Anicetas, one of the city governors, presented himself before the Emperor, boldly confessed his Christian faith, and denounced the worship of the idols. Anicetas was subjected to a series of cruelties: his tongue was cut out, but he miraculously continued to speak; he was thrown to a lion, but it refused to attack him; then he was savagely beaten with rods until his bones showed through his wounds. His nephew Photius, seeing his endurance of all these trials, ran forward, embraced his uncle, and declared to the Emperor that he too was a Christian. The Emperor ordered that he be beheaded immediately, but the executioner, raising his sword, gave himself such a wound that he died instead. After many tortures, the two were put in prison for three years, then brought out and cast into a fiery furnace, where they died, though their bodies were brought out of the flames intact. By belledejour-uk.blogspot.com Published On :: Mon, 03 Oct 2011 14:46:00 +0000 It is with some interest that I have been following media reports of the alleged conduct of Ashton Kutcher, a well-known campaigner against sex trafficking. As has been pointed out elsewhere, the "problem" his advocacy claims to address is certainly hugely overstated and possibly being manipulated by people who are at least as interested in money and credibility as they are in philanthropy. Interestingly, on Quora, which Kutcher has called "the smartest place on the internet" (you know, because academic journals and research forums are where the dumb kids hang out), there was a question not long ago which asked, "Why is it so common to include voluntary prostitution in the category of sex trafficking?" Kutcher stepped in, as did others, in defence of the idea that foreign-born women voluntarily choosing to enter sex work - such as, say, myself (and yes, one of them did mention me specifically) are trafficked. Also people being transported over state and international borders, or something. When you hear the word "trafficking", maybe you imagine a foreign child being kidnapped and sold into sexual slavery. Not only is that not accurate, it's also not what the lobbyists against sex work even seem to believe themselves. But it is an assumption they appear happy to exploit. As the Quora discussion shows, Kutcher and people like him claim that "trafficking" includes people going into sex work willingly and migrating willingly. In other words, equating consensual sex work with involuntary slavery. Actually a lot of other "rescue industry" types buy that as well. It's a stand with a lot of errors of logic, but it's their platform, they defend it, they own it. Right. Now, let's check out an article from the Daily Mail dated 03 October 2011 (no link since Istyosty has gone now, HuffPo covers it and so does The Frisky, also it's screensnapped below). It includes quotes from someone who not only claims to know the person Kutcher allegedly cheated with, but who also appears to indicate that the presence of girls like her at celeb parties is, shall we say, not entirely without reimbursement. Here's the bit in the Mail that caught my eye: Naumoff, who arranges for good looking girls to be shipped to certain hotspots, also told the newspaper: 'Sara’s a great girl. My job is to round up hot girls and bus them into clubs in San Diego or Vegas. The girls get free booze, food, whatever, and they attract rich and famous guys to the clubs. It’s a two-way street. The girls get to meet rich men and the guys get what they want.’ Which is? ‘Sex, obviously.’ Is Naumoff paid to do this? If so, by whom? The Mail doesn't say. You could be charitable and interpret this as kind of an introduction service. But then again, some of the men in question are already married. You could alternatively think this setup sounds an awful lot like people being reimbursed for travel and sex. Which might not only count as prostitution to some people, but trafficking as well. If you were the sort of person who was inclined to see things that way. Me? I don't believe anyone who enters any kind of quid-pro-quo relationship, be it sex for money or naked hot tubbing for a drinks tab, and does so willingly, is trafficked. So far so sugar daddy. But read the Quora opinions, and consider what's being quoted in the Mail, and ask yourself whether you think this alleged situation would tick the rescue industry's boxes for "prostitution: trafficking" or not. Lorsque vous travaillez avec un client pour la première fois, il convient de déterminer à l’avance les modalités de votre relation et mieux vaut le faire par écrit, afin d’établir clairement les responsabilités de chacun et de régler plus facilement d’éventuels différents. Pour cela, rédigez dès à présent vos conditions générales de vente (CGV), ou de prestation de service (CGPS) si vous êtes prestataire, mettez-les à disposition de vos clients et prospects sur votre site web et mentionnez-les dans vos devis. Vous ne savez pas par où commencer ou avez peur d’oublier une clause importante ? Lisez la