The workshop focused on the international framework for measures of restraint, as well as the internationally recognized constitutional right to institute proceedings in cases of violations. The detention of minors, persons with disabilities, women with children, or defendants in need of continued medical treatment and hospitalization were among the topics discussed, and participants learned more about their specific concerns to ensure that the restraint measures taken comply with human rights standards. “The right to liberty is a basic fundamental right, protected by international human rights law and enshrined in the Kyrgyz Constitution,” said Anete Erdmane, acting Senior Human Dimension Officer at the OSCE Centre. “To ensure that restrictions on liberty are applied in compliance with the law and that other human rights are not violated as a result of the deprivation of liberty, it is important that prosecutors and lawyers are aware of the relevant standards and obligations. In line with its mandate, the OSCE Centre works to improve the administration of justice and strengthen the rule of law in Kyrgyzstan.” The course was delivered by Ulugbek Azimov, a well-known national expert in the field, while Sergey Poduzov, an international human rights law expert from Russia, also led a training session. The training for 25 prosecutors and 31 defence lawyers from all regions of Kyrgyzstan was provided in close co-operation with the Training Centre for Prosecutors under the General Prosecutor’s Office of the Kyrgyz Republic and the Training Centre for Lawyers. The course covered a wide variety of topics directly relevant to the work of the participants, including recent developments in Kyrgyzstan. Drawing on the guidance of national and international experts, participants discussed the nature of the right to freedom of religion or belief, its interrelatedness with other human rights and fundamental freedoms, the nature, extent and impact of violations of freedom of religion or belief, and the duties of the state to respect, protect and fulfil this universal human right. Participants also took part in mock trials on cases involving interference with freedom of religion or belief, such as through the banning of religious clothing and discrimination against religious organizations. “In using topical case studies, the participants were able to apply the knowledge they had acquired in a practical ‘courtroom’ environment and improve their legal skills in analysing freedom of religion or belief cases and advancing cogent and structured arguments,” said Mark Hill, one of the participating international experts and a senior barrister from the United Kingdom. The mission’s deployment follows an official invitation from the Belarus authorities. The mission is led by Tana de Zulueta and consists of a core team of 10 experts based in Minsk and 38 long-term observers to be deployed in teams of two across the country. In addition, ODIHR will request 400 short-term observers to monitor proceedings on election day. The experts and observers are drawn from 24 countries. The mission will assess the parliamentary elections for compliance with OSCE commitments and other international standards and obligations for democratic elections, as well as with domestic legislation. Observers will follow the candidate registration process, campaign activities, the work of the election administration and relevant state bodies, implementation of the legal framework and the resolution of election disputes. As part of the observation, the mission will also monitor the media coverage of the campaign. be Russia’s labeling of journalists as terrorists a threat to media freedom, OSCE Representative says By feeds.osce.org Published On :: Tue, 12 Jul 2016 17:33:20 +0000 VIENNA, 12 July 2016 – OSCE Representative on Freedom of the Media Dunja Mijatović today expressed concern about the decision of Federal Financial Monitoring Service in Russia to publish an updated “list of terrorists and extremists” which includes members of the media. “Publishing this list could put the journalists at risk and jeopardize their safety,” Mijatović said. “It’s the government’s responsibility to ensure journalists’ safety; it should not put them in harm’s way based on state prosecutors’ suspicions under an anti-extremism law.” On 12 July, the Federal Financial Monitoring Service, tasked with monitoring legal entities’ and individuals’ compliance with Russia's terrorist and extremist financing legislation, published a searchable list of some six thousand individuals on its website. Previously held confidential, the list includes Crimean journalists Nikolay Semena from the Krym-realii online media, and Anna Andrievskaya from the Centre for Journalistic Investigations. Mijatović noted that she and other intergovernmental bodies have repeatedly pointed to the shortcomings of anti-extremism legislation in Russia and voiced their concerns regarding its application, including past verdicts in relation to journalists and warnings