The U.S. District Court for the Eastern District of Virginia has approved a comprehensive settlement agreement between the United States and the Commonwealth of Virginia, resolving the department’s findings that Virginia’s system for serving people with intellectual and developmental disabilities violated the Americans with Disabilities Act (ADA). The department had found that Virginia was violating the ADA requirement, as interpreted by the Supreme Court’s decision in Olmstead v. L.C., to provide people with intellectual and developmental disabilities the opportunity to live and receive services in the community.

Eight individuals and a Miami-based corporation were convicted by a federal jury for their participation in a Medicare fraud scheme involving the submission of more than $50 million in fraudulent billings to Medicare.

"We have reason to hope because over the last three and a half years, President Obama and Attorney General Holder have been unmistakable and unwavering in making Indian country issues in general -- and tribal sovereignty in particular -- a high, Administration priority, consistent with our desire to see all tribes thrive as prosperous, vibrant, and safe communities," said Acting Associate Attorney General West.

The Justice Department announced today that it seeks to intervene in a class action lawsuit against the Law School Admission Council (LSAC) in federal court in San Francisco to remedy violations of the Americans with Disabilities Act (ADA). The lawsuit, The Department of Fair Employment and Housing v. LSAC, Inc., et al., charges LSAC with widespread and systemic deficiencies in the way it processes requests by people with disabilities for testing accommodations for the Law School Admission Test (LSAT). As a result, the lawsuit alleges, LSAC fails to provide accommodations where needed to best ensure that those test takers can demonstrate their aptitude and achievement level rather than their disability.

John Wyss, aka “Bones,” 55, of Monroe, Wis., was sentenced by U.S. District Judge Maurice Hicks in the Western District of Louisiana.

Roland J. Flath, 72, of Fond du Lac, Wis., was sentenced in U.S. District Court in the Eastern District of Wisconsin by Judge J.P. Stadtmueller.

The Justice Department today announced that Rawland Leon Sorensen, the owner and manager of dozens of residential rental properties in Bakersfield, Calif., will be obligated to pay more than $2 million in monetary damages and civil penalties to settle a Fair Housing Act lawsuit alleging that he sexually harassed women tenants and prospective tenants.

Joshua Gardner, 29, was sentenced by U.S. District Judge Ann D. Montgomery in the District of Minnesota.

Four individuals were charged in court documents unsealed today in the Eastern District of Michigan for their participation in a Medicare fraud scheme involving home health services.

Five individuals were charged in court documents unsealed today in the Eastern District of Michigan for their participation in a Medicare fraud scheme involving purported home health and psychotherapy services.

A 22-count federal indictment was unsealed today in federal court in New Orleans charging Connie M. Knight, 46, with impersonating a federal employee for the purpose of enticing people to pay her for fraudulent hazardous waste safety training.

New Mexico-based Akal Security, Inc., one of the largest providers of security services at federal courthouses, agreed to pay $1,875,000 to resolve allegations that it failed to appropriately conduct firearms testing in the Northern District of California.

"In so many different ways, this organization – along with its ever-expanding network of partners – has been instrumental in improving lives and bringing positive change to communities across this city," said Attorney General Holder.

"That’s why today’s Justice Department is determined – and I am determined – to meet acts of senseless violence with renewed vigilance. Federal and tribal officials joined together in Tulsa, Okla., today in commemorating October as Domestic Violence Awareness Month at opening ceremonies before the department’s annual tribal consultation on Violence Against Native Women, held this year in Tulsa.

Attorney General Eric Holder, Deputy Attorney General James Cole, U.S. Attorney for the District of Maryland Rod Rosenstein, and Bureau of Justice Assistance Deputy Director, Kristen Mahoney, today announced more than $2.4 million in grants to 13 jurisdictions to combat the purchase and sale of counterfeit and pirated products. Intellectual Property theft refers to the violation of criminal laws that protect copyrights, patents, trademarks, other forms of intellectual property and trade secrets, both in the United States and abroad.

"Imitation may be the highest form of flattery, but American industry is not looking to be flattered by thieves engaged in illicit competition. Industry seeks a fair and level marketplace where American innovation can thrive," said Deputy Attorney General Cole.

"Although these awards will be utilized in a variety of ways, they will help to achieve our common goals: to advance prosecutions – as well as prevention and education activities – related to IP theft," said Attorney General Holder.

Medicare Fraud Strike Force operations in seven cities have led to charges against 91 individuals – including doctors, nurses and other licensed medical professionals – for their alleged participation in Medicare fraud schemes involving approximately $429.2 million in false billing.

Paulo Morales, 48, of Miami, was sentenced today by U.S. District Judge Robin S. Rosenbaum to 33 months in prison along with one year supervised release, the Justice Department announced. In July, Morales, a former Customs and Border Protection (CBP) officer, pleaded guilty to three misdemeanor counts of deprivation of rights under color of law.

The Justice Department announced today the unsealing of an indictment charging 10 individuals in connection with a vending machine “business opportunity” that defrauded thousands of victims across the country.

Gregory Thomas Miller, 57, of Deville, La., pleaded guilty on April 27, 2012, to a 10-count indictment charging him with seven counts of production of child pornography, one count of transporting child pornography, one count of possessing child pornography and one count of marijuana possession.

Attorney General Eric Holder recognizes 282 department employees for their distinguished public service today at the 60th Annual Attorney General’s Awards Ceremony. Fifty-seven other individuals outside of the department are also honored for their work. Sylvester Bruce, 45, a former corrections officer with Navajo Nation’s Shiprock Detention Center (SDC) in Shiprock, N.M., was sentenced today in federal court on charges related to the sexual abuse of an inmate during the summer and fall of 2010. In July 2012, Bruce pleaded guilty to one count of violating the victim’s civil rights when he touched her breasts against her will. Bruce also pleaded guilty to making material false statements to the FBI when he denied taking pictures of inmates inside the cells of the SDC.

