Seasonal neighbors: residential development encroaches on mule deer winter range in central Oregon.

Mule deer populations in central Oregon are in decline, largely because of habitat loss. Several factors are likely contributors. Encroaching juniper and invasive cheatgrass are replacing deer forage with high nutritional value, such as bitterbrush and sagebrush. Fire suppression and reduced timber harvests mean fewer acres of early successional forest, which also offer forage opportunities. Human development, including homes and roads, is another factor. It is this one that scientists with the Pacific Northwest Research Station and their collaborators investigated in a recent study.

Growing up in Western Pennsylvania, it was almost a given that young children watched at least a few episodes of “Mister Rogers’ Neighborhood.” And I’m pretty sure I watched more than just a few! I remember well the episode where we saw how crayons were made, as well as the episode where Mister Rogers visited a lighthouse. The Land of Make Believe was a familiar place – both on the show, and the ride at Idlewild Park, which my family and I visited several summers in a row. So it was with no small amount of nostalgia that I started the new book by Maxwell King – “The Good Neighbor: The Life and Work of Fred Rogers.” My nostalgia was only deepened by the fact that I listened to the audiobook version, narrated by none other than LeVar Burton of “Reading Rainbow,” another touchstone from my childhood. Branches Neighborhood Corp. v. CalAtlantic Group, Inc.

(California Court of Appeal) - Upheld an arbitrator's decision in favor of a builder in a dispute with a community association over alleged defects in construction. The association, consisting of residential condominium units, argued that its arbitration claim should not have been dismissed on summary judgment even though the association had filed the claim without first receiving the consent of its members, in violation of its declaration of Covenants, Conditions and Restrictions. Agreeing with the builder, the California Fourth Appellate District affirmed denial of the association's motion to vacate the arbitrator's decision.

(United States Ninth Circuit) - In a case challenging California's "Shark Fin Law," which makes it "unlawful for any person to possess, sell, offer of sale, trade, or distribute a shark fin" in the state, the district court’s dismissal of plaintiff's amended complaint is affirmed where the claim that the Shark Find Law is preempted by the Magnuson-Stevens Fishery Conservation and management Act is without merit, as plaintiffs failed to identify any actual conflict between federal authority under the Magnuson-Stevens Act to manage shark fishing in the ocean off the California coast and the California Shark Fin Law.
