ui Reconstructing the reflectivity of liquid surfaces from grazing incidence X-ray off-specular scattering data By journals.iucr.org Published On :: 2024-05-17 The capillary wave model of a liquid surface predicts both the X-ray specular reflection and the diffuse scattering around it. A quantitative method is presented to obtain the X-ray reflectivity (XRR) from a liquid surface through the diffuse scattering data around the specular reflection measured using a grazing incidence X-ray off-specular scattering (GIXOS) geometry at a fixed horizontal offset angle with respect to the plane of incidence. With this approach the entire Qz-dependent reflectivity profile can be obtained at a single, fixed incident angle. This permits a much faster acquisition of the profile than with conventional reflectometry, where the incident angle must be scanned point by point to obtain a Qz-dependent profile. The XRR derived from the GIXOS-measured diffuse scattering, referred to in this paper as pseudo-reflectivity, provides a larger Qz range compared with the reflectivity measured by conventional reflectometry. Transforming the GIXOS-measured diffuse scattering profile to pseudo-XRR opens up the GIXOS method to widely available specular XRR analysis software tools. Here the GIXOS-derived pseudo-XRR is compared with the XRR measured by specular reflectometry from two simple vapor–liquid interfaces at different surface tension, and from a hexadecyltrimethylammonium bromide monolayer on a water surface. For the simple liquids, excellent agreement (beyond 11 orders of magnitude in signal) is found between the two methods, supporting the approach of using GIXOS-measured diffuse scattering to derive reflectivities. Pseudo-XRR obtained at different horizontal offset angles with respect to the plane of incidence yields indistinguishable results, and this supports the robustness of the GIXOS-XRR approach. The two-time correlation function (TTC) is commonly used to track non-equilibrium dynamical evolution in XPCS measurements, with subsequent extraction of one-time correlations. While the theoretical foundation for the quantitative analysis of TTCs is primarily established for equilibrium systems, where key parameters such as the diffusion coefficient remain constant, non-equilibrium systems pose a unique challenge. In such systems, different projections (`cuts') of the TTC may lead to divergent results if the underlying fundamental parameters themselves are subject to temporal variations. ui In situ counter-diffusion crystallization and long-term crystal preservation in microfluidic fixed targets for serial crystallography By journals.iucr.org Published On :: 2024-09-25 Compared with batch and vapor diffusion methods, counter diffusion can generate larger and higher-quality protein crystals yielding improved diffraction data and higher-resolution structures. Typically, counter-diffusion experiments are conducted in elongated chambers, such as glass capillaries, and the crystals are either directly measured in the capillary or extracted and mounted at the X-ray beamline. Despite the advantages of counter-diffusion protein crystallization, there are few fixed-target devices that utilize counter diffusion for crystallization. In this article, different designs of user-friendly counter-diffusion chambers are presented which can be used to grow large protein crystals in a 2D polymer microfluidic fixed-target chip. Methods for rapid chip fabrication using commercially available thin-film materials such as Mylar, propylene and Kapton are also detailed. Rules of thumb are provided to tune the nucleation and crystal growth to meet users' needs while minimizing sample consumption. These designs provide a reliable approach to forming large crystals and maintaining their hydration for weeks and even months. This allows ample time to grow, select and preserve the best crystal batches before X-ray beam time. Importantly, the fixed-target microfluidic chip has a low background scatter and can be directly used at beamlines without any crystal handling, enabling crystal quality to be preserved. The approach is demonstrated with serial diffraction of photoactive yellow protein, yielding 1.32 Å resolution at room temperature. Fabrication of this standard microfluidic chip with commercially available thin films greatly simplifies fabrication and provides enhanced stability under vacuum. The Shanghai HIgh-repetition-rate XFEL aNd Extreme light facility (SHINE) experiences high average thermal power and demands wavefront preservation. To deeply study the thermal field of the first reflection mirror M1 at the FEL-II beamline of SHINE, thermal analysis under a photon energy of 400 eV was executed by fluid and solid heat transfer method. According to the thermal analysis results and the reference cooling water temperature of 30 °C, the temperature of the cooling water at the flow outlet is raised by 0.15 °C, and the wall temperature of the cooling tube increases by a maximum of 0.5 °C. The maximum temperature position of the footprint centerline in the meridian direction deviates away from the central position, and this asymmetrical temperature distribution will directly affect the thermal deformation of the mirror and indirectly affect the focus spot