"At the Justice Department, we have made enforcing the rights of American Indians a priority," said Assistant Attorney General Perez.

Lawrence Etsitty , 31, a former police officer with the Navajo Police Department (NPD), was sentenced today in federal court on charges related to the sexual abuse of a woman who was in his custody on Jan. 25, 2009. Earlier this year, Etsitty pleaded guilty to violating the civil rights of the victim when he groped, touched and kissed her against her will, while she was handcuffed. Etsitty also was charged and pleaded guilty to making false statements to the FBI.

The Justice Department and the Equal Employment Opportunity Commission (EEOC) announced today that they have reached a settlement with the Texas Department of Agriculture (TDA) and the Texas General Land Office (GLO) to resolve allegations that both state agencies were liable for pay discrimination on the basis of sex, in violation of Title VII of the Civil Rights Act of 1964 and the Equal Pay Act of 1963.

The Department of Justice and the U.S. Department of Education announced today a new, nearly $1 million grant fund entitled, “Promoting Reentry Success through Continuity of Educational Opportunities”, that will invest in innovative programs preparing incarcerated individuals to successfully reenter society with the support of education and workforce training.

Gordon Chavez, 35, a probation officer with the New Mexico Corrections Department of Probation and Parole, was arrested today in Albuquerque, N.M., on charges related to the sexual assault of a probationer whom he supervised.

Bryan Benson, a former Anderson, Calif., police officer, was arrested today on charges of deprivation of civil rights for sexually assaulting a woman while transporting her to jail and of trying to conceal his criminal conduct, announced the Justice Department.

Scott Edwards, a former Lincoln County, Mo., Sheriff’s Department detective, was sentenced today to 10 years in prison followed by three years supervised release for violating the constitutional rights of five women through acts of aggravated sexual abuse and sexual contact while serving as their “drug court tracker,” when the women were participants in the Lincoln County Drug Court program.

A dual United States and Costa Rican citizen charged in connection with the operation of a series of fraudulent business opportunities was arrested today in Chicago following his indictment by a federal grand jury in Miami on Nov. 29, 2011, the Justice Department and the U.S. Postal Inspection Service announced today. Sean Rosales was arrested based on charges that he and his co-conspirators purported to sell beverage and greeting card business opportunities, including assistance in establishing, maintaining and operating such businesses. The charges in the indictment form part of the government’s continued nationwide crackdown on business opportunity fraud.

A New Jersey woman was sentenced today to serve 30 years in prison for producing child pornography through the sexual exploitation of a 5-year-old girl on more than one occasion and streaming footage of a sexual assault over the Internet.

A federal grand jury in Albuquerque, N.M., has indicted Gordon Chavez, 35, a probation officer with the New Mexico Corrections Department on charges related to the sexual assault of a probationer whom he supervised. The New Mexico Corrections Department placed Chavez on administrative leave following his arrest on Dec. 4, 2012.

"Although no speech or ceremony can erase the pain that you’ve carried with you since that terrible night – by gathering to exchange stories, to share memories, and to lift up the legacies of those we’ve come to remember – I am confident that this community can continue to heal, to grow, and to move into a brighter future," said Attorney General Holder.

The Justice Department today announced a settlement agreement with Peroutka and Peroutka P.A., a debt collection law firm based in Pasadena, Md., to resolve allegations that the law firm violated the Americans with Disabilities Act (ADA) by discriminating against people who are deaf.

A Massachusetts man was sentenced today to serve 45 years in prison for his participation in an international criminal network, known as Dreamboard, dedicated to the sexual abuse of children and the creation and dissemination of graphic images and videos of child sexual abuse throughout the world.

The Justice Department today announced that property manager Rudy Ferrante agreed to a $15,000 civil judgment against him, to resolve allegations that he sexually harassed female tenants in Portland, Maine.

A former minister pleaded guilty today in North Carolina to engaging in illicit sexual conduct in Haiti.

Connie M. Knight, 46, previously of Belle Chasse, La., pleaded guilty in federal court in New Orleans today to three felony criminal charges and one misdemeanor criminal charge for creating false identification documents an impersonating a federal official.

"Today, more than ever, we must summon the courage to confront even the most intractable public safety challenges. And we must reject the notion that partisan gridlock and political convenience are acceptable reasons for inaction – particularly when lives are at stake, and the most vulnerable members of our society – our children – are depending on us," said Attorney General Holder.

"I’m especially proud of the part that we – at the Office of Justice Programs – have played in improving knowledge about what works in the fields of criminal and juvenile justice. Our National Institute of Justice and Bureau of Justice Statistics have, for many years, made significant contributions to our base of knowledge," said Acting Assistant Attorney General Leary.

Five individuals and five corporations have been charged in an indictment unsealed today in Brooklyn, N.Y., for allegedly importing hazardous and counterfeit toys from China for sale in the United States.

"In fact, this initiative constitutes a significant step forward in fostering increased levels of engagement with these partners and with Congress, in establishing a productive partnership between the Department of Justice and NIST, and in strengthening our ability to realize the goals and priorities that we all share," said Acting Assistant Attorney General Tyrangiel.

"We have made protecting consumers a centerpiece of the Department’s overall anti-fraud efforts because consumer fraud affects ordinary people every day and can devastate victims," said Principal Deputy Assistant Attorney General Delery.
