(United States Ninth Circuit) - In an action brought under 45 U.S.C. section 1983, seeking to enjoin the California Attorney General from requiring plaintiff to disclose the names and contributions of the it's "significant donors" on Internal Revenue Form 990 Schedule B, which plaintiff must file with the state in order to maintain its registered status with the Registry of Charitable Trusts, the district court's denial of a preliminary injunction is affirmed where: 1) the disclosure requirement did not injure plaintiff's exercise of the First Amendment rights to freedom of association; and 2) the disclosure requirement is not preempted by Congress for privacy purposes under 26 U.S.C. section 6104, part of the Pension Protection Act of 2006.

(Court of Appeals of New York) - In disciplinary proceeding against an attorney for various misconduct, including allegations that he failed to properly supervise the firm's bookkeeper resulting in misappropriation of client funds and that he breached his fiduciary duty by failing to safeguard those funds, the order of the Appellate Division is modified to dismiss the charge for failing to timely comply with the Grievance Committee's lawful demands for information where the imposition of this separate charge is unsupported by the record.

(United States Second Circuit) - Judgment of the Committee on Grievances suspending petitioner-attorney from practicing law in the Southern District of New York for a period of seven years is affirmed, where: 1) there is no error in the committee's conclusion that petitioner violation the New York Code of Professional Responsibility; 2) the Committee acted well within its informed discretion in ordering a seven-year suspension, notwithstanding the lack of directly analogous precedent, based on its conclusion that petitioner's conduct was sui generis.

(United States Second Circuit) - For Attorney Gordon's misconduct in this Court, this Court's Committee on Admissions and Grievances recommended that Gordon be disciplined. This Court adopts the Committee's findings of fact and recommendations, with certain exceptions, publicly reprimands Gordon, and suspends him from practice before this Court for two months, where the Committee found clear and convincing evidence that Gordon engaged in misconduct warranting the imposition of discipline, including but not limited to delayed filings, a lack of candor at the Committee's hearing, and causing unnecessary expense to the public.

(United States Second Circuit) - Affirmed the denial of a motion to dismiss based on foreign sovereign immunity under the Foreign Sovereignty Immunity Act in a securities lawsuit filed by the shareholder of an Argentine petroleum company against the Argentine Republic which held a majority of shares in the company. In affirming the denial and rejecting the claim of sovereign immunity, the appeals court noted that the plaintiff was seeking relief for injuries caused by commercial, rather than sovereign, activity.

(United States Fifth Circuit) - Affirmed. The district court was within its discretion to deny recognition to a Moroccan judgment against a haircare and liqour tycoon in a lawsuit relating to a failed energy provision agreement.

(California Court of Appeal) - In a labor and employment action, arising over a former, female firefighter's claims of harassment and discrimination against the City of Petaluma, the trial court's discovery orders are reversed where: 1) outside counsel's pure fact-finding role in the prelitigation investigation constituted legal services in anticipation of litigation and is privileged; and 2) defendant employer did not waive attorney-client privilege by asserting an avoidable consequences defense under the circumstances.

The district court granted summary judgment in favor of the Plaintiff, but declined to grant Plaintiff a contract with PG&E at a specified price. The Ninth Circuit held that the Re-MAT program violated the PURPA and therefore is preempted by PURPA, but the Ninth Circuit would not grant the contract because PG&E was not a party to the suit.

(United States Third Circuit) - Concluding that a transfer by a non-debtor cannot be a 'fraudulent transfer' under the Delaware Uniform Fraudulent Transfer Act in a complicated case involving Venezuela's nationalization of a gold mine owned by a Canadian company, the debt judgment subsequently issued by the World Bank, and the ensuing financial shuffle among companies related to the original transaction.

(United States Fourth Circuit) - An award of Employee Retirement Income Security Act (ERISA) benefits to a former NFL player displaying symptoms of chronic traumatic encephalopathy (CTE) is affirmed where the board of the NFL Player Supplemental Disability Plan failed to follow a reasoned process or explain the basis of its determination to deny benefits.

(United States Second Circuit) - Held that the Social Security Administration was justified in imposing an assessment and penalty on a recipient of disability benefits who failed to report work activity. The benefit recipient disputed that his failure to report earnings was material. While rejecting his legal challenge, the Second Circuit held that the agency lacked substantial evidence to support the amounts of the assessment and penalty, and therefore vacated and remanded.

(United States Ninth Circuit) - Affirmed.