of the beam at the sample. ui Development of hard X-ray photoelectron spectroscopy in liquid cells using optimized microfabricated silicon nitride membranes By journals.iucr.org Published On :: 2024-10-15 We present first hard X-ray photoelectron spectroscopy (HAXPES) results of aqueous salt solutions and dispersions of gold nanoparticles in liquid cells equipped with specially designed microfabricated thin silicon nitride membranes, with thickness in the 15–25 nm range, mounted in a high-vacuum-compatible environment. The experiments have been performed at the HAXPES endstation of the GALAXIES beamline at the SOLEIL synchrotron radiation facility. The low-stress membranes are fabricated from 100 mm silicon wafers using standard lithography techniques. Platinum alignment marks are added to the chips hosting the membranes to facilitate the positioning of the X-ray beam on the membrane by detecting the corresponding photoemission lines. Two types of liquid cells have been used, a static one built on an Omicron-type sample holder with the liquid confined in the cell container, and a circulating liquid cell, in which the liquid can flow in order to mitigate the effects due to beam damage. We demonstrate that the membranes are mechanically robust and able to withstand 1 bar pressure difference between the liquid inside the cell and vacuum, and the intense synchrotron radiation beam during data acquisition. He was the first African American hired for The Tonight Show band. He mentored the teenage prodigies Miles Davis and Quincy Jones. But Terry isn't as well known as you might think he'd be. Thanks to the new documentary, "Keep On Keepin' On," you can see Clark Terry — or C.T., as everyone calls him — in action. The film tells the story of Terry's early love of the trumpet, his quick rise through the jazz ranks, and how he's devoted much of his life to inspiring other musicians — all with a sparkle in his eye. The movie is directed by first time filmmaker Alan Hicks and made on a shoestring budget. Hicks is himself a drummer and had been one of Terry's students. Originally it was going to be a short film about Terry and Hicks' relationship, funded by the Australian Broadcasting Company. (Hicks is from Australia.) When that financing fell through, Hicks improvised. Determined to tell the world about Terry, he and a childhood buddy, Adam Hart, decided to do it themselves — despite having no filmmaking experience. They bought a camera and plane tickets to the U.S. and began following Terry. For many years their schedule was to shoot until they ran out of funds, usually about three months, work for a few months to save more money, then go back to shooting. To demonstrate how Terry mentors his students, they followed one young man in particular. Justin Kauflin is a blind jazz pianist with stage fright who would spend days and nights practicing at Terry's bedside. Over the course of the film, as we learn about Terry's past, we see the aging trumpeter in the present (he's now 93) — struggling with advanced diabetes, but always composing riffs from his bed late into the night. In one moving scene, Kauflin is riddled with anxiety as he prepares to compete in the Thelonious Monk International Jazz competition. Terry sends him an audio letter and some lucky socks for inspiration. Years into the project, when Quincy Jones came to visit Terry, he met Kauflin and the filmmakers. Eventually Jones signed on as an executive producer of "Keep On Keepin' On" — as is only fitting given that, at age 13, he'd been Terry's first student. The first project under review is about 150 kilometers north of Matagami, where there is a small town with a rail link to much of James Bay, and has the Billy Diamond Highway running through it. American Salars said it's close to Q2 Metals Corp. (QTWOTSX-V; OTCQB:QUEXF) Cisco Lithium Project, which reported drill intercepts of 215.6 meters at 1.69% Li2O, including 64.6 meters at 2.29%. Also nearby are multiple projects owned by Sayona Mining Ltd (SYA:ASX), which is currently Canada's only lithium producer. "Our primary objective remains the acquisition of low-cost lithium brine assets in Argentina while expanding our existing NI 43-101 lithium brine resources," said Chief Executive Officer and Director R. Nick Horsley. "We believe that Quebec-based hard rock lithium assets can now be acquired at deeply discounted prices and advanced with critical mineral flow through financing incentives in anticipation of the next lithium rally." American Salars said it is reviewing additional projects close to Sayona, which will be subject to disclosure "once due diligence is completed and a deal is completed." The company stressed that its "intent to acquire property and current strategic review does not necessarily mean that a transaction will occur." Current Assets Also in Argentina, Nevada The company's existing portfolio of lithium deposits includes two NI 43-101-compliant Inferred Mineral Resource Estimates (MREs) consisting of 457,000 tonnes of lithium carbonate equivalent (LCE) at the Candela 2 Lithium Brine Project and a shared MRE at the Pocitos 1 Lithium Brine Project consisting of 760,000 tonnes LCE. The Pocitos MRE is shared with the neighboring Pocitos 2 property, which is not under contract or owned