Today I will address other national security investigative authorities enacted or amended as part of the USA PATRIOT Act, focusing in particular on the legal authorities relating to national security letters.

The United States is seeking an order from a federal court in San Francisco authorizing the IRS to request information from HSBC Bank USA, N.A. about U.S. residents who may be using accounts at The Hong Kong and Shanghai Banking Corporation in India (HSBC India) to evade federal income taxes.

"The department has organized itself to ensure that we are in a position to aggressively investigate and prosecute cyber crime wherever it occurs," said Deputy Assistant Attorney General Weinstein.

Dr. Arvind Ahuja of Greendale, Wis., was indicted today by a federal grand jury in Milwaukee on four counts of willfully filing materially false tax returns and four counts of failing to file Reports of Foreign Bank and Financial Accounts.

A superseding indictment was returned today in Milwaukee against Dr. Arvind Ahuja of Greendale, Wis., adding a charge of conspiracy to defraud the Internal Revenue Service.

"The fight against transnational organized crime is one of the highest enforcement priorities of the Department of Justice and the Administration," said Assistant Attorney General Breuer.

First Niagara Bank N.A. and HSBC Bank USA N.A. agreed to sell 26 branch offices in the Buffalo, N.Y., area with approximately $1.6 billion in deposits, to resolve the Justice Department's antitrust concerns from the sale of HSBC’s branch network in upstate New York to First Niagara.

"The Administration has responded to Congress’ call for input on the cybersecurity legislation that our Nation needs, and we look forward to engaging with Congress and, specifically, this Committee as you move forward on this important issue," said Deputy Section Chief Richard Downing.

A federal grand jury in San Jose, Calif., Wednesday indicted Ashvin Desai of San Jose on three counts of tax evasion, two counts of willfully aiding the preparation of materially false tax returns and three counts of failing to file Reports of Foreign Bank and Financial Accounts.

"The pillars of the division’s work are civil merger and non-merger enforcement, criminal enforcement, competition advocacy, and international activities and we have been active in all those areas," said Acting Assistant Attorney General Pozen.

"“In response to my call to identify savings across the department, almost $700 million in savings have been developed – funds that are being reinvested in critical mission areas. I also want to note that, in the department’s FY 2013 budget of $27.1 billion, proposed spending increases have been exceeded by proposed cuts," said Attorney General Holder.

"Despite the significant fiscal constraints the federal government has faced in recent years, the 116,000 dedicated employees who serve in Department offices around the world have made significant – and, in many cases, historic – progress in safeguarding our citizens from terrorism, violent crime, financial fraud, and a range of threats that often disproportionately threaten the most vulnerable members of society," said Attorney General Holder.
