun lunch with Katherine and Marcus, the proprietors. In front of the "Purple Rain" wall Since I was there over the weekend, I spoke at Red Balloon for the Minnesota SCBWI about Research and the Suspension of disbelief. I also had the chance to go run a couple times on the Mississippi Riverfront trail and visit the Science Museum of Minnesota. T.rex! Triceratops Stegosaurus! After Monday's school visit I had a fun lunch with Drew and Jordan of Wild Rumpus Books at Pizzeria Lola (a separate Pizza-a-Day Diet post will be forthcoming). Then I visited the bookstore, where I met the menagerie. Copper oven and decorative birch logs Chicken! Ferret! Then I was back to Chicago and spent a day at the Field Museum of Natural History and showed Madeline Smoot of CBAY Books a bit of the city! Many thanks to all the librarians and booksellers and Blue Slip Media and everyone else who made this happen. Thanks also to Quinette Cook and all the folks from MN SCBWI who came out for the workshop. It was great fun meeting you! sto Texas Ironman 70.3 (Galveston)! By greglsblog.blogspot.com Published On :: Fri, 13 Apr 2018 13:54:00 +0000 I just completed my second Ironman 70.3 ("half-Ironman") in Galveston, Texas! It was different, but not too different than the first. In some ways it was more challenging than Austin, although I did manage to eke out a personal best, so I count myself pleased, although I've identified several areas where I can improve :-). The Galveston site presented a couple more difficulties than the Austin one, viz., transportation of people and bicycles, as well as housing therefor. The race site was at Moody Gardens, which has its own resort hotel, which we might have done if we had planned on going on Friday and staying until Monday. Ultimately, we decided to drive down the morning before the race with our bikes, rent a house via Airbnb, and drive back the evening of the race. Leaving Austin at 7 AM... With two bikes on the back, three people (and one bike) in the car, and all our gear, we were pretty packed, but the drive only took about three and a half hours, even accounting for coffee breaks. We drove directly to Moody Gardens to pick up our race packets and drop off our bikes. The first thing we discovered when we arrived was that it was cold and rainy and the swim venue (Offats Bayou) was a bit choppy... Under the triumphal arch the day before the race... Registration/packet pickup was in a big white tent overlooking the bayou (the same big white tent Moody Gardens had used for a cool dinosaur thing a couple years back). The white tent with dinosaurs five years ago... The pickup and registration and dropoff were strangely inefficient: You wait in line at a first table to show your ID and USA Triathlon membership; then you go to a second table to pick up your waiver and other forms. Next, you go to a third table to fill in and sign your waiver and forms, and go to a fourth table to drop off your signed waiver and forms. Thereafter, you go to a fifth table to pick up your wristband and swim cap and bike and helmet stickers; go to a sixth table to pick up your backpack/goodie bag and T-shirt; and finally, go to a seventh table to pick up your timing chip. Then you exit via the Ironman store and vendor village where you can wait in line to buy stuff. Inside the big white tent The course talk was outside and the rain had died down enough so that it wasn't all that unpleasant. Behind us was the paddlewheeler Colonel and a whole lot of choppy water with whitecaps. We were assured that the weather could be better the next day, however. No rain and significantly less wind, although there would be a headwind on the return portion of the bike route. The paddlewheeler Colonel. The swim course, with the finish right by the paddlehweeler The Airbnb was a nice little three-bedroom cottage about five miles from the event site and across from a large cemetery. It had a complete kitchen that would come in useful later that night when we couldn't get into any of the nearby Italian restaurants without reservations. The house we rented Cemetery across street. Making spaghetti dinner That evening, we gathered all of our gear and made dinner and looked forward to the race. I went for a three mile run around the nieghborhood to loosen up a bit, and then we made dinner. I managed to get around five or six hours of sleep and only hit the snooze button once when the alarm went off at 4:30 in the morning. After a couple cups of coffee, a banana, and a bagel, we were off! The temperature felt good: low fifties, not too much of a breeze. I decided I didn't need gloves, but would take along my arm warmers for the bike just in case. We arrived at Moody Gardens a little after six and discovered we had had to park about a fifteen minute walk from the actual transition area. A remarkably long line greeted us to enter transition (for body marking), but since we had already done so, we