(California Court of Appeal) - In an unlawful detainer action between two non-profit religious organizations, trial court's order compelling defendant's pastor, who was not a party to the action, to sign the written settlement agreement in his individual capacity, is reversed and remanded where: 1) the parties' oral settlement agreement did not require the pastor to release any personal claims against the plaintiff or sign a written agreement purportedly conforming to the oral settlement in his individual capacity; and 2) the trial court lacked jurisdiction over the pastor.

(California Court of Appeal) - Reversed order denying Defendant’s motion to strike. Plaintiff represented deceased celebrity, Jenni Rivera, and they sought to restrict disclosure by Defendant broadcaster of certain information. Appeals court ruled the First Amendment protected broadcaster’s use of information and reversed trial court order.

(United States Federal Circuit) - Vacated in part and affirmed in part. Plaintiff owns patents for making flameless candles. The Patent Trial and Appeal Board held that certain claims by plaintiff were unpatentable and some claims were time barred. The Federal Circuit vacated the time barred decision as to one of the claims and affirmed the Board’s decision as to the other claims.

The patentee contended that the petitions for inter partes review were time-barred because an alleged real party in interest had been served with a complaint alleging infringement over one year prior to the IPRs' filing dates. Finding possible merit in this argument, the Federal Circuit vacated and remanded for further proceedings.

(United States Ninth Circuit) - In an issue of first impression involving the Securities and Exchange Commission's ability to disgorge ill-gotten funds from so-called 'relief defendants', the district court's final judgment, arising in connection with the SEC's enforcement action for federal securities law violations arising out of a fraudulent investment scheme, is affirmed where: 1) the district court properly asserted jurisdiction over appellants as relief defendants to determine the legal and factual legitimacy of appellants' claim to the $5 million; and 2) the district court did not clearly err in finding that the $5 million transfer as a loan was a sham.

(United States Ninth Circuit) - Affirmed a judgment of liability under the Lanham Act for reverse passing off. At trial, a jury found that a manufacturer of industrial tires had arranged to obtain a competing manufacturer's tires with the labels removed and used the tires to solicit business from one of the competitor's customers. The Ninth Circuit affirmed a judgment that these actions violated the Lanham Act, which prohibits conduct that would confuse consumers as to the origin, sponsorship, or approval of goods or services. The panel's opinion also addressed other issues including trade dress validity.

(California Court of Appeal) - In a suit brought by operators of recycling centers where beverage containers sold in California may be redeemed for their California Redemption Value, against companies that sell or distribute beverages containers in California, contending that defendants knowingly and "falsely" label beverage containers sold both inside and outside California with "CA CRV," "California Redemption Value," or similar labels when, in fact, under California law, only containers purchased inside California may be redeemed in California, and alleging common law tort claims against defendants for fraud, negligent misrepresentation, strict products liability, interference with prospective economic advantage and business relations, and breach of express warranty, the trial court's judgment of dismissal is affirmed where the injunctive and compensatory relief plaintiffs seek cannot be awarded by a California court because it would violate the "dormant" commerce clause of the federal Constitution.