to media entities. “I call on the relevant authorities to take down the list with the names of the journalists and review the policy which puts those exercising their freedom of expression in danger,” Mijatović said. “Labeling journalists as terrorists because of their critical voices and critical reporting cannot be justified.” Mijatović also pointed to a previous public statement in which she criticized amendments to the Criminal Code of the Russian Federation that increased criminal liability for online calls for extremist activity to up to five years in prison (available atwww.osce.org/fom/120175). The first of the workshops, which are being organized in close partnership with the Directorate of the Albanian State Police and the General Directorate of Border and Migration, took place in Korça, where 20 border and migration police were trained on measures to be taken to cope with the situation. The subjects were based on trends as identified by Frontex and EUROPOL, and included migrant routes, the pre-screening of migrants, profiling of possible terrorist fighters, and the detection of criminal offences. The workshop was conducted by experts from the Albanian Europol National Unit and the Albanian Border and Migration Police. During her visit, Thors focused on promoting the effective implementation of the Constitutional Act on the Rights of National Minorities, in particular the provisions regarding languages and scripts; on education matters; and, on issues pertaining to national minorities and good neighbourly relations. Concerned that marginalizing or stigmatizing national minorities poses a threat to the cohesion of society and to bilateral relations, Thors urged the systematic condemnation of discriminatory rhetoric or conduct. “Divisive rhetoric has proven a dangerous path. The more diversity, the richer a society is, as different cultures are the shared wealth of all,” Thors said. “It is crucial to foster a sense of belonging for all members of society in order to effectively promote the integration process,” she added. Thors called for ensuring the protection of the rights of national minorities whilst avoiding polarization of the society along ethnic lines, consistent with The Ljubljana Guidelines on the Integration of Diverse Societies, published by HCNM in 2012. The High Commissioner also emphasized the need for a renewed dialogue between all political and social actors to overcome difficulties, including those related to the protection of minority rights, in a consultative manner. Participants improved their practical skills on analyzing security situations and applying problem-solving methods, and in strengthening effective communication with the police and other stakeholders. The event brought together 23 representatives of the Moldovan Parliament, the authorities of Gagauz-Yeri, civil society and the international community to discuss institutional dialogue between central and Gagauz authorities. Independent researchers from the Comrat-based NGO Piligrim-Demo presented a recent report detailing the joint commissions formed over the years to initiate dialogue on the implementation of Gagauzia’s status as an Autonomous Territorial Unit. They outlined their recommendations for improving the functioning of the current working group established between the Parliament of Moldova and the People’s Assembly of Gagauzia. “Such discussions on the process of dialogue between civil society, the expert community and members of the Parliament and People's Assembly are important as they provide critical input to the process and build common understanding of issues,” said Jale Sultanli, Country Manager Moldova of the Crisis Management Initiative (CMI). Experts from the OSCE Conflict Prevention Centre, the UN Office for Disarmament Affairs and the UN Security Council’s 1540 Committee also attended the meeting, which was hosted by the Ministry of Foreign Affairs of Belarus, and is the second event of its kind to be held in the OSCE region and in the world, and the first to be held in trilateral format. Opening the event, Deputy Foreign Minister of Belarus Valentin Rybakov said that the issues of non-proliferation are among his country’s priorities in the area of international security. He noted that Belarus was the first state of the former Soviet Union to voluntarily refuse the opportunity to possess weapons of mass destruction, and that the withdrawal of such weapons from the country’s territory was completed in 1996. Rybakov added that his country also initiated the adoption of the UN General Assembly resolution on prohibiting the development and manufacture of new types of weapons of mass destruction and new systems of such weapons. Adriana Volenikova of the OSCE Conflict Prevention Centre said regional co-operation on UNSCR 1540-related issues has become one of the most efficient means in bolstering national implementation and enhancing an open dialogue between countries that face similar challenges and benefit from close interaction in related areas.
