The Department of Justice filed a complaint today in the United States District Court for the District of Colorado on behalf of Naval Petty Officer Third Class Lindsey Hunger against Walmart Inc. The complaint alleges that Walmart violated the law when it declined to hire Hunger due to her upcoming naval reserve duties.

The Department of Justice announced today the resolution of a lawsuit in which Naval Petty Officer Third Class Lindsey Hunger alleged that Walmart violated her rights when it failed to offer her employment at the Walmart store located at 2545 Rimrock Avenue in Grand Junction, Colorado because of her upcoming Naval Reserve commitments. Ms. Hunger had alleged that Walmart’s actions violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). The Department of Justice Civil Rights Division and United States Attorney’s Office represented Petty Officer Hunger in the lawsuit.

Also provided by this invention is a process for reducing the amount of soluble halide in a slurry comprising a liquid organic medium, at least one viscosity reducing agent, at least one dihydrocarbylmagnesium compound, solids from the formation of said dihydrocarbylmagnesium compound, and an initial amount of soluble halide. This process comprises mixing at least one alkali metal with the slurry at a mole ratio of alkali metal to magnesium of less than about 1:1.25, thereby forming precipitated soluble halides.

This episode, we talk to hip-hop impresario Michael Holman. Holman was instrumental in bringing the burgeoning culture in Uptown NYC in the late 1970s — the breakdancers, the DJs, the rappers, and the aerosol artists — to a Downtown crowd and, shortly afterwards, to the rest of the world. He wrote books, made short films, hosted TV shows, made albums, managed breakdance troupes, acted in movies, hosted live shows, you name it. Holman also co-founded the band Gray, whose members have included the legendary artist Jean-Michel Basquiat and film director Vincent Gallo.

He is perhaps best known for Graffiti Rock, a TV show he created and hosted in 1984, which was a Soul Train-style show for hip-hop. While it only aired for one episode, its influence is still being felt. In fact, Holman is currently putting together a documentary on the making of Graffiti Rock. The New Yorker’s fiction editor, Deborah Treisman, talks with Salman Rushdie about “Quichotte,” his apocalyptic quest novel. A few years ago, when the four hundredth anniversary of “Don Quixote” was being celebrated, Rushdie reread Cervantes’s book and found himself newly engaged by a much-improved translation. He immediately began thinking of writing his own story about a “silly old fool,” like Quixote, who becomes obsessed with an unattainable woman and undertakes a quest to win her love. This character became Quichotte (named for the French opera loosely based on “Don Quixote”), who is seeking the love of—or, as she sees it, stalking—a popular talk-show host. As Quichotte journeys to find her, he encounters the truths of contemporary America: the opioid epidemic, white supremacy, the fallout from the War on Terror, and more. “I’ve always really liked the risky thing of writing very close up against the present moment,” Rushdie tells Treisman. “If you do it wrong, it’s a catastrophe. If you do it right, with luck, you somehow capture a moment.” At the same time, the novel gives full rein to Rushdie’s fantastical streak—at one point, for instance, Quichotte comes across a New Jersey town where people turn into mastodons. Treisman talks with the author about the influence of science fiction on his imagination, and about his personal connection to the tragedy of opioids. Rushdie’s much younger sister died from the consequences of addiction, and the book is centrally concerned with siblings trying to reconnect after separation.

