The other appeal (No.7of 2013) has been preferred by Federation of Indian Airlines (FIA) which has challenged the legality etc. of a subsequent Order No.30/2012-13 dated 28.12.2012 issued by AERA in exercise of powers under Section 13(1)(b) of the AERA Act read with Section 22A of the Airports Authority of India Act 1994(AAI Act) to re-determine the amount of DF at IGI Airport, New 4 Delhi. By this order AERA reviewed the earlier DF Order dated 14.11.2011 in a small measure, reduced the rate of DF w.e.f. 01.01.2013 and extended the levy period upto April, 2016 subject to further review. The FIA, it appears, had challenged the earlier DF order dated 14.11.2011 also. Its stand is that levy of DF to bridge the funding gap for IGI Airport is contrary to law and the relevant agreements which cast a duty upon DIAL to arrange for funds for development of the Airport. It is also pleaded that the project cost has been blown-up beyond realistic proportions and AERA has failed to exercise the required level of scrutiny which would have kept the final project cost at a reasonable and permissible level.

1. The present Execution Petition is filed by Tata Power Delhi Distribution Page 1 of 25 EP No.09 of 2016 in A. No. 171 of 2012 Limited ("TPDDL/Petitioner") for execution of the Judgment dated 10.02.2015 passed by this Tribunal in Appeal No. 171 of 2012. The Appellant West Bengal State Electricity Distribution Company (WBSEDCL) has come up with the present appeal challenging the order dated 01.11.2019 of Central Electricity Regulatory Commission (the Central Commission) in Petition No. 298/MP/2018 which had been instituted by the Respondent Damodar Valley Corporation (DVC) seeking declaration as to right to recover a sum aggregating Rs.111,74,47,434 Crores towards principal and delayed payment surcharge at the rate of 1.5% per month as on 31.08.2019 along with further interest till payment. There are differences in the assessment and restriction of chemicals exempt from the EU’s regulatory instrument REACH. A new study has analysed the differences between several regulatory frameworks that govern these chemicals and recommended greater harmonisation in assessment criteria and regulatory follow-up.

According to most EU legislation, regulatory assessment of chemicals should make use of all available and relevant studies. However, in practice, assessments tend to be predominantly based on research sponsored and provided by industry as part of their legal obligations to show safety of their products, rather than on independent peer-reviewed findings. To bridge this science–policy gap, a team of Swedish researchers, in combination with regulators at three Swedish governmental agencies, have published a list of recommendations aimed at increasing the regulatory usability and impact of academic research. This advice is aimed at researchers, for whom it clarifies relevant regulatory data requirements and quality criteria. However, it is also relevant to policymakers, in that it highlights the advantages and availability of relevant, reliable peer-reviewed research for use in the regulatory assessment of chemicals. The study’s recommendations contribute to the formulation of more science-based, sustainable policies.
