(United States Second Circuit) - Affirmed the confirmation of an arbitration award issued by a rabbinical tribunal. Two groups of Hasidic Jews had agreed to arbitrate a trademark dispute before the tribunal, and then the winning side sought to confirm the award in secular court. The Second Circuit held that the district court properly exercised subject matter jurisdiction and confirmed the award.

Bland v. City of Newark

(United States Third Circuit) - Held that police officers were entitled to qualified immunity from claims arising out of a wild high-speed chase that ended with the motorist being shot between 16 and 18 times. The apparently unarmed motorist and his wife filed this suit alleging that the officers violated the motorist's Fourth Amendment rights. On interlocutory appeal from the denial of qualified immunity, the Third Circuit held that the officers' conduct was within the bounds of the Supreme Court's relevant decisions regarding the use of lethal force, and the officers were entitled to summary judgment on qualified immunity grounds.

Savage v. State of Maryland

(United States Fourth Circuit) - Affirming in part the dismissal of an African-American police officer's discrimination and retaliation claims against a state prosecutor for reading aloud criminal suspects' letters containing racial epithets at a trial preparation meeting that the officer attended. The Fourth Circuit held that the police officer did not state a claim for racial harassment or retaliation as no reasonable employee could believe that the prosecutor's conduct violated civil rights law and because the prosecutor was protected by absolute prosecutorial immunity.

(United States Seventh Circuit) - District court's granting of summary judgment and bench verdict for Defendant affirmed. Sherman Act claim fails where the only current feasible way to comply with Chicagoland area city commercial fire safety ordinances was to use an exclusive provider. Under Fisher v. City of Berkeley, government restraints on trade imposed unilaterally do not form the basis of a Section 1 or Section 2 claim.

(United States First Circuit) - Reinstated a university professor's claims that she was retaliated against in violation of Title VII and the Maine Human Rights Act. The professor alleged that she was transferred to a different department and suffered other retaliation after she complained of being sexually harassed by her department chair. Agreeing that genuine disputes of material fact existed, the First Circuit reversed the entry of summary judgment for the university and remanded.

Narragansett Indian Tribe v. Rhode Island Department of Transportation

(United States First Circuit) - Affirmed the dismissal of an Indian tribe's complaint against federal and Rhode Island agencies concerning a highway bridge reconstruction. The tribe argued, at base, that the state of Rhode Island broke a promise to give the tribe three parcels of land as mitigation for the expected negative impact on historic tribal land of an I-95 bridge replacement project. Agreeing with the district court, the First Circuit held that the tribe's claims were barred by federal sovereign immunity and lack of subject matter jurisdiction.