suite de ce billet ! C'EST QUOI DES CONDITIONS GÉNÉRALES DE VENTE OU DE PRESTATION DE SERVICE ? Vous avez sans doute déjà entendu le terme de conditions générales de vente (CGV) et coché une case sur un site web pour signifier que vous les aviez lues et acceptiez leurs termes avant d’effectuer un achat sur Internet. Comme les CGV, les conditions générales de prestation de service (CGPS) définissent les relations contractuelles entre un vendeur et un acheteur, mais désignent spécifiquement les conventions relatives à la délivrance de services plutôt que de biens : en tant que traducteurs, c’est donc le terme que nous devons privilégier. Si leur rédaction n’est pas obligatoire pour la prestation de services entre professionnels (B2B), l’article L441-1 du Code de commerce prévoit que les CGPS doivent être communiquées au client professionnel qui en fait expressément la demande. Mieux vaut donc y consacrer un peu de temps dès maintenant pour disposer du document au moment voulu. Quel est l'intérêt d'AVOIR DES CGPS ? Présenter vos conditions générales de prestation de service à un nouveau client vous permet d’aborder la façon dont vous souhaiter collaborer avec lui. Elles peuvent servir de base à la rédaction d’un contrat, mais en l’absence d’accord spécifique, elles s’appliqueront par défaut si vous vous en faites mention dans vos devis. Les CGPS n’ont que des avantages : Elles établissent dès le début de la relation vos responsabilités et celles de votre client. Elles précisent certains points pouvant être source de litige avant que des problèmes se posent (droits d’auteur, modification de texte source en cours de projet, retards de paiement, etc.). En présentant clairement vos exigences, elles vous permettent de négocier un accord plutôt que de signer aveuglément celui que votre client vous présente. Elles séparent le bon grain de l’ivraie en rebutant les clients abusifs. Si une entreprise refuse de vous confier un contrat de traduction à cause de vos conditions générales, c’est qu’elle ne vous traitera jamais comme un partenaire, autant éviter de perdre votre temps. Elles reflètent votre professionnalisme et vous différencient des traducteurs proposant leurs services en envoyant un simple CV. Comment rédiger vos CGPS ? Bien que les CGPS ne soient pas obligatoires pour encadrer les conventions entre professionnels, si elles sont formalisées leur contenu est imposé en partie par la loi (le code de commerce en l’occurrence) et doit inclure certaines mentions, notamment : Les conditions de vente (parties en présence, nature du travail, délais impartis, etc.). Le prix unitaire (prix au mot source ou au mot cible, montant forfaitaire à l’heure ou pour l’ensemble du projet…). Les éventuelles réductions de prix et conditions d’escompte accordées au client, ainsi que leur mode de calcul. Les conditions de règlement (paiement à l’avance, en cours ou en fin de contrat, mode de règlement, délais de paiement, etc.) y compris les pénalités en cas de retard de paiement et leur mode d’application (X % d’intérêt par mois/semaine/jour à compter de la date limite de paiement, sans oublier l’indemnité forfaitaire). Pour vous aider dans cette tâche, la Société française des traducteurs (SFT) propose des Conditions générales de prestations de service recommandées, que vous pouvez adopter telles quelles (après les avoir relues attentivement !) ou adapter à vos besoins. Puisqu'il s'agit d'une traduction, il est important de souligner qu'en cas d'incohérence, le document en français est le seul à avoir valeur de contrat. Vous remarquerez aussi que j’utilise les mêmes éléments visuels pour mes CGPS que sur mon site, comme sur l’ensemble de mes documents d’entreprise (devis, factures, correspondance, CV, etc.). Cette identité visuelle sert à convaincre mes clients potentiels qu’ils ont affaire à une professionnelle et à les amener à me respecter en tant que telle. Points importants À FAIRE figurer dans vos CGPS En plus des mentions légales, n’oubliez pas d’aborder les questions suivantes : Propriété intellectuelle : demandez au client de confirmer par écrit qu’il est bien propriétaire des droits d’auteur ou autorisé à faire traduire le texte source. Qui sera titulaire des droits d’auteur de la traduction ? Quels documents ou sources d’information devront rester la propriété de votre client ? Mémoire de traduction : à qui appartient la mémoire de traduction créée ou utilisée pour ce projet ? Au client, à vous ou aux deux parties ? Confidentialité : quelles informations ne doivent pas être divulguées et combien de temps serez-vous tenu de respecter cette clause de confidentialité ? Protection des données personnelles : dans le cadre du Règlement général sur la protection des données (RGPD), vous avez le devoir d’informer les personnes à qui appartiennent les données personnelles que vous collectez (donc vos clients, dont vous enregistrez au moins le nom et les coordonnées) de l’usage que vous en faites et de leurs droits. Cette information doit figurer sur les supports