The Police Officer Who Killed 12-Year-Old Tamir Rice Has Been Fired

The police officer who fatally shot 12-year-old Tamir Rice in a Cleveland park in November 2014 has been fired, Cleveland's police chief said at a press conference on Tuesday. The decision comes two and a half years after Rice was killed. Officer Timothy Loehmann was fired not for shooting Rice but for lying on his job application about his disciplinary record at a previous police department, according to the termination documents. (Another officer who had been on the scene of the shooting was suspended for 10 days.)

Loehmann, who started working for the Cleveland Police Department in early 2014, failed to disclose that although he voluntarily left his job at another department, he was allowed to resign after a series of incidents in which supervisors deemed him unfit for duty, according to Cleveland.com. He also did not disclose that he had failed a written exam for employment at a second police department.

Loehmann shot Rice after he and his partner responded to a 911 call about a person in a park waving a gun. His death became an early touchstone for the Black Lives Matter movement. Video of the shooting showed that Loehmann shot the child, who was holding a toy pellet gun, within two seconds of arriving on the scene. A grand jury declined to charge the officers involved.

A dispatcher who took the initial 911 call was suspended in March for failing to tell the responding officers that the caller had said the person with the gun might be a juvenile and that the gun could be fake. A June 2015 Mother Jones investigation revealed how that failure contributed to the child's  death.

These two matters have come up against almost identical backdrop of proceedings recorded by Tamil Nadu Electricity Regulatory Commission (hereinafter referred to variously as "TNERC" or "State Commission" or "Commission"), the Appellant in first captioned appeal being Madurai Power Corporation Private Limited, which was the petitioner in D.R.P. No. 19 of 2012, the second captioned appeal having been instituted by Samalpatti Power Company Private Limited, petitioner in D.R.P. No. 16 of 2012.

It appears that the said two petitions had come up for consideration before the State Commission around the same point of time, the hearing having been concluded, the orders having been reserved by similar proceedings recorded on 21.12.2018. Noticeably at that stage, the State Commission was functional in full strength with the Chairman and two Members in position. Before orders could be passed in either of the said matters, one of the members (Mr. G. Rajagopal) Appeal No. 127 of 2019 and Appeal No. 146 of 2019 Page 3 of 8 demitted office in January, 2019. Meanwhile, certain written submissions had been placed on record by the parties which were respondents before the State Commission (respondents in these appeals as well). Along with the said written submissions, certain documents were submitted to which exception was taken by the appellants primarily on the ground that it was new material, taking on board the same amounting to (as per their contention) amendment of the pleadings, it being statedly impermissible at the stage at which it had been tendered for record. Since the Registry of the Commission seems to have returned such material upon objections being taken, the respondents herein were constrained to file applications - i.e. IA No. 1 of 2019 in the first captioned matter and IA No. 2 of 2019 in the other matter.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. . To link the Debit Authorization Form with the loan agreement involved, an account statement was placed on record. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, intimating return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.