by American Salars, but the company noted that none of the drilling that makes up a partial basis for the MRE took place on the Pocitos 2 block. Both brine projects are located in Salta Province, Argentina. Major mining company Rio Tino recently invested in Argentina by acquiring Argentina lithium producer Arcadium Lithium for US$6.7 billion, making the company the world's third-largest lithium producer. American Salars recently released assay results from soil samples collected during its Phase 1 exploration program at its 100%-owned Black Rock South lithium project close to Tesla's Gigafactory in Nevada. Technical Analyst Clive Maund wrote that the entire "San Emidio Desert basin is a highly prospective lithium exploration zone and is about 38 kilometers long and up to 11 kilometers wide at the widest point, with the central playa measuring about 8.5 kilometers north-south and 4.5 kilometers east-west." Out of 38 samples, 33 recorded lithium concentration of more than 100 parts per million (ppm) or higher, the company said. The highest grade was 180.5 ppm with an average grade of 131 ppm across the 33 samples of the surface of the property. Technical Analyst Clive Maund wrote that the entire "San Emidio Desert basin is a highly prospective lithium exploration zone and is about 38 kilometers long and up to 11 kilometers wide at the widest point, with the central playa measuring about 8.5 kilometers north-south and 4.5 kilometers east-west."* "After a massive speculative runup in 2020 and especially in 2021, the lithium price fell victim to a severe bear market that ran from mid-2022 through the end of 2023," Maund continued. "By the end of last year, this bear market had exhausted itself, and a basing process began that has continued up to the present." In addition to its location near the Gigafactory, Black Rock South is 93 miles southwest of Thacker and 215 miles northwest of the United States' only producing lithium mine, the Silver Peak lithium brine mine owned by Albermarle. The Catalyst: More Growth Coming Lithium is critical in the energy transition for its use in batteries for EVs and other applications. It also is used in electronics, medicine and other industries. According to a report by Grand View Research, market size for the metal was estimated at US$31.75 billion last year and is projected to grow at a compound annual growth rate (CAGR) of 17.7% from this year through 2030. "The automotive application segment is expected to witness substantial growth, driven by stringent regulations imposed by government bodies on ICE automakers to reduce carbon dioxide emissions from vehicles," researchers at Grand View said. "This has shifted the interest of automakers toward producing EVs, which is anticipated to benefit the demand for lithium and related products." EVs and battery storage primarily will fuel future growth of the lithium market, Marin Katusa of Katusa Research wrote recently. He pointed out that all major electric vehicle batteries require lithium, about 1.55 pounds per kilowatt hour of battery capacity, on average. "I think the data speaks for itself that there's more growth and opportunity on the horizon," Katusa wrote. According to FastMarkets, prices for the metal have fallen over the past 18 months as weaker demand improved availability. However, this "has done little to deter the appetite for expansion," raw battery materials analyst Jordan Roberts told the publication.[OWNERSHIP_CHART-11095] The consensus among market analysts points to a recovery in lithium prices in the fourth quarter of 2024, Fastmarkets reported. "This is the company's entry point into Quebec with the intention of building a strategic portfolio of hard rock lithium projects to complement our lithium brine assets," Director and Chief Executive Officer R. Nick Horsley said. "The company's long-term belief in a lithium price rebound is steadfast and now is the time to build a multi-jurisdictional lithium company." The Lac Simard South project is about 80 kilometers southwest of Sayona’s Authier lithium project and spans the townships of Beauneville, Clérion, Delbreuil, and ChabertIt, and is accessible by gravel road off Route 117 near the municipality of Cadillac, American Salars said. "The claims in the eastern sector are accessible by a network of logging roads; the southern and western sectors are accessible by boat or all-terrain vehicle and has very little overburden," the company said in a release. Technical Analyst Clive Maund wrote that the entire "San Emidio Desert basin is a highly prospective lithium exploration zone." The company's existing portfolio of lithium deposits includes two NI 43-101-compliant Inferred Mineral Resource Estimates (MREs) consisting of 457,000 tonnes of lithium carbonate equivalent (LCE) at the Candela 2 Lithium Brine Project and a shared MRE at the Pocitos 1 Lithium Brine Project consisting of 760,000 tonnes LCE. The Pocitos MRE is shared with the neighboring Pocitos 2 property, which is not under contract or owned by American Salars, but the company noted that none of the drilling that makes up a partial basis for the MRE took place on the Pocitos 2 block. Both brine projects are located in Salta Province, Argentina. Major mining company Rio Tino recently invested in Argentina by acquiring Argentina lithium producer Arcadium Lithium for US$6.7 billion, making the company the world's third-largest lithium producer. American Salars also recently released assay results from soil samples collected during its Phase 1 exploration program at its 100%-owned Black Rock South lithium project close to Tesla's Gigafactory in Nevada. Out of 38 samples, 33 recorded lithium concentration of more than 100 parts per million (ppm) or higher, the company said. The highest grade was 180.5 ppm with an average grade of 131 ppm across the 33 samples of the surface of the property. 