Three Dollars is the story of Eddie Harnovey, a honest, compassionate man with a brilliant wife, Tanya, and a beautiful, if possibly epileptic, daughter Abbey. Eddie's life revolves around work and the three women in his life; the third is Amanda, a childhood sweetheart who re-appears in his life with mathematical precision every nine-and-a-half years. Eddie has a lovely house in the suburbs, he has a strong moral conscience, he's intelligent and witty, and the world around him is falling apart. On the brink of bankruptcy with just $3 to his name, has he made the wrong choices?Perhaps a large part of the answer lies in the speed with which we live our lives. It is easy to feel sympathy for Eddie as he bemoans the pace of change: "Everything happens too quickly to be understood while it is happening. Analysis is impossible until the event is over."A more likely cause of Eddie's predicament may lie in the fact that his wife is about to lose her teaching position at the university and Eddie, an engineer working for the Department of Environment, has been asked by his wife's former lover to falsify a report to allow a smelting plant to be built by Amanda's father.The depth of these relationships is explored with insight and great wit, unpicking those worries that come to us at night while, like Eddie, we lie and notice (and usually ignore) the cracks and flaking of paint on the bedroom ceiling. For Eddie, it is a time to rank debts and what has become the persistence and tyranny of the day-to-day struggle to financially survive.Three Dollars was written in 1998, but set in the times of Australia's introduction to what the surely misnamed 'economic rationalism'. The obsession with material goods and the soulless never-ending pursuit of profit are both a target for Eddie's scorn as well as a source of hilarious black comedy. Written with great humour and prose which at times may seem just a little too deliberate, Three Dollars is as pertinent today as it was in the 1990s.There are times, however, when the characters' tendency to editorialise or sermonise is a touch overwhelming, even if the sentiments seem sound or relevant to Australian politics today. Take this monologue from Eddie's wife, Tanya:"People's fear of change and their despair at the lack of certainty in any area of their lives, particularly where the social and the personal meet, that is with respect to their jobs and income, if it lasts long enough, will lead them to abandon reason, to be suspicious of it and to look for scapegoats and simplistic solutions. The wisdom or correctness of a government's decision will scarcely be discussed but instead attention will be focused on the strength with which the decision was made, the apparent certainty, the conviction with which it was implemented."Admittedly, Tanya is a university politics lecturer, but the moral hectoring in the novel can easily distract from the plot and soon become tiring.Ignoring the occasional sermon, however, Three Dollars an entertaining read, beautifully written and extremely funny. It sat on my bookshelf for over a decade and was rescued only because the mixed reviews for Perlman's latest novel, The Street Sweeper, made me curious. No ambiguity about Three Dollars though: compelling, dramatic and a disconcertingly humorous reflection of the way so many of us live our lives. In 2005, Three Dollars was made into an Australian movie, starring David Wenham. A superb interpretation of the novel, both film and book are highly recommended.

(United States Third Circuit) - Reversing a district court determination that a man complaining that the NFL's policies relating to the sale of SuperBowl tickets violated New Jersey law lacked subject matter jurisdiction and deferring action on the merits of the appeal pending a decision by the Supreme Court of New Jersey on a petition for certification of questions of state law, retaining jurisdiction over the appeal pending resolution of the certification.

(United States DC Circuit) - Reversed. Plaintiffs offered the chance to apply for a select number of diversity visas that were never granted and whose statutory deadline had passed did not have a moot claim because the district court retained the authority to potentially award relief.

(United States Supreme Court) - In a case involving the tipper and tippee liability provisions of Section 10(b) of the Securities Exchange Act of 1934 and the Securities and Exchange Commission's Rule 10b-5, defendant's conviction of federal securities-fraud crimes for trading on inside information he received from a friend and relative-by-marriage, is affirmed where: 1) the Ninth Circuit properly applied Dirks v. SEC, 463 U.S. 646, to affirm defendant's conviction; and 2) under Dirks, the jury could infer that the tipper here personally benefited from making a gift of confidential information to a trading relative.

(United States Federal Circuit) - The district court's orders purporting to clarify a preliminary injunction and enjoining defendants from using various materials and processes first developed by plaintiff, are vacated and remanded, where the district court lacked jurisdiction over this case when plaintiff initiated this lawsuit because plaintiff's complaint does not allege a sufficient controversy concerning inventorship, but instead concerns only ownership of the disputed patent.

(United States Third Circuit) - In a suit brought by a shareholder of retailer-defendant, seeking to include its proposal in defendant's proxy materials for shareholder consideration, the district court's judgment in favor of plaintiff ordering the inclusion of the proposal into the proxy materials is reversed where the proposal, which goes to the heart of defendant's business, is excludable under the "ordinary business" exclusion of SEC Rule 14a-8(i)(7), 17 C.F.R. section 240.14a-8(i)(7).
