What Happened to Val Kilmer? He’s Just Starting to Figure It Out. - The New York Times

By now I understood that the story I was telling about Val Kilmer, which I’d thought had been about a man’s relentless faith and optimism, was really about reconciliation: the squaring of two opposing things into something we swear is true despite all evidence to the contrary. Your beauty can sentence you to misery; Val Kilmer uses a tracheostomy tube, but he can talk; his brother is dead but only to our senses. Mark Twain despised Mary Baker Eddy, until you can will him into a dream where he doesn’t. God is good, and there are no ventilators. My beautiful friend has cancer, and the treatment exists, but it’s unavailable to her right now.

Timm v. Goodyear Dunlop Tires North America

(United States Seventh Circuit) - Affirmed. A lawsuit arising from a terrible motorcycle accident that alleged defects in the tires and helmets involved failed because the plaintiffs didn't present admissible expert testimony to support their claims.

tim

District No. 1 Pacific Coast v. Liberty Maritime Corp.

(United States DC Circuit) - Reversed and remanded. The district court had jurisdiction over a Labor Management Relations Act Claim relating to a maritime labor union because the act provides federal jurisdiction over suits for violation of contracts between employers and labor organizations.

tim

Palin v. The New York Times Company

(United States Second Circuit) - Vacated and remanded. Palin appeals the dismissal of her defamation complaint against The New York Times for failure to state a claim. Finding the district court erred in relying on facts outside the proceedings, the case is remanded for further proceedings.

tim

Time Warner Cable Inc. v. County of Los Angeles

(California Court of Appeal) - Reversed in part a ruling addressing how much money Los Angeles County may tax Time Warner Cable. The plaintiff in this lawsuit, Time Warner, argued that the county government was taxing it more than the law allowed for its use of public rights-of-way. On appeal, the Second Appellate District held that the county was not required to value the possessory interests based only on five percent of cable television revenue. In all other respects the panel affirmed the trial court's judgment.

tim

Optimum Techs., Inc. v. Henkel Consumer Adhesives, Inc.

(United States Eleventh Circuit) - In dispute arising out of distributorship agreement and competing adhesive products for floor coverings, judgment for defendants is affirmed over claims that the district court erred in granting: 1) partial summary judgment for defendants on plaintiff's claims of trademark infringement and unfair competition; 2) summary judgment in favor of defendants on plaintiff's claims of breach of confidential relationship, breach of fiduciary duty, fraudulent concealment, fraud, and negligent misrepresentation; and 3) granting defendants' renewed motion for judgment as a matter of law on plaintiff's trademark and unfair competition claims, due to a lack of evidence establishing plaintiff's damages.

Balfour Beatty Infrastructure, Inc. v. Mayor and City Council of Baltimore

(United States Fourth Circuit) - In a construction company's suit against a city for breach of contract, alleging that the city unlawfully assessed liquidated damages against the company for failure to complete a construction project on time, the district court’s dismissal for lack of subject matter jurisdiction is affirmed where plaintiff is not excused from the normal requirement of administrative exhaustion under Maryland law.

tim

O'Boyle v. Real Time Resolutions, Inc.

(United States Seventh Circuit) - Affirmed the dismissal of a consumer's proposed class action, which alleged that a debt-collection letter violated the Fair Debt Collection Practices Act. The letter allegedly stated that important information was on the back of its first page, but the information was on the front of its second page.

Tima v. Attorney General of the US

(United States Third Circuit) - Denied an alien's petition for review of a decision ordering him removed from the United States. The Board of Immigration Appeals had ruled that the citizen of Cameroon, who entered the U.S. on a student visa in 1989, was ineligible for waiver of removal because his felony conviction of making false statements about a sham marriage constituted a crime involving moral turpitude. On appeal, the Third Circuit agreed that the man was not eligible for a fraud waiver, and thus denied his petition for review.

(United States Fourth Circuit) - Affirming the district court's determination that a hospital did not fail to pay funds owed Medicate for the treatment of the plaintiff's mother, despite being a bit late in their payment, meaning that the plaintiff was not entitled to double damages under the Medicare Secondary Payer Act.

Editorial: Ethics in the time of coronavirus

The world has been thrust into an unprecedented time. The White House has estimated that 100,000 to 240,000 Americans could die in the coming months as a new virus sweeps through the nation and that’s if we implement and execute the recommendations from our doctors and scientists. About 700,000 jobs were lost in the U.S. in March as mayors and governors across the nation responded responsibly by forcing all but the most essential businesses to close.

Kiszla: Saying goodbye, unable to give a final hug to my dying mother, during the time of coronavirus

During the final minutes of her life, heartbeat fading, my mother was too weak to speak or open her eyes. But 1,500 miles away from where hospice had gently laid her down to die, I felt the strength of her spirit pushing me out the door. So I grabbed cross-country skis from the garage, clicked boots into my bindings and glided across a cold, empty meadow, where I surrendered Mom to the hand of God.