were able to get in with only a brief wait and some judicious weaving through the crowd. Testing out the wetsuit when I first got it. There was then the ritual of putting on the wetsuit and pumping the bike tires and then transition closed! (We might have cut the timing a little close). We then made our way separately to the swim start: they did a wave start by age group. You jump off the pier (see above map), hang around in the water for a couple minutes, and then swim like the wind when you hear the starter's horn. The water was a nice 72 degrees, about twenty degrees warmer than the outside temperature. The water felt good, although it took a few minutes to get used to the waves and occasional mouthful of salt water. I felt pretty good, though, and noticed myself passing a lot of people. More importantly, I managed to beat my swim time from last fall's Austin Ironman 70.3. Once I was out of the water, the wetsuit strippers were efficient and I had no problem getting to my bike (even without my glasses), stowing my wetsuit and taking off. Because it was relatively warm, I decided not to bother with my sleeves, and I wouldn't have worn gloves even if I had brought them. The first half of the bike portion was glorious. The temperature was perfect and I had no problems staying in aero position almost the whole way. Unfortunately, at the turnaround, I was made to realize just how much of a tailwind I had been benefitting from. The rest of the ride felt like I was pulling a mobile home... Grimacing with miles to go... Also about that time, the temperature dropped by about ten degrees, and it started to rain. And then my back started to hurt from being in aero position for so long. In short, the ride back was completely miserable...But I managed to break three hours, which had been my goal. In addition to the lower back pain, I got a pain between my shoulders, and every time I tried to stand up in the pedals to stretch, my legs felt like they wanted to cramp up. And my hands were so cold I could barely move them to squeeze my water bottles. Trying to squeeze out the last drop from my water bottle. By the time I got back to transition, my hands were so numb that I couldn't operate the clip on my helmet. Putting on my shoes and tying my laces was equally an ordeal. It didn't help that my legs and abs kept cramping up when I bent to tie the laces. After a ridiculously long transition, I made it onto the run course and my watch died. But my legs felt good and I enjoyed the run a lot more than I thought I was going to on the return bike. :-). My pacing was a bit off and I came in somewhat slower than I would've liked, but it still felt pretty good. Victory! Overall, I came in a couple minutes better than the Austin Ironman 70.3, which I'm pleased with (although I think my run could've gone better). Mugging with the finisher's medal Using the R8 recovery roller thing... All in all, it was a great experience and I'd definitely do the race again. A big thanks to all the organizers, volunteers, sponsors, and first responders who made the event a success! Full Article 70.3 Ironman races triathlon
sto Stones, Shrines and Alters of Erin By iron-mitten.blogspot.com Published On :: Thu, 24 Oct 2024 15:11:00 +0000 Here are the finished standing stones from Alternative Armies amongst others.I've added a few extra skulls to the base once flocked.A bear hide has been left as an offering too.Battle shine, again extra weapons have been added to the base. The rocks form a sacred circle in which to knee and offer your items.Paper ferns were added to this base. I'm not sure how they will last as they are fragile. Being hard up against the stone will help them. This place must be strong in fey magic because flowers have sprung up around the stones. Flowers are a nice way to show the affinity of a place. Flowers equal a nice holy area, where dead and dying grass says the opposite. The great fertility rock with it's comfy furs to lie on. I wanted to give this the impression of a giant lady in a fur cloak. The cloak is made from moss and ivy.Ancient pillar, I added some ivy to this to weather it in. Also putting flock to act as moss up one side helped to age it. Moss normally grows on the north side of trees, so I added this trick to a lot of the stones. This is a miniature from Reaper Bones, I think it's called 'Evil tower'. I thought it would make a good Fomorian piece or maybe something older and darker. What ever it is, it has been thrust up from the ground and killed the surrounding grass. It must be cursed...Ivy again helps weather these small stones. This isn't a bad place as flowers grow around the mound, new life from old.I've rediscovered Celtos as a figure range that might be useful for this growing project. It's time to dig out the old stones and compare them. A lot of these previous models had a greenstuff carving in them. The two weapon shrines. One is a place of worship, the other, sacrifices. The two stones of the dead. These could be used for any undead project.Recently I thought about making more of an effort to photograph my miniatures. I have seen other people use backdrops and so thought I'd play around with the idea. By using a photo from a book as a background, the results can be quite different. Rather than a cluttered work table full of detail taking away from an image, the background actual enhances and compliments it. This simple book set up has really improved these stone pictures and it's something I'll do again for sure. Full Article Celtic Mythology Celts
