A trio of Apple customers this month filed a class action lawsuit against Apple, accusing the Cupertino company of violating California consumer protection laws and false advertising for continuing to sell AirPods Pro models that had ongoing issues with crackling or static sounds.


A few months after the ‌AirPods Pro‌ came out in October 2019, buyers began to complain about crackling, rattling, popping, and static-like noises affecting the ‌AirPods Pro‌. The sound seemed to show up when something caused an earbud to move or vibrate, such as walking or running.

Apple tried to fix the problem with software updates, but the company ultimately launched an ‌AirPods Pro‌ repair program in October 2020. Customers with affected ‌AirPods Pro‌ were able to bring them to Apple for a fix or a replacement, but unfortunately, many customers found that their replacement ‌AirPods Pro‌ also suffered from the same issue.

As a result, Apple is now facing a class action lawsuit, with the plaintiffs requesting "relief" due to the defective nature of the ‌AirPods Pro‌. The complaint says that customers would not have purchased the ‌AirPods Pro‌ or would have paid less had Apple made the flaw clear.

Apple is also being accused of false advertising for highlighting features like "superior sound quality" and "pure, incredibly clear sound" when knowing there was an issue with crackling and static.

The court will need to decide if the arguments made here hold up, and whether the case deserves class action certification.

AmiMoJo writes: The climate-damaging vapors left behind by jet planes could be easily tackled, aviation experts say, with a new study suggesting they could be eliminated for a few pounds per flight. Jet condensation trails, or contrails, have spawned wild conspiracy theories alleging mind control and the spreading of disease, but scientists say the real problem is their warming effect. "They create an artificial layer of clouds, which traps the heat from the Earth that's trying to escape to outer space," said Carlos Lopez de la Osa, from the Transport & Environment campaign group, which has carried out a new study on the solutions to contrails. "The scale of the warming that's associated with them is roughly having a similar impact to that of aviation carbon emissions." Tweaking the flight paths of a handful of aircraft could reduce contrail warming by more than half by 2040, at a cost of less than $5.1 per flight. Geography and a flight's latitude have a strong influence on whether a contrail is warming. Time of day also influences the climate effects of contrails. Those formed by evening and night flights have the largest warming contribution. Seasonality is also important -- the most warming contrails tend to occur in winter. "Planes are already flying around thunderstorms and turbulence areas," Mr Lopez de la Osa said. "We will need to add one more constraint to flight planning, which is avoiding areas of contrail formation."

In England, the introduction of family names is generally attributed to the Normans and the Domesday Book of 1086. Documents indicate that surnames were first adopted among the feudal nobility and gentry, and only slowly spread to the other parts of society. Some of the early Norman nobility arriving in England during the Norman Conquest differentiated themselves by affixing 'de' (of) in front of the name of their village in France. This is what is known as a territorial surname, a consequence of feudal landownership. In medieval times in France, such a name indicated lordship, or ownership, of the village. But some early Norman nobles in England chose to drop the French derivations and call themselves instead after their new English holdings. -- True surnames, in the sense of hereditary appellations, date in England from about the year 1000. Largely they were introduced from Normandy, although there are records of Saxon, surnames prior to the Norman Conquest. By the end of the twelfth century hereditary names had become common in England. But even as late as 1465 they were not universal.