de collecte de données, mais peut aussi être ajoutée aux CGPS puisqu’elles servent à informer vos clients et prospects. Non-concurrence : pouvez-vous accepter des contrats d’entreprises concurrentes ? Si oui, êtes-vous tenu d’en informer votre client ? Si non, êtes-vous dédommagé en conséquence ? Modifications : que se passe-t-il si le client change le texte source en cours de projet ? Comment doit-il vous en informer ? Êtes-vous libre de refuser de traduire les modifications ? Serez-vous rétribué en conséquence ? Êtes-vous responsable des modifications effectuées par des tiers ? Acceptation/refus du travail fini : sous quelles conditions une traduction sera-t-elle acceptée ou refusée (relecture, vérification par le client…) ? Qui effectue la relecture et qui vérifie la qualité du travail fourni ? En se basant sur quels critères ? Quelles mesures seront prises pour corriger d’éventuelles erreurs (délai de notification, frais éventuels, etc.) ? Que se passe-t-il si le client n’est pas satisfait du résultat ? Quelle sera l’étendue de votre responsabilité professionnelle ? Annulation du projet : que se passe-t-il si le contrat est annulé une fois le travail commencé ? Comment le traducteur sera-t-il compensé (pénalités ou paiement du travail déjà réalisé) ? Rupture de contrat : Sous quelles conditions chaque partie peut-elle être libérée de ses obligations (faillite du client, poursuites pénales, manquements graves aux termes du contrat, maladie grave ou incapacitante, etc.) ? Résolution de disputes : quelles sont la loi applicable et la juridiction compétente en cas de litige ? Quelle sera la procédure à suivre (conciliation, arbitration, tribunal compétent…) ? ET SI VOUS AVEZ AFFAIRE À DES PARTICULIERS ? Certains traducteurs ont une clientèle composée en partie de particuliers (traduction certifiée, édition à compte d’auteur, etc.), dans ce cas les CGPS sont obligatoires et doivent être acceptées de façon formelle avant toute commande. Les obligations des professionnels ont été renforcées par la Loi Hamon du 13 juin 2014 et la Loi pour la confiance dans l’économie numérique en prévoyant notamment un délai de rétractation de 14 jours pour le client particulier, dont il faut impérativement tenir compte. En omettant de communiquer ses CGPS, le prestataire s’expose à des sanctions, notamment à une amende civile de plusieurs milliers d’euros. En outre, s’il n’est pas fait mention des conditions d’application, du taux d’intérêt des pénalités de retard ou du montant de l’indemnité forfaitaire pour frais de recouvrement, il risque une amende administrative. Derniers conseils Mieux vaut se mettre d’accord à l’avance plutôt que de devoir gérer un conflit plus tard. Envoyez vos CGPS à votre client ou négociez les termes de votre contrat AVANT de commencer une mission. Tout ce qu’un client vous demande, une fois votre contrat ou devis signé, devrait être accepté par écrit (un email ayant valeur d’écrit dans le cadre de relations commerciales entre professionnels). Un contrat de prestation de service s’établit entre deux parties (vous et votre client), si vous devez en signez un, rédigé ou non sur la base de vos CGPS, méfiez-vous des clauses dont l’exécution sera soumise aux actions d’un tiers (paiement, vérification, approbation…). Ainsi, si vous travaillez en tant que sous-traitant, n’acceptez pas d’attendre que votre client soit lui-même payé pour recevoir le règlement de votre prestation. À vous de jouer maintenant ! The advent of COVID-19 pandemic necessitates a digital disruption in retail supply chain management centred on efficient technology like blockchain in order to enhance supply chain performance. The present research aims to decipher the nature of associations between supply chain management practices, blockchain technology adoption and supply chain performance in retail firms. The research is based on primary survey of specific food and grocery retailers operating on a supermarket format stores in two Indian cities. The findings pointed towards the presence of significant and positive association of all the constructs with each other. Moreover, the mediating role of blockchain technology adoption was also revealed, i.e., it partially mediates the effects of supply chain management practices on supply chain performance. Initial experiences of the metaverse were not very satisfactory; new virtual world metaverses may or may not survive as information services or platforms. The purpose of this empirical study is to identify the characteristics of a virtual world metaverse and their effects on intention to continue usage of the platform. Considering the metaverse as a new type of user experience and a powerful mode of communication, we examine the mediating role of these characteristics according to Pine and Gilmore's (1998) experience economy theory, which enriches our understanding of the factors affecting the success of a metaverse. In addition, since social interaction is important in metaverses, we extend Pine and Gilmore's experience