'Basing Process' Underway for Commodity Technical Analyst Clive Maund wrote that the entire "San Emidio Desert basin is a highly prospective lithium exploration zone."* "After a massive speculative runup in 2020 and especially in 2021, the lithium price fell victim to a severe bear market that ran from mid-2022 through the end of 2023," Maund wrote. Black Rock South is also 215 miles northwest of the United States' only producing lithium mine, the Silver Peak lithium brine mine owned by Albermarle. The Catalyst: Experts Predict Recovery Lithium is critical in the energy transition for its use in batteries for electric vehicles (EVs) and other application and is also used in electronics, medicine, and other industries. While prices have slumped this year after EV sales didn't hit predicted marks, many experts believe the market will recover. According to a report by Grand View Research, market size for the metal was estimated at US$31.75 billion last year and is projected to grow at a compound annual growth rate (CAGR) of 17.7% from this year through 2030. "The automotive application segment is expected to witness substantial growth, driven by stringent regulations imposed by government bodies on ICE automakers to reduce carbon dioxide emissions from vehicles," researchers at Grand View said. "This has shifted the interest of automakers toward producing EVs, which is anticipated to benefit the demand for lithium and related products." EVs and battery storage primarily will fuel future growth of the lithium market, Marin Katusa of Katusa Research wrote recently. Their new study provides insights into the molecular mechanisms of competition among bacteria. "Many organisms, including humans, acquire bacteria from their environment," said Tim Miyashiro, a biochemist and molecular biologist at Penn State and the leader of the research team. "These bacteria can contribute to functions within the host organism, like how our gut bacteria help us digest food. We're interested in the interactions among bacteria cells, and between bacteria and their hosts, to better understand these mutually beneficial symbiotic relationships." Cells of the bioluminescent bacteria Vibrio fisheri take up residence in the light organ of newly hatched bobtail squid. At night, the bacteria produce a blue glow that researchers believe obscures a squid's silhouette and helps protect it from predators. The light organ has pockets, or crypts, in the squid's skin that provide nutrients and a safe environment for the bacteria. "When the squid hatches, it doesn't yet have any bacteria in its light organ," said Miyashiro. "But bacteria in the environment quickly colonize the squid's light organ." Some of these different bacteria strains can coexist, but others can't. "Microbial symbioses are essentially universal in animals, and are crucial to the health and development of both partners," says Irwin Forseth, a program director in the National Science Foundation's Division of Integrative Organismal Systems, which funded the research. "The results from this study highlight the role small genetic changes can play in microbe interactions. "Our complaint alleges that recent changes to Georgia's election laws were enacted with the purpose of denying or abridging the right of Black Georgians to vote on account of their race or color, in violation of Section 2 of the Voting Rights Act," Garland said at a news conference. The lawsuit marks the first major action from the Biden administration to combat a series of new restrictive voting measures passed by Republican-led state legislatures. And it came on the eighth anniversary of the U.S. Supreme Court decision to gut another key provision of the landmark Voting Rights Act, Section 5. Garland noted that Georgia experienced record voter turnout and participation in the 2020 election cycle. In March, Georgia Gov. Brian Kemp, a Republican, signed Senate Bill 202, a 98-page omnibus measure that makes sweeping changes to the state's absentee voting rules, adds new voter identification mandates and nearly cuts in half the amount of time for voters to request a mail-in ballot. It also expands early voting access for most counties and formally codifies Sunday voting hours as optional. The legislation outlaws passing out food or drinks to voters within 150 feet of a polling place or too close to voters waiting in line, a provision that Assistant Attorney General Kristen Clarke, who heads the department's Civil Rights Division, highlighted at the press conference. "Historically, minority voters in Georgia have been disproportionately more likely to wait in long lines to vote in person on Election Day," she said. "Given those long