(United States Federal Circuit) - Reversed finding of the International Trade Commission (ITC) that plaintiff had violated Section 337 of the Tariff Act of 1930 by importing components of automated teller machines that infringed on certain patents. The court reasoned that the term “cheque standby unit” is a means-plus-function term and lacks corresponding structure disclosed in the specification.

(California Court of Appeal) - Reversed. Defendant was judged a mentally disordered offender (MDO) for bipolar disorder. With his bipolar disorder in remission, a re-commitment order was sought for Defendant’s pedophilia. The appeals court held that a re-commitment order must be based on the same mental disorder that was the basis of the original commitment.

(United States Fourth Circuit) - Affirmed the conviction of a Norfolk, Virginia, city council member for wire fraud, extortion under color of official right, conspiracy to commit such offenses, and two counts of perjury. The charges stemmed from the council member's solicitation of bribes from local real estate developers. He raised various substantive and procedural challenges to his conviction, but the Fourth Circuit found no merit in them and affirmed.

(United States Sixth Circuit) - In a copyright and trade secret infringement suit brought by a provider of credit union software against the developer of a competing credit union software, district court's grant of summary judgment in favor of the defendant is affirmed where: 1) district court did not abuse its broad discretion in refusing to compel additional discovery and plaintiff can point to no errors of fact or law in the court's denial of its employees access to defendant's software; 2) district court did not abuse its discretion in barring the use of an expert's report because the report failed to comply with the requirements of Fed. Rule of Civ. Proc. 26(a)(2)(B); 3) plaintiff was not entitled to take the deposition of defendant's expert witness because defendant designated him as a non-testifying expert; 4) district court did not abuse its discretion in declining to impose a sanction on defendant because plaintiff was not left without a remedy for any harm caused by the third party's spoliation; 5) defendant was entitled to summary judgment on the merits on the copyright infringement claims because plaintiff has not produced any direct evidence of copying and indirect evidence of copying was not sufficient to create a fact question as to whether copying occurred; and 6) district court correctly held that plaintiff's end user product was not a trade secret because plaintiff did not take reasonable steps to maintain its secrecy.

(United States First Circuit) - The decision of the United States Tax Court holding petitioner liable, as the recipient of a fraudulent transfer from his former company, for the company's back taxes of over $4.9 million, plus interest of at least $8.7 million, is: 1) reversed in part and remanded, where the tax court calculated prejudgment interest under the wrong statute, which should have been determined in accord with Massachusetts law, and under Massachusetts law, no interest would have begun to accrue until the date of the Notice of Liability; but 2) affirmed in part, where petitioner's loans to his former company to pay petitioner's litigation expenses did not reduce the net amount transferred to him.

(United States Seventh Circuit) - Affirmed. An insurer that did not receive timely notice of an accident could not be compelled to provide coverage.

(United States Third Circuit) - Affirmed the denial of habeas relief to a defendant who alleged violation of his Confrontation Clause rights. The defendant, who was convicted of third-degree murder, challenged the use of prior statements of a witness who refused to answer any substantive questions on cross-examination. While agreeing that the defendant's rights were violated, the Third Circuit concluded that his Confrontation Clause claim was procedurally defaulted and there was no cause to excuse the default here.

(United States First Circuit) - Rejected a petition for review of a decision of the federal Surface Transportation Board (STB). The basic issue here was whether a local government could regulate certain activities at a rail-to-truck transloading facility. The petitioners, who lived near the facility, argued that the STB did not have exclusive jurisdiction and thus local regulation was permitted. Finding no basis to reverse the STB's ruling regarding the scope of its exclusive jurisdiction, the First Circuit rejected the petition for review.
