The retiree, who had served in both the military and civilian sectors of the U.S. government, argued that he was entitled to civilian service credit for additional discrete time periods of his government service. On his petition for review of a Merit Systems Protection Board decision, the Federal Circuit affirmed in part and reversed in part.

(United States Third Circuit) - Sentence for conviction of securities fraud, 15 U.S.C. section 78j(b), and tax evasion, 26 U.S.C. section 7201, is affirmed where: 1) despite defendant's failure to register as such, he was an 'investment adviser,' as defined by the Investment Advisers Act of 1940, 15 U.S.C. section 80b-2(a)(11), and the District Court therefore properly applied the investment advisor enhancement under U.S.S.G. section 2B1.1(b)(19)(A)(iii); 2) the Government did not breach the plea agreement; and 3) the sentence is not substantively unreasonable.

(United States Third Circuit) - Dismissal of plaintiff's suit, alleging trade-dress infringement and tortious interference, for lack of personal jurisdiction is reversed were defendant had sufficient contacts with New Jersey.

(Court of Appeals of New York) - Conviction for manslaughter is reversed where the trial court abused its discretion by prohibiting defense counsel from questioning prospective jurors about their views on involuntary confessions.

(California Court of Appeal) - Revived an automobile lessee's lawsuit against a car dealership. Held that the dealership did not make a timely and appropriate offer to correct the alleged issue, for purposes of California's Consumer Legal Remedies Act. Reversed a summary judgment ruling.

(California Court of Appeal) - Held that a truck driver did not have to arbitrate his claim for unpaid wages. He fell within the Federal Arbitration Act's exemption for transportation workers engaged in interstate commerce. Affirmed the ruling below.