and protracted wait times, civic groups, including churches, have at times provided food and water to voters in line to make their wait more comfortable. As we allege in our complaint, this needless ban was passed with unlawful discriminatory intent." Clarke also said the Georgia Legislature passed the bill through "a rushed process that departed from normal practice and procedure." "The version of the bill that passed the state Senate ... was three pages long. Days later, the bill ballooned into over 90 pages in the House. The House held less than two hours of floor debate on the newly inflated SB 202 before Gov. Kemp signed it into law the same day," she said. "These legislative actions occurred at a time when the Black population in Georgia continues to steadily increase, and after a historic election that saw record voter turnout across the state, particularly for absentee voting, which Black voters are now more likely to use than white voters." Garland said the lawsuit is the first of "many steps" the department is taking to protect the right to vote for all eligible voters. He said the Civil Rights Division will continue to examine voting laws that other states have passed. "We will not hesitate to act," Garland said. The Justice Department announced this month it would vigorously defend voting rights. Garland said that the department will double the number of voter enfranchisement lawyers and focus attention on litigation related to voting rights. In response to the filing, Kemp said the lawsuit is "born out of the lies and misinformation the Biden administration has pushed against Georgia's Election Integrity Act from the start." "[Biden and his allies] are weaponizing the U.S. Department of Justice to carry out their far-left agenda that undermines election integrity and empowers federal government overreach in our democracy," he said in a statement. Georgia Secretary of State Brad Raffensperger, another Republican who notably defended the state's administration of the 2020 election, said in a statement he "looks forward to ... beating [the administration] in court." Garland's announcement comes just days after Senate Republicans united to block Democrats' attempts to pass sweeping voting rights legislation. Senate Judiciary Chairman Dick Durbin, D-Ill., tweeted his approval of the lawsuit shortly after the announcement Friday. "If Republicans think the fight for voting rights ended with their filibuster of the For the People Act, they are sorely mistaken," he wrote. "Glad to see the Biden Administration is joining this effort. We must protect our democracy." The Republican National Committee also linked the failed Senate vote to the Department of Justice's lawsuit. "We are totally surprised by this unexpected honor," said Ronald Rael, who designed the project with fellow architect Virginia San Fratello. They share the award, he said, with the Ciudad Juárez, Mexico-based art collective Colectivo Chopeke. "That's amazing," San Fratello said in a video feed announcing the prize. The seesaw installation won both the overall prize and in the transportation category. "Most importantly, it comes at a time when we are hopeful for change and that we start building more bridges instead of walls," Rael added. "The Beazley Designs of the Year are the Oscars of the design world," said Razia Iqbal, a journalist who chaired the Design Museum's panel of judges. The award, she noted, highlights work that pushes boundaries of creativity and innovation. The metal wall was meant to be a stark barrier dividing the U.S. and Mexico, the centerpiece of President Trump's aggressive immigration policies. But in one spot, it became a junction point instead – a fulcrum for a series of seesaws that let children in the two countries share a playground toy. The project, officially named Teeter-Totter Wall, was first installed in July 2019 when workers slid steel beams through the slats of the border near El Paso, Texas, and Ciudad Juárez. "For the first time, children from both El Paso, Texas, and the Anapra community in Mexico were invited to connect with their [neighbors], in an attempt to create unity at the politically divisive border," the museum said. "Everyone was very happy and excited to engage the seesaws," Rael told NPR at the time. The installation went smoothly, turning an idea that had been growing for 10 years into a reality. "It was peaceful and fun — a day at a park for the children and mothers of Anapra," Rael said. "The project resonated with people around the world in a way that we didn't anticipate," San Fratello said when the award was announced. "It speaks to the fact that most people are excited about being together, and about optimism and about possibility and the future. And the divisiveness actually comes from the minority." Rael is a professor at the University of California, Berkeley; San Fratello teaches at San José State University. The seesaw project was chosen out of more than 70 nominees from dozens of countries, including a customized "stab-proof vest" that the artist Banksy designed for musician Stormzy. Also considered: the gray and red rendering of SARS-CoV-2, the virus that causes COVID-19. Commissioned by the U.S. Centers for Disease Control and Prevention and designed by Alissa Eckert