sto My Halloween Season Story, "Unquiet Graves," in CLARKESWORLD By floggingbabel.blogspot.com Published On :: Fri, 01 Nov 2024 20:24:00 +0000 . I am always happiest when a story of mine comes into print. Today, I have the joy of introducing you to "Unquiet Graves," a seasonal tale of graveyard misbehavior and betrayal. Oh, and there's nothing supernatural about it at all.You can read the story here. But if you're like me, you'll just go to Clarkesworld, look over the table of contents, and decide which story you want to read first. Mine by preference, but follow your whim. And for those who like trivia . . .I came up with the handheld's app many long years ago and it took forever to come up with a story for it. You'll notice that it is left unnamed in the story. That's because its secret name was "The Graveyard Reader." Which is the title of a well-known story by Theodore Sturgeon. While I was writing the story, I thought of it as "The New Graveyard Reader." But Sturgeon's story and mine go off in totally different directions, and giving mine (or even the app) a title suggesting there was some implicit connection between the two would only cause confusion. The title I finally came up with was derived from "The Unquiet Grave" by that most prolific of all poets, Anonymous. If you look it up, I suggest you do so after reading my story. It gives away some of the plot.* Full Article

sto stodgy and claggy By separatedbyacommonlanguage.blogspot.com Published On :: Thu, 20 Jun 2024 20:02:00 +0000 I have been asked many times if I've written about stodgy, and I always think I have, because I wrote a post about other BrE -odgy adjectives. I have no idea why stodgy didn't make it into that post, but I'm here to rectify the stodgelessness of this blog.I remember (early in my time in England) asking an English friend what she meant when she said she looked forward to a bit of stodge. She meant 'a carbohydrate-heavy meal'. It was new to me, and this chart from the Corpus of Global Web-Based English (GloWbE) lets you know why: most Americans don't talk about stodge:stodge in the GloWbE corpusBut stodgy is a different matter:stodgy in the GloWbE corpusSo how could I not figure out from context what stodge meant, if stodgy be a relatively common word in AmE? Because Americans typically don't use stodgy to mean 'carb-heavy'. We mostly use it to refer to someone or something that is so conventional or inactive as to be dull. You can see this in the typical nouns following stodgy in the News on the Web corpus. Here are the top 3: BrE AmE 1 stodgy food stodgy industry 2 stodgy performance stodgy incumbents 3 stodgy comfort food stodgy reputation Stodgy performance (in sport[s]) in the BrE column shows that it can also mean 'dull' in the UK. It's a negative thing when it comes to things other than food, and it can be negative regarding food too. You might feel unpleasantly heavy after eating stodgy food. But stodgy food can also be nice, as I know all too well.Claggy reminds me a bit of stodgy, and it came up recently when I baked some banana bread for a gathering then overheard a participant describe it as claggy. This again, is a BrEism, which might have become somewhat familiar in the US due to the popularity of the Great British Bake Off (aka the Great British Baking Show: see this old post about that). It means 'having a tendency to clot'—so when it is used in reference to baked goods, it means something like 'so moist or undercooked as to feel gummy or clumpy'. My thought on having my moist banana bread called claggy: Those who come empty-handed shouldn't throw baking insults, [IrE/AmE] bucko!I reali{s/z}e I haven't given any AmE equivalents. That's because I felt like these words filled a gap in my vocabulary when I learned them. But if any Americans out there have some good words for these things, do let us know in the comments! P.S. See the comments re the original 'muddy' sense of claggy. It's also made an appearance in the NYT Spelling Bee: an archive of disallowed BrE words post.P.P.S. I dealt with this a bit more in my newsletter, including a less-used synonym of claggy, clatty. Related, there is also clarty ('smeared/covered with sticky mud'), which didn't make it into the newsletter, but is discussed in the comments below. Full Article adjectives food/cooking
