The case of the Union, which espoused the cause of the workers, was that the delinquent workers were employed by the management in their packing centre at Puthentheruvu, Karunagappally. Since 26.10.2012 was a public holiday owing to Bakrid, the factory was closed. On 27.10.2012, when the workers reached the factory, they were denied employment by the Management. The Union raised an industrial dispute and the matter reached the District Labour Officer, who convened a conference. In the meantime, a WP(C) No.12490/2018 3 show cause notice was issued to the workers and consequently on 2.11.2012, the workers were suspended from service pending enquiry. An enquiry officer was appointed who proceeded with the enquiry and submitted a report with the finding that the workers were guilty of all charges. Banking on the said report, the workers were dismissed from service with retrospective effect. According to the Union, the enquiry which was conducted was a farce and is therefore vitiated. The principles of natural justice were violated and the management failed to bring home the charge. They also contended that the punishment imposed was grossly disproportionate to the nature of charges levelled against the workers. Full Article

ny NY's Cuomo criticised over highest nursing home death toll By www.business-standard.com Published On :: Sun, 10 May 2020 10:48:53 +0530 New York Governor Andrew Cuomo, who has won bipartisan praise for rallying supplies for his ravaged hospitals and helping slow the coronavirus, is coming under increasing criticism for not bringing that same level of commitment to a problem that has so far stymied him: nursing homes. We've tried everything to keep it out of a nursing home, but it's virtually impossible, Cuomo told reporters. Now is not the best time to put your mother in a nursing home. That is a fact. Residents' relatives, health care watchdogs and lawmakers from both parties cite problems with testing and transparency that have prevented officials and the public from grasping the full scale of the catastrophe. And they are second-guessing a state directive that requires nursing .. Full Article
ny Batsman should be given out LBW if any ball goes on to hit the stumps: Chappell By www.business-standard.com Published On :: Sun, 10 May 2020 11:16:53 +0530 Former Australia captain Ian Chappell has proposed radical changes in the LBW laws, stating that a batsman should be given out leg before as long as the ball is hitting the stumps irrespective of the spot of its landing and impact. Chappell also said captains should agree on one way of working up the ball which will encourage swing bowling, even as the ICC is considering the use of artificial substances to shine the ball instead of sweat and saliva in post COVID-19 scenario. "The new lbw law should simply say: 'Any delivery that strikes the pad without first hitting the bat and, in the umpire's opinion, would go on to hit the stumps is out regardless of whether or not a shot is attempted'," he wrote in a column for ESPNcricinfo. "Forget where the ball pitches and whether it strikes the pad outside the line or not; if it's going to hit the stumps, it's out." The 76-year-old said the change in lbw law would attract expected criticism from the batsmen but it would make the game more ... Full Article