and Dan Higgins, the famous sphere, with its menacing clusters of crowns, won the design award in the graphics category. The two actors who filed the suit have agreed to drop their claims. In 2019, Sarah Tither-Kaplan and Toni Gaal alleged that James Franco's Studio 4 acting school sexually exploited female students. The complaint, filed in Los Angeles Superior Court, also alleged fraud and sought to represent more than 100 former female students at the now defunct Studio 4. Vince Jolivette, Jay Davis and Franco's RabbitBandini Productions were also named in the suit which accused Studio 4 of setting out to "create a steady stream of young women to objectify and exploit." According to their joint status report filed on Feb. 11, Tither-Kaplan and Gaal agreed to drop their individual claims. The Sexual Exploitation Class claims will also be dismissed. NPR is reaching out to both parties for comment. The original complaint was filed shortly after Franco won a Golden Globe for his performance in The Disaster Artist. Franco denied the allegations. In a statement to NPR at the time, his attorney said "James will not only fully defend himself, but will also seek damages from the plaintiffs and their attorneys for filing this scurrilous publicity seeking lawsuit." In 2016, Franco made a docuseries based on his Sex Scenes class at Studio 4 that he posted on his Facebook page. The videos have since been taken down, but one is still available on Vimeo. Tither-Kaplan, who was a student in the class, told NPR she thought it would teach her how to "maneuver in sex scenes professionally as an actor," but it "did not do that at all." According to Tither-Kaplan, the class did not explain industry standards such as "nudity riders, the detail required in them, the right to counsel with the director about nude scenes, the custom to choreograph nude scenes ahead of time to negotiate them with the cast and the director — I knew none of that throughout that class." According to the parties' agreement, the allegations of fraud will be "subject to limited release." It is not clear whether monetary payments are involved. Yet the study arrives as states and school districts across the country have begun scaling back or simply dropping their masking requirements for staff and students alike. With the majority of school-age children still too young to qualify for vaccination, Friday's research is the latest salvo in a simmering fight between public health officials and politicians — with parents lining up on both sides. The new study comes from Georgia and compares COVID-19 infection rates across 169 K-5 schools. Some schools required teachers, staff and sometimes students to wear masks; some did not. Between Nov. 16 and Dec. 11, researchers found that infection rates were 37% lower in schools where teachers and staff members were required to wear masks. The difference between schools that did and did not require students to wear masks was not statistically significant. This is one more study showing that masking, among other mitigation efforts, "can reduce infections and ultimately save lives," said Dr. Sean O'Leary, a professor of pediatrics at the University of Colorado and vice chair of the Committee on Infectious Diseases for the American Academy of Pediatrics. O'Leary points to a previous CDC study, of schools in Florida, that also found "a strong association with student mask requirements and lower rates of infections in students." Like any study, Friday's release comes with caveats. Only 12% of schools invited to share their data did so. And it's always worth remembering: Correlation is not causation. Still, the results offer an important warning to states and school districts that are now lifting their school-based mask requirements, especially for adults: It's safer if you don't. The latest, and perhaps broadest effort to change schools' masking policies comes from Texas, where Republican Gov. Greg Abbott issued an executive order Tuesday banning all mask mandates in the state's public schools. After June 4, the order says, "no student, teacher, parent or other staff member or visitor may be required to wear a face covering." For Abbott, and many opponents of mask mandates, the move is about restoring a balance between safety and freedom. "We can continue to mitigate COVID-19 while defending Texans' liberty to choose whether or not they mask up," he said in announcing the order. Zeph Capo, president of the Texas American Federation of Teachers, called the move "unconscionable" in a statement. "The governor's new verdict takes a blanket approach to addressing what is still extremely dangerous for some Texans — a return to school unmasked." And Texas isn't alone. On Thursday, Iowa's Republican governor, Kim Reynolds, also signed a law banning schools from requiring masks. The justification is similar: "I am proud to be a governor of a state that values personal responsibility and individual liberties," Reynolds said in a statement. "Whether a child wears a mask in school is a decision that should be left only to a student's parents," South Carolina Gov. Henry McMaster said last week as he issued an executive order allowing parents to opt their children out of school-based mask requirements. Public health experts have been