economy model by including Schmitt's (2011) relate experience for better understanding. eta A Detailed Rubric for Assessing the Quality of Teacher Resource Apps By Published On :: 2016-06-25 Since the advent of the iPhone and rise of mobile technologies, educational apps represent one of the fastest growing markets, and both the mobile technology and educational app markets are predicted to continue experiencing growth into the foreseeable future. The irony, however, is that even with a booming market for educational apps, very little research regarding the quality of them has been conducted. Though some instruments have been developed to evaluate apps geared towards student learning, no such instrument has been created for teacher resource apps, which are designed to assist teachers in completing common tasks (e.g., taking attendance, communicating with parents, monitoring student learning and behavior, etc.). Moreover, when teachers visit the App Store or Google Play to learn about apps, the only ratings provided to them are generic, five-point evaluations, which do not provide qualifiers that explain why an app earned three, two, or five points. To address that gap, previously conducted research related to designing instructional technologies coupled with best practices for supporting teachers were first identified. That information was then used to construct a comprehensive rubric for assessing teacher re-source apps. In this article, a discussion that explains the need for such a rubric is offered before describing the process used to create it. The article then presents the rubric and discusses its different components and potential limitations and concludes with suggestions for future research based on the rubric. Full Article
eta Impact of a Digital Tool to Improve Metacognitive Strategies for Self-Regulation During Text Reading in Online Teacher Education By Published On :: 2024-06-18 Aim/Purpose: The aim of the study is to test whether the perception of self-regulated learning during text reading in online teacher education is improved by using a digital tool for the use of metacognitive strategies for planning, monitoring, and self-assessment. Background: The use of self-regulated learning is important in reading skills, and for students to develop self-regulated learning, their teachers must master it. Therefore, teaching strategies for self-regulated learning in teacher education is essential. Methodology: The sample size was 252 participants with the tool used by 42% or the participants. A quasi-experimental design was used in a pre-post study. ARATEX-R, a text-based scale, was used to evaluate self-regulated learning. The 5-point Likert scale includes the evaluation of five dimensions: planning strategies, cognition management, motivation management, comprehension assessment and context management. A Generalized Linear Model was used to analyse the results. Contribution: Using the tool to self-regulate learning has led to an improvement during text reading, especially in the dimensions of motivation management, planning management and comprehension assessment, key dimensions for text comprehension and learning. Findings: Participants who use the app perceive greater improvement, especially in the dimensions of motivation management (22,3%), planning management (19.9%) and comprehension assessment (24,6%), which are fundamental dimensions for self-regulation in text reading. Recommendations for Practitioners: This tool should be included in teacher training to enable reflection during the reading of texts, because it helps to improve three key types of strategies in self-regulation: (1) planning through planning management, (2) monitoring through motivation management and comprehension assessment, and (3) self-assessment through comprehension assessment. Recommendation for Researchers: The success of the tool suggests further study for its application in other use cases: other student profiles in higher education, other teaching modalities, and other educational stages. These studies will help to identify adaptations that will extend the tool’s use in education. Impact on Society: The use of Metadig facilitates reflection during the reading of texts in order to improve comprehension and thus self-regulate the learning of content. This reflection is crucial for students’ knowledge construction. Future Research: Future research will focus on enhancing the digital tool by adding features to support the development of cognition and context management. It will also focus on how on adapting the tool to help other types of learners. Full Article

It discovered a significant connection between monetary policy and sustainable development along with sub-dimensions of SD. Likewise, this study confirmed a positive mediating influence of e-BS between monetary policy and sustainable development. Finally, the study additionally ensured a positive moderation of financial risk between monetary policy and sustainable development, respectively.