quick to sound the alarm. "All along in this pandemic, we have seen the tragic consequences when politics start to play a role in public health decisions. And to me, this kind of maneuver smells like politics — to ban the requirements that are ultimately there to save lives," O'Leary said. "The body of evidence shows us that masks work." And Dr. Aaron Milstone, a professor of pediatric infectious diseases at Johns Hopkins, likens the banning of mask mandates to having a variable speed limit. "Unfortunately, with contagious diseases the decisions I make impact someone else," Milstone said. "It would be like saying: You can drive 55 mph if you think that's safe for you, but if someone else thinks they can safely drive 90 mph, their choice may wind up risking your life." While the CDC recently scaled back its masking guidance for people who are fully vaccinated, the agency also reiterated that schools should continue to require universal masking, at least through the end of the current school year. Though one vaccine has been approved for use for 12- to 15-year-olds, those kids won't be considered fully vaccinated for another month. Milstone said it's simply too early to talk about schools without masking. "Until vaccines are eligible for all children, it's hard to abandon the practices that we know work the best to prevent the spread of COVID." Dr. Anthony Fauci, chief medical adviser to the White House, told CNBC this week that it is conceivable the CDC could recommend that middle and high schools be mask-free in the fall — if, that is, enough students 12 years of age and older get vaccinated. Eric Holcomb in an attempt to block the state's push to end pandemic unemployment benefits on June 19. Indiana Legal Services, an organization providing free legal assistance, and the Concerned Clergy of Indianapolis filed the lawsuit on behalf of five unnamed plaintiffs who are set to lose their jobless benefits. The complaint was filed Monday in Marion County Superior Court. This lawsuit may be the first of its kind that aims to stop states from ending these benefits earlier than Congress mandated. The unemployment insurance program "has served as a vital lifeline for thousands of Hoosiers," the complaint, reviewed by NPR, says. "By prematurely deciding t0 stop administering these federal benefits, Indiana has violated the clear mandates 0f Indiana's unemployment statute—to secure all rights and benefits available for unemployed individuals." Indiana is one of 25 Republican-led states that decided to end jobless aid in an effort to get people to return to work. Indiana and seven other states are set to end expanded unemployment benefits as soon as this weekend. This is despite Congress's authorization for extra payments until early September. Those benefits include the extra $300 a week in federal aid and the special pandemic program for gig workers that allows them to receive jobless benefits. Ordinarily, independent contractors wouldn't be eligible. Plaintiffs, as well as many other Indiana residents, rely entirely on the unemployment benefits to pay for food and rent and to care for their families, the complaint alleges. Attorneys in this case are requesting the judge approve a preliminary injunction that would allow people to receive their benefits while the case continues. Holcomb says it's time to get back to work Holcomb told The Indianapolis Star that people no longer need unemployment benefits as the state has a plethora of jobs open. "Eliminating these pandemic programs will not be a silver bullet for employers to find employees, but we currently have about 116,000 available jobs in the state that need filled now," he said. According to the governor's office, Indiana's unemployment rate has recovered to 3.9% after climbing to 17% at the height of the pandemic. The lawsuit challenges Holcomb's assertion. Each of the five plaintiffs say they are unable to return to work due to lingering injuries or disability, health conditions that put them at risk for COVID-19 exposure, dependent children at home and no childcare available, or no positions that are available in their career field. Millions of Americans still heavily rely on jobless aid as the country slowly reopens from pandemic-induced lockdowns, according to the organization. As of May 22, more than 15.3 million people still needed some form of unemployment benefit—nearly twice the number who received payments when the aid programs began in late March 2020, NELP said. According to its analysis, over 46% of unemployment insurance recipients in the states ending the programs early are people of color. ui Prosecutors Get Their 1st Guilty Plea In The Jan. 6 Oath Keepers Conspiracy Case By www.scpr.org Published On :: Wed, 23 Jun 2021 16:20:11 -0700 Ryan Lucas | NPR Updated June 23, 2021 at 6:56 PM ET Federal prosecutors secured their first guilty plea Wednesday in the Justice Department's sprawling conspiracy case involving the Oath Keepers extremist group in connection with the Jan. 6 attack on the U.S. Capitol. At a hearing in federal court in Washington, D.C., Graydon Young pleaded guilty to one count of conspiracy and one count of obstruction of an official proceeding. The 55-year-old Florida resident agreed to cooperate with investigators, which could prove critical as the government pursues the remaining defendants in the high-profile case. Young is one of 16 people associated with the Oath Keepers to be charged with conspiracy, obstruction and other offenses over the Capitol riot. Prosecutors say the defendants coordinated their efforts and actions to try to disrupt Congress' certification of the Electoral College count on Jan. 6. More than 500 people have been charged so far in connection with the Capitol breach, but the Oath Keepers conspiracy case is one of the most closely watched because of the allegations and the link to an extremist organization. Young is the second defendant linked to the Oath Keepers to plead guilty. Jon Schaffer pleaded guilty to obstructing an official proceeding and entering restricted grounds with a dangerous weapon in April. According to Young's statement of offense, he coordinated with his co-conspirators ahead of Jan. 6 and used encrypted messaging apps to maintain "operational security." On the day itself, the document says, Young and some of his co-conspirators pushed through U.S. Capitol Police lines guarding the Capitol and into the building. "Mr. Young believed that he and the co-conspirators were trying to obstruct, influence, and impede an official proceeding, that is, a proceeding before Congress, specifically, Congress's certification of the Electoral College vote," the document says. At Wednesday's hearing, Judge Amit Mehta read that passage to Young to ensure that it was accurate. "Yes, sir," Young replied, "that is correct." According to the plea deal, Young has agreed to cooperate fully with prosecutors, including sitting for interviews with investigators and testifying before the grand jury and at trial. The government, meanwhile, has agreed to dismiss the remaining charges against him. Even so, Mehta said Young is facing a possible prison sentence of 5 to 6 1/2 years under the sentencing guidelines. Wednesday brought another significant development in the Capitol investigation. Anna Morgan-Lloyd, a 49-year-old from Indiana who described Jan. 6 as the "best day ever," became the first Capitol riot defendant to be sentenced. Morgan-Lloyd was not accused of taking part in any of the violence at the Capitol. She pleaded guilty to a single misdemeanor count of "parading, demonstrating, or picketing in a Capitol building." Mark Grods entered a plea of guilty to one count of conspiracy and one count of obstruction of an official proceeding. According to the statement of offense, the conspiracy's aim was to stop Congress' certification of the Electoral College count. The plea marks another step forward for prosecutors pursuing a broader conspiracy case against 16 alleged members or associates of the Oath Keepers, a far-right, anti-government group. Last week, one of the defendants in that case pleaded guilty to conspiracy and obstruction, and agreed to cooperate with investigators. Grods, who was charged separately but admitted to having coordinated with members of the Oath Keepers, has also agreed to cooperate with the government, including testifying before a grand jury or at trial. In a court filing, prosecutors said Grods' case "is part of an ongoing grand jury investigation and plea negotiation related to United States v. Thomas Caldwell, et al.," which is the government's Oath Keepers conspiracy case. At a court hearing Wednesday in Washington, D.C., just blocks from the Capitol, U.S. District Court Judge Amit Mehta went over the charges and the terms of Grods' plea deal, and told him his estimated sentencing guidelines range was 51 to 63 months. "How do you plead on count one, the charge of conspiracy, sir?" Mehta asked. "Guilty," Grods said. "Count two, obstruction of an official proceeding, how do you plead, sir?" Mehta asked. "Guilty," Grods replied again. In his statement of offense, Grods admits to bringing firearms to Washington, D.C., and then stashing them across the Potomac River at a Virginia hotel — a detail the government says buttresses its argument that the Oath Keepers prepared for violence on Jan. 6. The government alleges the group planned to store weapons in Virginia and ferry them into Washington, D.C., on Jan. 6 if the situation in the city got messy. Grods' statement of offense says on Jan. 6, he rode in a golf cart with others through the city before parking a few blocks away from the Capitol and walking the rest of the way. He then linked up with other alleged Oath Keepers, who forged their way through the crowd, up the steps of the Capitol in a military-style "stack" formation and into the building itself. Other members of the "stack" have been charged in the Oath Keepers conspiracy case. Four minutes after entering the Capitol, the statement of offense says, Grods left the building as police shot pepper balls at a wall near him. Two days after the assault on the Capitol, an unnamed individual told Grods to "make sure that all signal comms about the op has been deleted and burned," according to the statement of offense, which Grods confirmed he had done. It is unclear how much additional information Grods will be able to provide investigators, but his plea agreement — the second in the span of a week — may prompt other defendants in the case to cut deals with prosecutors as well.
